Today, under the watchful eye of the illustrious Obama, our great leader, and his communist and Muslim cohorts, observe the communist take-over of America proceed, along with the help of Muslim anarchists. Rest assured, “enemy combatants,” as well, will be up to no good. Dumb-de-dumb-dumb! America’s days are numbered—unless you are willing to fight for your life. So far I've yet to see it. “Now is the time for all good men to come to the aid of their country.” The take-over today began in 1933 under the leadership of one of America's greatest presidents. Look at the picture. This is what this great one gave us.
In 1933, in his “Fireside Chats” Roosevelt: “It is the inherent duty of the federal government to keep its citizens from starvation.” Roosevelt is given credit for being one of America’s greatest leaders. In 1937, Roosevelt claimed federal power had been tipped out of balance by the Supreme Court. President Obama has given us subtle warning that the Court may try the same again in his heath care bill, and indicated that he will not stand for it. He has shown his penchant before to take the law into his own hands. Obama calls himself a Roosevelt Democrat—out to transform America.
I’ve taken from my challenge, my Writ of Certiorari to the United States Court of Appeals for the Ninth Circuit in the October term of 1980, case number 1570. Keep in mind that I’m not a lawyer. I’m an abused taxpayer with a personal stake in the outcome. I had a right to personally take my case to the Supreme Court. The fact of the matter is that I was there. What I want to know: where are America’s lawyers? We’ve five times the number we need and all they do is complicate the law to the extent that they are in control. Witness what I mean.
The IRS lawlessly put me on the street. Reason: I wrote the Attorney General a letter claiming that as implemented, the income tax was unconstitutional. The IRS taxed me double what I owed. I had a refund coming due to business losses. The IRS applied the tax I owed and froze the balance of my refund, stating that if I would drop my petition to the tax court the IRS would refund the balance of the refund, after deducting double the tax I owed. After that notice, my landlord locked me out for nonpayment of rent. I was self employed. Uncle Sam put me out of business and then proceeded to put me on the street. A lawyer told me he had heard worse. His advice was to forget it and get on with my life.
My life was over. I engaged Uncle Sam in a fight to get it back. Under “Reasons for Granting the Writ, Urgent Need for Review,” some excerpts: The urgency lies in the fact that there has been a progressively growing shift in emphasis away from property rights, and to their almost complete replacement, other personal rights as the primary focus of the law’s concern….In 1937, FDR said: “The balance of power between the three great branches of the Federal Government has been tipped out of balance by the Court in direct contradiction of the high purposes of the famers of the Constitution….Justice Brandeis and some of this brothers would reason: “Property is only a means. It has been a frequent error of our Court that they have made the means an end….This Court’s test as to a right is whether the right at issue is ‘of the very essence of a scheme of ordered liberty,’ by reason that neither liberty nor justice would exist if such a right were sacrificed….A tax to promote the general welfare cannot be wrested out of its setting and legalized by ignoring its purpose as the mere instrumentality of bringing about a desired end. U.S. v. Butler, 297 U.S. 1.61 (1936)….Colley’s Constitutional Limitations identified due process with the doctrine of vested rights drawn from natural law…. And this Court holds: ‘it is elementary that tax laws are to be interpreted liberally in favor of taxpayers and the words defining things to be taxed may not be extended beyond their clear import.’ And this Court likewise recognized the rule that, in cases where complainant shows that in addition to the illegality of an exaction in the guise of a tax there exist ‘special and extraordinary circumstances sufficient to bring the case within some acknowledged head of equity jurisprudence, a suit may be maintained to enjoin the collector’ Miller v. One of Edwards' birds of a feather, dirtbag Wade H. McCree, Jr., Soliciter General, in his blather for the respondent, the Commissioner of Internal Revenue, in opposition to this pipsqueek layman, out of his tree, “Every court that has heard this argument has rejected it…. Funds generated by the income tax for various social welfare purposes are ‘exclusively within the jurisdiction within the jurisdiction of the legislative and executive branches,’ rather than the courts.” So much crap! The Court knew that. Look at the picture. He's a lawyer, sitting on the right hand of God Almighty. He can do no wrong.
Have you ever heard a single one of your elected representatives argue against dirtbag McCree's interpretation? So much for never wrong lawyers. In Flast v. Cohen, at 98, the Court: “the government contends that under no circumstances should standing be conferred on federal taxpayers to challenge a federal taxing and spending program. An analysis of the function served by standing limitations compels a rejection of the government’s position.” If the taxpayer can show a personal stake in the outcome, he has standing, according to the Court in Flast. The government, run by lawyers, would not know the truth if it slapped the government in the face. So what are you waiting for? Your government does not have a legal leg to stand on. The bureacracy is a gestapo. Congress knows that. Most of them should be in jail. They don't practice the law. They practice humbug.
My case involved outright theft by the IRS, obstruction of justice. The Tax Court ruled that The IRS wrongfully taxed me. The IRS admitted it. After the case was closed, the IRS made the “mistake” of pulling the same stunt again, just to show me it could violate a court order and get away with it.
Solicitor General McCree: “Petitioner’s charges of fraud and harassment by the Internal Revenue Service are similarly without merit. The charges are based on an error made by the Service in determining petitioner’s 1974 income tax liability.”
The error was made after the Tax Court ruled against the IRS. The error was made again after the District Court took the case and the IRS admitted the error. The error was made a third time when the IRS went to my bank and stripped me. The Supreme Court sat deaf and dumb, and never said a word. I took the record to the press. The IRS admitted it was in error. The IRS made the error again. I took the error my congressman. The IRS admitted it made a mistake.
Not only the IRS, but the EPA throws the book at people who give them any resistance. Just the other day, it was reported that the EPA lost its case in court and still prevented a family from building their home on land the EPA deemed to be wetlands. The land sits useless, in violation of a court order. Is there nothing anyone can do? There is plenty we can do about this outrage, I'm here to tell you. I hung the IRS with its own rope. You can't sit and take this kind or crap and not act. They will take every right you have. I know them for what the are. They are cowards, people who feel inferior, using power to belittle everyone they can.
Case in point: The DOJ is stonewalling Congress on the selling of automatic weapons to Mexican thugs who are killing people with those guns. Beware! They are calling it a mistake. We don’t know who is responsible, but we do know that Obama is involved. Obama is a communist oppressor. He doesn’t believe in our laws. He has his own ideo of the law. He's making his idea of the law stick. Are you going to allow Obama to take over America without a fight—give up every right you have, even your life? I can’t believe what I’m seeing. America is not prepared. It was the same in Germany when Hitler took over. I’m a personal witness of what happened in Germany. The American people are unaware of what they face. It goes to my guts that I'm seeing the same thing take place in my America! We must take action now.
