It appears the ACA is unconstitutional

28 October 2013

The Honorable Congressman Smith

The Honorable Senator Cornyn

The Honorable Senator Cruz

Good morning Gentlemen!

On this bright Monday morning I have a question I would ask you ask yourselves...... once you have the answer, what comes next appears to be obvious and unavoidable... the only way to fix this is remove it.

The "version" of the Affordable Care Act (ACA, obamacare) that became Law originated in the Senate.

Chief Justice Roberts clearly stated the ACA was "constitutional" as a TAX (not healthcare).

The Constitution of the United States clearly tells us that the House holds the purse strings, controls funding - and is able to tax.... The SENATE is incapable of creating a TAX according to law.

The question to ask yourselves is this: Since the Senate version of the ACA is what became Law - Chief Justice Roberts said the ACA is a TAX - and only the House can create a tax....

Why does the ACA continue to exist - as it is an unconstitutional mandate from a government body unauthorized to do what was done. Yet signed by all......................

4063763816?profile=originalI came by this yesterday - thought everyone should see it.... share as you see fit.

This is an employee handout from United HealthCare - one of the obamacare insurance companies.... Ya know, one of them receiving a $10 billion taxpayer dollar kickback over a 10 year period.... (the last time I read this particular law - this is called insurance fraud and quite illegal.... but apparently no so much if obama does it.........)

Inside, on page #1 is a section titled "Affordable Care Act Transition Reinsurance Fee". This section describes a "fee" all employees will pay each paycheck (bimonthly).

Here is the full text from this section;

The Affordable Care Act transition reinsurance fee is payable to the Department of Health and Human Services. This new fee will apply to all employees and their dependents who will be enrolled in medical coverage. The fees are:

Employee-only coverage:                                     $2.30/paycheck

Employee+Spouse/domestic partner coverage:      $4.60/paycheck

Employee+child(ren) coverage:                            $6.24/paycheck

Employee+family coverage:                                 $9.43/paycheck

What this says is that as an employee - you are going to be charged a "fee" every paycheck, paid to HHS.... and there are NO limits on exactly how long this "fee" is going to be taken out of your check!! From all appearances (and what I can discern in the ACA) this "fee" will exist for as long as you are employed - and I suspect this is just the tip of the iceberg - as eventually people are going to start looking at their paycheck stubs and questioning why there are so many additional taxes coming out of their check they have never seen before.....

Bottom line:

If there are 100 million single people employed in the US (I just pulled a number out of the air) that means that if we take the "Employee only" "fee" of $2.30/paycheck, multiply it by 100 million people - the federal government is raking in $460 million dollars a month! ON THIS "FEE" ALONE!!!!!

If you make that 100 million "Employee+family" coverage the federal government is raking in $1.886 TRILLION dollars a month!!!

Now do you understand why the democrats find obamacare non-negotiable?

Almost $2 TRILLION dollars a month additional revenue they have to spend!!!!!

WHISKY TANGO FOXTROT !!!!

Has anyone else bought sporting goods recently? Look on your receipt to see the obamacare taxes there!

If you have visited your Veterinarian and had surgery on your pet - look on your receipt to see the obamacare taxes there!

In almost every aspect of our lives.... this "obamacare" is taxing us..... It has caused every price on every consumable and healthcare product to increase - by the addition of TAXES!!!

Chief Justice Roberts CLEARLY told the world this was not healthcare - IT IS A TAX!!!

Wake up to the fact you are not receiving any sort of "affordable" anything.... this is another means this regime lied to Americans to hide their new method of funding a corrupt government!

With all of the hiked insurance premiums - in reality - the only ones who will find obamacare "affordable" are those who will not be paying for it......... (welfare recipients, illegal aliens, etc.....)

You really need to remember all of Mr. Obama's rhetoric about "redistribution of wealth"..... he meant it and he's being allowed to DO it.....

This is in-your-face tyranny.

United HealthCare is leading the pack (so to speak) advising employees of this new "fee" - as would be expected from one of the participating obamacare insurance companies.... but it is just a matter of time before all employers tell their employees the same....

Those of you in Congress, reading this, had best understand that as a Nation of free people - we hold you accountable for your actions.

If you are one of those denigrating Senator Cruz, understand this: Senator Cruz is doing what his constituents asked him to do - not what he wanted to do - because we the people wrote all of YOU, millions of letters telling YOU we didn't want this, we shut down your entire telephone systems on multiple occasions trying to tell you this.... Senator Cruz listened.

