Has Spying Compromised the
Separation of Powers and Liberty?

{theepochtimes.com} ~ Founding Father James Madison informs us in “Federalist 51” that the separation of powers “to a certain extent is admitted on all hands to be essential to the preservation of liberty.”... The checks and balances intended by having three branches of government, and the federalism dichotomy between a national government and the states, were brilliant developments in protecting liberty by compartmentalizing governing powers.  Most Americans can easily identify the three branches of government. Three principals, however, actually wield power under the Constitution: the federal government, states, and We the People. Only the first two of those principals are directly regulated by the Constitution, which the fourth chief justice of our Supreme Court, John Marshall, described in a separation-of-powers case as our “fundamental and paramount law.”The Constitution, to say it another way, is the law that governs government itself. The extra safeguard of a Bill of Rights was added to this paramount law that governs government at the insistence of some of the Founders—in case the structural protections of liberty weren’t enough. Those safeguards, as with all laws, need some form of remedies or consequences for violations in order to give those laws teeth. So, what happens to this paramount legal structure when one adds in the phenomenon known as the “administrative state,” that collection of alphabet soup-named agencies that wield extraordinary amounts of power, or the more sinister-sounding “deep state,” some of whose members even deny its very existence? Also, what are the larger consequences to liberty when agents within the administrative or deep states are able to operate relatively free from consequences for unconstitutional overreach, lawlessness, and outright lawbreaking?...  https://www.theepochtimes.com/has-spying-compromised-the-separation-of-powers-and-liberty_2762718.html

{dailycaller.com} ~ The former general counsel for President scumbag/liar-nObama made “false and misleading statements” to the Justice Department... regarding work he did for the Ukrainian government that has come under scrutiny in the special counsel’s probe. Greg Craig’s allegedly false statements were revealed in a settlement announced Thursday by the Justice Department. The agency announced it was settling with Craig’s former firm, Skadden, Arps, Slate, Meagher & Flom, which worked with former Trump campaign chairman Paul Manafort on behalf of Ukraine beginning in 2012. Skadden Arps agreed to register retroactively with the Justice Department as a foreign agent of Ukraine and to pay a $4.6 million fine, the same amount that the firm was paid for its consulting work. Craig, who left Skadden Arps in April 2018, is not identified by name in the Justice Department announcement, but he has previously been identified as the lead Skadden Arps partner who worked on its Ukraine account. Other clues from the Justice Department settlement point to Craig as the lead partner referenced in case...

{gatestoneinstitute.org} ~ But how does one go from darkness to hope? In the painting, Liberty, looking back over her shoulder reminds me of my past, a past I so tried to suppress... I find this hard to admit, but I had a radical moment, my time of Islamism. I longed for a revival of a golden age when Muslims were mighty and triumphant, ruling large parts of the world, fighting victoriously in the name of God. I gloried in this past. Reviving medievalism, these fantasies were a way to escape modern life. I dreamed of a past and future glory, like many in their dogmatic slumber. It never seemed like darkness; it seemed like a pearl of light. I was entrapped in the golden cage of Islamism. I was a bird of paradise that did not want to escape. Then it dawned on me: the way to hope is change and reform. Islam is the only religion which has not gone through reform. I am not afraid of speaking the truth, but religious extremists, especially, despise women who use their voices against them. There is an increased fear, and rightly so, about the free expression of extreme religious ideas and opinions that are polluting our social, cultural, economic and political orders in the Arab world, which is why Jamal Khashoggi stands as an enemy to free thinkers -- Muslims and states that turned against politics disguised as religion. "There can be no political reform and democracy in any Arab country without accepting that political Islam is a part of it," Khashoggi wrote. Religious liberals make up the minority in Arab countries. An alarming  84-86% of Muslims in Egypt and Jordan support the death penalty for Muslims who leave the religion, and 82-70% support stoning for adultery. Jordan and Egypt also happen to have a significant percentage of Muslim Brotherhood adherents in seats of power in parliament. Many of these extremists are gaining momentum, destabilizing the region through proxy wars...

{dailycaller.com} ~ The Metropolitan Museum of Art is reviewing its gift acceptance policies after information that members of a prominent donor family... headed a deceit campaign to push the highly addictive prescription opioid OxyContin, The Met told The Daily Caller News Foundation. Other New York City art museums that have taken money from the Sackler family, which owns Purdue Pharma, refused to comment on the Tuesday court filing  with documents showing members of the Sackler family covered up information about the dangers of OxyContin. “The Sackler family has been connected with The Met for more than a half century. The family is a large extended group and their support of The Met began decades before the opioid crisis. The Met is currently engaging in a further review of our detailed gift acceptance policies, and we will have more to report in due course,” Daniel H. Weiss, president and CEO of The Met, told TheDCNF in a statement Thursday. An employee at The Met told TheDCNF news about the Sackler family is what prompted the institution to review its policy, although the employee would not detail any review timeline...  https://dailycaller.com/2019/01/17/sackler-family-met-museum/?utm_medium=email

{americanthinker.com} ~ CNN reports: "James Watson, who discovered the double-helix structure of DNA alongside Francis Crick in the 1950s based on the work of British chemist Rosalind Franklin... said in a PBS film that genes cause a difference in intelligence between white and black people in IQ tests. "The 90-year-old's comments were labeled 'reprehensible' by the Cold Spring Harbor Laboratory (CSHL) on New York's Long Island, where Watson had been the director from 1968 to 1993. The laboratory said it 'unequivocally rejects the unsubstantiated and reckless personal opinions Dr. James D. Watson expressed,' noting the statements were 'reprehensible and unsupported by science.'" Watson was shortly relieved of his administrative duties, but not his title. Among other "reckless" statements attributed to the Nobel winner, Watson implied what has been statistically proved over and over: that stupidity is linked to genes. In CNN's report, the word "unsubstantiated" stands out most glaringly, especially in light of the existence of a warehouseful of substantiation to support Watson – for example, documented statistical IQ differences among the races among humanity...

by Thomas Gallatin:  President Donald Trump signed legislation Wednesday ensuring that the roughly 380,000 furloughed federal workers currently not receiving pay will be paid once the partial government shutdown ends. By taking this action, Trump eased the impact of the shutdown on federal employees while at the same time encouraging continued stability for labor-market statistics. As The Wall Street Journal explains, “Had that not occurred, the loss of more than 300,000 employees from the government’s payroll would have most likely overwhelmed any private-sector job creation. That in turn would have caused total nonfarm payrolls to decrease for the first time since October 2010, snapping a streak of 99 straight months of job growth. The streak is the longest on record dating to 1939.”

Even with Trump’s action guaranteeing that there is light at the end of the shutdown tunnel, hundreds of thousands of federal workers — many of them essential and still on the job — are feeling the immediate financial hit from missed paychecks. Meanwhile, House Speaker Nancy Pulosi and her fellow Democrats are content to play political games by refusing to even meet with Trump and Republicans in negotiation efforts and by requesting that Trump postpone the annual State of the Union Address over bogus security concerns. In truth, Pulosi doesn’t want Trump to have that much unfiltered access to the American people, where he can make a strong compelling case for the need for a border wall and can expose the Democrats for being opposed to enforcing the nation’s sovereign right to secure our borders. She’d rather continue the pain and theater of her shutdown so she can better represent people who aren’t even citizens of the nation.
Importantly, though, despite the partial government shutdown, the vast majority of Americans are getting along just fine. In fact, if it wasn’t for the media constantly covering it, would many Americans even know there was a shutdown?  ~The Patriot Post
