{ salon.com } ~ Under the U.S. Constitution, federal judges — including Supreme Court justices — can be impeached by Congress just as a president can be impeached... In order to impeach Kavanaugh, a majority in the House of Representatives would first have to approve an indictment to impeach. Democrats now control the House, but given how divided they are on whether or not to impeach Trump, it stands to reason that there would be plenty of House Democrats who, unlike Pressley, have no appetite for impeaching Kavanaugh either. But if the House did vote to impeach Kavanaugh, that wouldn’t automatically remove him from the Supreme Court: he would also have to be convicted in a Senate trial. And that’s where the lifting would get even heavier. Kavanaugh would need to be convicted by a two-thirds supermajority in the Senate, which is now controlled by far-right Republicans. Kavanaugh was confirmed before the 2018 midterms, but in November 2018, Republicans slightly increased their Senate majority — which means that the Senate would be even friendlier to Kavanaugh now than it was last year. Not only would few, if any, of the Senate Republicans who voted to confirm Kavanaugh in 2018 not convict him in a Senate trial, but also, centrist Democrats ranging from Sen. Joe Manchin who voted for Kavanaugh’s confirmation to Sen. Kyrsten Sinema of Arizona would be most unlikely to vote for his removal. Sinema, who has exalted the late Republican Sen. rino-John McCain as her role model more than once, obviously likes the fact that Democrats are making a lot of inroads in Arizona — and it’s hard to imagine her rocking the boat by voting to remove Kavanaugh from the Supreme Court. But perhaps the strongest argument against impeaching Kavanaugh at this point is the Supreme Court itself. If Democrats regain the White House and achieve a Senate majority — thus making Moscow Mitch Senate minority  leader — they will be in a much better position to add some liberals and progressives to the Supreme Court. The far right now dominates the Supreme Court, but a Democratic president combined with a Democratic Senate would be in a better position to prevent the Court from moving more to the right. To achieve that, however, Democrats will have to perform well in November 2020. Perhaps impeaching Kavanaugh would be realistic in 2021 if Democrats regained the Senate in 2020, but even then, centrist Democratic senators could be an obstacle. And a Democrat-controlled Senate still wouldn’t guarantee the two-thirds supermajority needed...

{ cnsnews.com } ~ At a recent debate on CNN, the two leading progressive senators, Elizabeth dinky-Warren and commie-Bernie Sanders, pledged to shut down America’s nuclear power plants... Such a rash decision would cause lasting environmental damage. From an environmental standpoint, it is hard to beat nuclear power. It produces no air pollution or greenhouse gas emissions just harmless steam. It results in fewer deaths per unit of energy produced than virtually all other forms of energy, such as wind power or fossil fuels nobody died at Three Mile Island. And it provides the steady flow of energy needed for a carbon-free or low-carbon power grid, because unlike wind or solar power, it produces a constant, reliable flow of electricity regardless of whether the weather changes. As the Washington Examiner notes, shutting down nuclear power plants would increase greenhouse gas emissions, and make it harder to prevent climate change: “The International Energy Agency has concluded that meeting the goal of keeping warming to no greater than 2 degrees Celsius would require doubling global nuclear energy generation capacity by 2050. The Intergovernmental Panel on Climate Change, which is often cited as the leading authority by liberals, reached a similar conclusion.” There is a strong consensus among both conservative and liberal energy experts that getting rid of nuclear power would be a bad thing. The city set up public toilets and last year announced formation of a special six-person “poop patrol” team to clean up the human waste. The city also announced funding to hire people to pick up used needles. Many of those needles came from the city itself. The health department hands out an estimated 400,000 clean syringes a month under programs designed to reduce the risk of HIV and other infections for drug users who might otherwise share contaminated needles... Former FBI Deputy Director and Acting Director Andrew McCabe deserves to be prosecuted on charges of lying to investigators.

Deputy Attorney General Jeffrey Rosen has rejected a request by McCabe to block such a prosecution, Fox News reported Thursday after U.S. Attorney for the District of Columbia Jessie Liu recommended prosecuting McCabe.

This is the right decision by Rosen and Liu. The American people need to be reassured that the rules the FBI applies to the rest of us apply equally to its own agents and lawyers.

Justice Department Inspector General Michael Horowitz released a report last year concluding that McCabe lied to then-FBI Director scumbag-James Comey, to other FBI agents, and to officials of the Office of the Inspector General about leaks to a Wall Street Journal reporter.

McCabe made unauthorized disclosures about the FBI’s investigation into the scumbag/liar-Clinton Foundation. He then lied about it when questioned, including under oath to the inspector general, Horowitz’s report said.

According to the inspector general’s report, “law enforcement sensitive information” about the scumbag/liar-Clinton investigation was disclosed in an Oct. 20, 2016, Wall Street Journal article. Until that article was published, the FBI — as is its normal procedure — had refused to confirm whether there was an ongoing investigation.

McCabe disclosed a communication he had received from an scumbag/liar-nObama Justice Department official expressing his concerns over the FBI investigation into the scumbag/liar-Clinton Foundation during the election, the inspector general’s report found.

The IG report said that when McCabe was asked by scumbag-Comey about the article, he told scumbag-Comey that he had had not authorized the disclosure and didn’t know who did.

McCabe repeated that lie to agents from the FBI’s Inspection Division and to the Office of the Inspector General when questioned about it. Only in a second round of questioning by the inspector general did McCabe finally admit that he was responsible for the disclosure.

It isn’t just that McCabe lied to investigators, including when he was under oath. The IG also says that McCabe engaged in “misconduct” because the disclosure was “designed to advance his personal interest at the expense of department leadership.”

But the real point is this: lying to a federal agent is a felony under 18 U.S.C. §1001. That is the exact statute under which Special Counsel Robert Mueller — and the Justice Department — prosecuted former National Security Adviser Michael Flynn for lying to FBI agents who interviewed him about conversations he had with the Russian ambassador to the U.S. when Flynn was part of the Trump transition team.

You can violate this law even if you are not under oath at the time you were interviewed — and Flynn wasn’t under oath when he was questioned.

This makes McCabe’s behavior arguably even worse. McCabe was under oath when he was questioned by the IG and, moreover, he held the second-highest post in the most powerful law enforcement agency in the federal government.

McCabe, more than an ordinary citizen, knew the importance of this law and the fact that he had a duty to tell the truth when he was being questioned about unauthorized leaks that could compromise an open law enforcement investigation. To believe he misremembered or temporarily forgot is not credible.

Holding McCabe to account sends a loud and clear message: no one is above the law. If he wasn’t prosecuted, the message would be that the laws that are applied to citizens, politicians and military officers don’t apply to high-ranking FBI agents and the Justice Department.

Not only would that be legally indefensible, but providing that kind of immunity to law enforcement officials would be dangerous. They, even more than the rest of us, must be accountable for their actions and must adhere to both the spirit and the letter of the law. Anything else will inevitably lead to corruption and abuse of power.

McCabe is presumed innocent unless and until proven guilty beyond a reasonable doubt. But charging him is the right thing to do.
