A legislative proposal in South Dakota’s House of Representatives seeks to give the state’s attorney general the authority to review presidential executive orders and possibly nullify those deemed unconstitutional.

“State Rep. Aaron Aylward (R-Harrisburg) introduced HB 1194, which is described as an act ‘to authorize the review of certain executive orders issued by the President of the United States,'” the Daily Wire reported Monday.


The process starts with a review by the Executive Council of the Legislative Research Board, then a referral from the Council sent to the state attorney general and the governor, according to KELO.

“Once the referral has been made, the attorney general may examine the order to determine whether the state can seek an exemption or declare it unconstitutional,” the report continued:

The proposed bill would also allow the attorney general to block implementation of any order deemed unconstitutional if the order refers to:

  • A pandemic or other public health emergency
  • The regulation of natural resources
  • The regulation of the agricultural industry
  • The regulation of land use
  • The regulation of the financial sector through the imposition of environmental, social, or governance standards
  • The regulation of the constitutional right to keep and bear arms

“This isn’t just a President [Joe] Biden issue but rather an overall executive overreach issue that we’ve been experiencing for a long time,” Aylward said.

    • According to Article 5 of the US Constitution, there are (2) Two ways to Amend the US Constitution...

      1.) Article 5 of the Constitution provides Congress with the power to recommend and pass Amendments (by 2/3rd vote in Congress) that MUST BE RATIFIED BY 3/4ths of the States before bcecoming Constitutional.

      2.) Article 5 also requires Congress to call a Convention upon 'application' of 2/3rds of the States to consider amendments to the Constitution which become law upon ratification of 3/4ths of the States legislatures, or in convention, as Congress proposes. 

      A Red State Caucus would go a long way to forcing Congress to 'Call a Constitutional Convention'  in which amendments to the Constitution could be proposed and ratified ... amendments which could be used to restore Constitutional Government by limiting federal power... Congressional, Executive, and Judicial powers could be rapidly removed, limited, and or restated in terms unambiguous to all.

    • Grow them at the state ballot box by recall or election cycle.

    • Challenge your State Legislators and Governor to pass anti-Commandeering legislation to limit the overreach of Federal Power... Also, ask them to explore a Resolution calling for a Red State's Caucus as proposed on this site... along with the use of Writs of Quo Warranto to challenge the right of federal agents and officers occupying offices obtained by fraud.  We must ask our State Officials to act in these matters and if they will not then we must formally petition them to RESIGN and let others willing to defend the States and its Citizen's 9th and 10th Amendment rights assume their seats in government.

      Work to get your county and local GOP committees to demand their GOP legislators and Governors act to organize and SECURE your State's and its Citizens' right to a Republican form of Constitutional Government... not a fraudulent system of Marxist usurpations, in the form of illicit Executive Orders and Judicial Fiat, fronting as the law of the Republic.  Attend your local GOP meetings and demand they censure and or remove RINO's from the Party roles .... clean out the Deep State in local governments.

Dakota and good for the USA... now we have 49 more States to turn around... it should start with the GOP held State Legislators and Governors FORMALLY organizing and recognizing a Red State's Caucus for the purposes of formally coordinating and defending anti-commandeering acts designed to Constitutionally limit federal power and overreach.  It should also work to perfect  Writs of Quo Warranto for any and all federal AND LOCAL government officials who have fraudulently assumed office or a seat of power within the government .... anywhere. We must remove the deep state for our local and state governments.

      Message, petition and organize rallies to demand your State Government prosecute political corruption, election fraud, and any other government abuses occurring in your local and state government... demand offending officials resign immediately or petition to have them formally removed ... recalled or impeached.  Do not let them hold office any longer than absolutely necessary.  Send a message that the GOP and its Conservative members are not sitting around any longer.... they intend on cleaning house ... beginning with their own party and moving on to holding all members of government to the highest lawful standard... and where they don't to remove and PROSECUTE THEM... Start with your State AG and local prosecutors.... expand it to juges ... recall or impeach them.  We must become aggressive and overtly revolutionary in our fervor for reforms... half measures must end.

  • Since we can all guess that the Executive in the form of the DOJ is the thug to be played, lets see how this goes. 

    A unified non-compliance by the state could either result an impass, or military action by the Executive.

    Either way, creeping Progressive Socialism will not work in that kind of direct confrontation.

    I doubt other states will single out North Dakota in co-operative Federal disciplinary action.
