These are not process arguments; they are factual arguments central to the constitutional framework of our government. The failure of a full House vote to authorize the House Judiciary Committee to pursue evidence -via enforceable subpoenas- was a defect by design of liar-Nancy Pelosi’s decision to initiate an impeachment inquiry by her decree, not an authorizing vote. White House lawyer Patrick Philbin explains the legal issue; this could be the lead argument in the defense case when it starts. CTH noted this structural issue last August, and the issue remained throughout the heavily manipulated proceedings. None of the House requests for testimony or documents held any enforcement authority because the House did not follow the constitutional process. The House was not issuing subpoenas, it was issuing letters requesting voluntary witness participation and document production. Recently the DOJ Office of Legal Counsel explained this issue in a lengthy legal finding that leads to the same conclusion...

Linsdey Graham (R-S.C.) unloaded some heated criticism on congressional Democrats on Wednesday over their actions in the Senate impeachment trial so far... saying that they were on a "crusade to destroy" President Donald Trump. At a Wednesday news conference flanked by fellow GOP Sens. Mike Braun (Ind.) and Steve Daines (Mont.), Graham described Democrats' previous demands on the rules of the Senate trial as "an effort to ask the Senate to ignore every privilege that President scumbag/liar-Clinton was able to exercise, Nixon was able to exercise, and to suggest to the Senate that an independent judiciary, really, is a non-player." "If I were the president I wouldn't cooperate with these guys at all," Graham said of those behind the impeachment effort. "I wouldn't give them the time of day. They're on a crusade to destroy this man and they don't care what they destroy in the process of trying to destroy Donald Trump. I do care." The Senate was in session until the early morning hours Wednesday as the result of several Democrat-sponsored amendments to the trial rules package having to do with calling new documents and witnesses. During debate about one of those amendments, House manager scumbag liar-Jerry Nadler accused the senators opposed to it of wanting a "cover-up" rather than trying to get to the truth. In Graham's Wednesday remarks, he appeared to allude to scumbag liar-Nadler's "cover-up" comments, saying "To my Democratic colleagues, you can say what you want about me, but I'm covering up nothing; I'm exposing your hated of this president to the point where you would destroy the institution." The debate about subpoenaing witnesses and documents has become a major point of contention in the Senate's trial as a result of House investigators' decision not to take White House's claims of privilege to federal court during the course of last year's inquiry. Under the adopted rules of the trial, the question of bringing in more witnesses will be taken up later in the process...

To highlight the point, Democrat Senator Dianne Fein-stein, the ranking member of the Senate Judiciary Committee, simply walked out during the trial when scumbag/liar-Adam Schiff was testifying; said “goodnight” and just went home.

by ~ House Judiciary Committee Chairman scumbag liar-Jerry Nader was one of the impeachment managers liar-Nancy Pelosi picked to try the case in the Senate. On the first day scumbag liar-Nadler was already wishing liar-Pelosi picked someone else... And that’s because scumbag liar-Jerry Nadler never knew what him when Donald Trump’s lawyer shut him down with this jaw-dropping truth bomb. Democrats spent the first day of the trial wasting everyone’s time with procedural votes over subpoenaing witnesses and documents despite the Republican majority passing rules following the scumbag/liar-Clinton impeachment model where all decisions on witnesses would come after each side made their opening arguments and the Senators had time to ask questions. scumbag liar-Nadler argued one motion to subpoena former National Security Advisor John Bolton’s testimony would “put the United States Senate on trial” and that the President’s lawyers were “lying.” Democrats argued all day that Republicans were engaging in a cover up because they would not allow Democrats to run the Senate trial. scumbag liar-Nadler made that very argument in the wee hours of that morning and that set off White House Counsel Pat Cippollone. Cippollone’s fiery response was the highlight of the first day of the impeachment witch hoax trial. “Thank you, Mr. Chief Justice, members of the Senate. We came here today to address the false case brought to you by the House managers. […] We’ve been respectful of the Senate. We’ve made our arguments to you. And you don’t deserve, and we don’t deserve, what just happened. Mr. scumbag liar-Nadler came up here and made false allegations against our team. He made false allegations against all of you: he accused you of a ‘cover up.” He’s been making false allegations against the President,” Cippollone began. Cippollone then took scumbag liar-Nadler to task in sharply personal terms...  
Impeachment Trial Kicks Off
Nate Jackson:  The Senate kicked off its impeachment trial yesterday with votes on rules for the proceedings and opening statements from President Donald Trump’s legal team and his Democrat accusers. Chief Justice John Roberts presided and had to rein in a few tempers. “Those addressing the Senate should remember where they are,” Roberts admonished. Though this is only the third time in our nation’s history that a president has stood for an impeachment trial, the proceedings were remarkably — and predictably — unserious. And yet, somehow, that’s quite fitting.

House Democrats failed to make a compelling case for impeachment in their rush to vote before Christmas. They claim to have “overwhelming” evidence for impeachment, while simultaneously hollering about a Republican “coverup” to obstruct the evidence they need. House Democrats want the Senate to aid them by extending the investigation, including calling more witnesses that they didn’t bother calling (John Bolton and Mick Mulvaney, for example. Anyone but Hunter Biden or the whistleblower!). That’s not the Senate’s job, and Majority Leader Mitch McConnell is playing it all about as well as he can.

“Democrats really don’t want to hear more witnesses,”  surmises The Wall Street Journal editorial board. “They merely want to pretend they do, get Republicans to vote against witnesses, and use that as an issue in November. Perhaps Republicans should call them on it.”

While the question of calling witnesses didn’t receive a vote yesterday, McConnell conceded to one more day for each side to present its case and to allow all House evidence without a Senate vote to admit it. The rules were officially adopted in a 53-47 party-line vote at 1:40 a.m.

Those who portray McConnell as having “caved” to moderates on those rules are either unfamiliar with Trump’s Art of the Deal or are willing to attribute such strategic moves only to Trump himself. McConnell has a strategy that provides political cover for Republicans in tough reelection battles like rino-Susan Collins, Martha McSally, and Cory Gardner. As a bonus, he can point to having compromised with Democrats in order to be as fair as possible. Of course, that won’t stop Democrats from caterwauling about a “rigged” trial all the way until Election Day.

But did we mention that Democrats like Chuck scumbag-Schumer have taken the opposite position on rules they took in the 1999 impeachment trial of scumbag/liar-Bill Clinton? We can’t quite put our finger on what’s different now…

Some highlights of the cases made by each side:

“The president is on trial in the Senate, but the Senate is on trial in the eyes of the American people,” pronounced scumbag liar-Jerry Nadler, chairman of the House Judiciary Committee. He slammed Republicans for balking at more witnesses because “only guilty people try to hide evidence.” Except scumbag liar-Nadler insisted just last week that testimony from either Hunter or loose lips liar-Joe Biden would not be “relevant” because he had a “mountain of evidence” that was perfectly sufficient to impeach and remove Trump.

“Let me be very blunt,” said House Intelligence Chairman scumbag/liar-Adam Schiff. “Right now a great many, perhaps even most, Americans do not believe there will be a fair trial. They don’t believe that the Senate will be impartial. They believe that the result is pre-cooked, the president will be acquitted.” Funny, but scumbag/liar-Schiff pre-cooked the impeachment inquiry in the House.

White House Counsel Pat Cipollone, on the other hand, was right on the mark. Democrats have “no case” against Trump. But never mind that, he said; “They’re not here to steal one election, they’re here to steal two elections.”   ~The Patriot Post