YOU didn't - and we WILL remember this come the next elections............... BOTH PARTY's!

The Soviet Leader, Kruschev visited the US under the guise that he wanted to learn about our agriculture. It was during this visit that he made his famous comments, which I fear are not discussed in todays school rooms. The comment at the bottom is from the Secretary that toured the visitor at the direction of then current President Eisenhower. Mr. Benson thought they were ahead of schedule to do what was promised by Kruschev back in 1968. He may have been right or not, but surely now that the keystone has been laid for a new socialized America with Obama care we are well down the road to a transformed America, as Obama has promised. I hope and pray that this destruction of America can be stopped and Obama's DREAM can be stopped too. I want America the Judeo-Christian super power nation with our Constitution and all of our  Bill of RIght's intact  and not transformed into Obama's Fabian world.

President Eisenhower, Kruschev had expressed a desire to learn something of American Agriculture — and after seeing Russian agriculture I can understand why. As we talked face to face, he indicated that my grandchildren would live under communism. After assuring him that I expected to do all in my power to assure that his and all other grandchildren will live under freedom he arrogantly declared in substance:

“ ‘You Americans are so gullible. No, you won’t accept communism outright, but we’ll keep feeding you small doses of socialism until you’ll finally wake up and find you already have communism. We won’t have to fight you. We’ll so weaken your economy until you’ll fall like overripe fruit into our hands.’

“And they’re ahead of schedule in their devilish scheme.” (Ezra Taft Benson “Our Immediate Responsibility.” Devotional Address at Brigham Young University. circa 1968.”) [access the audio file on this page.]

Educating the Uneducated

                                                        Educating the Uneducated

Obamacare is revealing just how unaffordable the ‘Affordable Care Act’ is and the Democrats are STILL not willing to negotiate. Obama knows the midterm election hangs on this one issue. The people are learning that this abomination is going to cost them much more than most can afford and he remains intransigent. The question is why?

It all goes back to the man’s personality profile. He is a pathological narcissist as declared by a minimum of four world class psychologists and psychiatrists of which I am aware. So just what is a pathological narcissist? The best definition I have found reads: Narcissistic personality disorder (NPD) is a personality disorder in which the individual is described as being excessively preoccupied with issues of personal adequacy, power, prestige and vanity. This condition affects one percent of the population. First formulated in 1968, it was historically called megalomania, and is severe egocentrism.
You see he actually believes, like Stalin and Hitler, that he cannot be wrong and there is no amount of evidence that can change that.

The undereducated voter is now learning what that means to their personal financial well being. One lady on the government’s face book page had this to say and I quote from a Tea Party news post: A single mother of two said she is in school and working full-time while living “75% below the poverty level.” She said she was shocked to learn she did not qualify for a healthcare subsidy. “Are you F’ing kidding me????” she wrote on the government’s Obamacare Facebook page. “Where the HELL am I supposed to get $3,000 more a year to pay for this ‘bronze’ health insurance plan!?!??? And I DO NOT EVEN WANT INSURANCE to begin with!! This is frightening,” she wrote. End quote.

My research, which is far from complete shows that there are now more than 3 million people in this country that have had their work hours reduced in direct response to the coming of this law. Several companies have closed their doors and I have read the comments of five business owners that were in the process of expanding their businesses who actually cut back and is today even smaller, not larger. Why? They found out the cost of the insurance they would be forced to buy would be prohibitive. One of these is a lady in SC that had dug herself out of poverty and off the welfare roles with a small business that had grown to the point of providing incomes for her own and fifty one other families. She was elated to learn that she had been approved for a loan to expand and located a new location so that she could double her employees and probably her own income. Then she found out the cost of The Affordable Care Act and its effect on her plans. She was forced to not only forgo her expansion, but actually to reduce her work force by two to get under the act’s trigger point and save her existing business. Gee, thanks all you democrats.
I took a look at the Facebook page mentioned above and the reviews are somewhat more mixed than that one, but the trend seems to be those who can afford their health care now will be getting a better deal while those that are at poverty level or below will be slammed very hard. If they don’t sign up they will be charged a tax they can’t afford to pay. If they don’t pay they can be subject to fines, interest, penalties and fees plus, after three years of this increasing debt they can’t afford, they could see a tax lien on their house, bank accounts, saving including, but not limited to their retirement accounts.

Last week a poll was released that stated the majority of Americans were opposed to “Obamacare”, but were in favor of “the Affordable Care Act!” Wait a minute … They are one and the same thing! But NOW they are learning. We need to keep up the tutoring.

The Federal Government Shutdown - and a solution you may have missed          October 3, 2013

The Honorable Congressman Stockman

The Honorable Congressman Smith

The Honorable Senator Cornyn

The Honorable Senator Cruz

The Honorable Congressman Issa

The Honorable Congressman Goodlatte

The Honorable Senator Paul

The Honorable Justice Roberts

Gentlemen,

For some of you, I am a constituent, for others, an information source or worse case, a pain in the rear... please forgive me if you feel I fall into the latter category as I am not a politician and I am certainly not "politically correct".

I write today on the topic of our current Federal Government shutdown.

I re-read Supreme Justice Roberts decision on the Affordable Care Act this morning - and I re-read the Constitution of the United States. I determined there is something I believe you may have missed in the chaos and misdirection found today on the Hill.

In a nutshell;

1. Supreme Justice Roberts ruled that the Affordable care Act is in fact a tax. Congress has within its power to impose a tax in this Nation.

2. The Constitution of the United States, Article I, section 8, paragraph 1 states: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;"

Therefore, The Supreme Court rules that the Affordable Care Act is Constitutional, but a tax. The Constitution states that any tax (excises) imposed by Congress MUST be "uniform throughout the United States;"

President Obama has, by Executive Legislative Fiat, excluded the entire Federal Government from the Affordable Care Act.

This appears to be unconstitutional as the Affordable care act no longer meets the requirements of Article I, section 8, paragraph 1 - the federal Government has now been exempted from this "tax".

Gentlemen, this entire Federal Government shutdown appears to be unconstitutional!

The argument from Senator Reid is that if the funding for the Affordable Care Act is not within the budget approved from the House - it will be rejected.

From the White House; President Obama has clearly stated he will veto any budget if it does not include funding the Affordable Care Act.

Dozens of polls have been run by credible organizations Nation-wide over the past few months, all asking the American Public if they wanted or did not want the Affordable Care Act...

The lowest poll results I found was 68% against the Affordable Care Act and the highest poll results I found was 92% against the Affordable care Act. This tells me - and should tell any elected listening to their constituents  - the American Public does not want the Affordable Care Act!

Gentlemen - it appears the American Public has voiced their opinions against this "law" and wants no part of it. The House did the right thing and voted to de-fund the Affordable Care Act then provided their budget to the Senate, who rejected it....

Yet, President Obama exempted all Federal Employees from the Affordable Care Act - and therein lies the Constitutional issue... the Affordable Care Act no longer meets the requirements of Article I, section 8, paragraph 1. Moreover - Senator Reid wants no part of the Affordable Care Act upon himself or his friends. He knows for a fact it is NOT "affordable".

I ask that all of you join together, ask your peers to join together - and hand carry if necessary this argument to the Supreme Court for a ruling. If Supreme Justice Roberts agrees to clear the decks and hear this - this may be a method to restore our government budget constitutionally and get our Government back in the game.

As a sidebar, it de-funds the Affordable Care Act and places those supporting funding it on notice the People of this Nation are tired of the unconstitutional actions of those we elected to office and will no longer tolerate these abuses.

Respectfully,

They both voted for closure which let the bill go forward for a vote. As Cruz pointed out that would have been the time and place to stop the bill. Instead they voted to let it go to the floor where 51 votes was enough  to pass it. Now they can tell us they voted against the law, but essentially they worked with Reid and it passed.

Maybe it was to let Putin lead the world and slip America from the super power position? VIA,

Was it to allow Iran to develop a nuclear weapons, while wringing his hands?

Continue to print an extra 80 billion USD a month, until the dollar is no longer the number one currency?

The House passed a bill to continue to fund America, except for Obama care. The President goes around every day saying the GOP wants to shut down America. Obama could tell Reid to accept the bill and not shut down the government, but he will not. He has used the bully pulpit every day to fool Americans, because he thinks we are fools.

Continue to push Obama Care, the largest tax in the history of the world, 21 taxes, which was rammed down America's throat. Most selling points were lies and it will decimate the greatest health care system in the world.

Use every crisis and murder to get registration and ultimately ban most, if not all guns.

Sign the UN Small Arms Treaty to seek to neutralize the Second Amendment.

Use the EPA rules to execute Obama's war on coal and energy prices. Bypass Congress and declare the CO2 we breathe out as a pollutant. They have added social costs and a lower than possible CO2 limit from coal to kill any future plants. Germany's green program has driven up kilowatt costs from .06 to over .20 cents today, which is badly hurting industry in that country. Spain is broke from their  green program and Obama wants that for America too. While our energy costs are lower today, Obama's objective will be to make them skyrocket. This will break America and further kill off US jobs.

EPA rules make Coal fired plants come up to the latest standards if they upgrade, which means no upgrades and eventual shut down of the plants. Coal costs .03 to .04 per kilowatt and provides 45% of our power.

The EPA may delay the alternative fuel related tax that will sharply drive up gasoline prices until after the next election. We could be energy independent and stop buying middle east oil and the indirect funding of radical Islam and terrorists. This is never discussed in the press.

Global temps are down for the past decade and the Russians say it will continue for 250 years. This year Artic ice is up 60%.

Perhaps it was Obama's plan to cut our military and cede back superpower and world influence to the Russians?

Other than his book, The Dreams of my Father, we have few clues why he wants to see America shrink in the world. I guess it is to punish America and the west for the sins of our Fathers, as Obama and his Father perceived them.

The wealth re- distribution Ponzi scheme of carbon credit trading from the US and the West is one way to cut America down to size.

I doubt Obama will ever tell us what he intended.

CORE is an approach used by foreign governments, dictated by the Federal government and supported by Gates and the companies that provide the tests. TCAP tests cost $8.00 per student and the CORE tests may run $29.00. Aside from the money and that NY and MA have had lower test scores after CORE, it is not right for the Feds to further control our local school curriculum. Specifically, having math that will consider partial  correct a answer to 4x3 = 11, if you explain your logic with pictures, boxes and statements. The actual math portion is wrong and would be corrected. Also, you can have the correct math answer . but fail to explain and demonstrate your logic via picture boxes and get marked wrong! Then there is the language section which drops some traditional stuff and adds cultural and other enrichment, which includes various life style options. These get more perverse as the KIDS get in the 11th and 12th grades.

The fact that 45 states have adopted this Federal approved and pushed program is enough reason to question it, but there are other serious reasons too.

Now, that Obama has gotten the States to fall in line he is seeking to set up a National School Board to ensure future compliance! Obama's  Secretary of Education was the Superintendent of Chicago schools, which are some of the worse schools in the nation. Arnie Duncan is from Chicago and I guess that trumps all issues when filling any federal appointed position.

Obama Care and the IRS enforcement is being force feed onto America too. As Obama continues to reduce individual choice, States rights `and local control of our schools, I wonder what is the end objective? I know in history it has been said those that control the youth control the future and to control the school textbooks gives you control of the youths. I am sure that this is the final goal of Obama.

The roots of this approach rest in previous administrations, but its embrace is tremendous and force feed under Obama.

We need local control and simple block grants from the federal government and no Federal Department of Education. We did not have it for most of our history and did better before it was formed.

The Unaffordable Care Act

Obamacare.  It has a ring to it.  To a conservative it is mocking and placing blame all at once.  Exactly what we want to do.   To a liberal it is a badge of pride and the crowning glory of their hero-in-chief.  For those two groups it fails to move the needle.  Then there are the masses in between.  And to those masses it plays like an ad campaign.  To the uninformed it states exactly the opposite of what it is... "Obama Cares".

I cringe every time I hear the Affordable Care Act referred to as Obamacare.  It is the type of advertising that money just cannot buy.  The sound clip audience simply hears "Obama Cares" over and over, and just like that it becomes an accepted fact.  So the other guy automatically becomes the opposite.  If Obama cares, the other guy doesn't care.  Opposition means that you don't care.  This is critical.  We are talking about soundbite voters who don't know a lick about current events or politics.  They just absorb a few words and let their minds fill in the blanks.  And every time they hear Obamacare it makes the man dearer to their hearts.

These are voters, like it or not.  And if we want to win elections we need to speak the language that they listen to.  That does not mean changing our values or sucking up to this interest group or that.  It is as simple as using different language when we mock.  That is why I prefer the term Unaffordable Care Act.  It tells it exactly like it does; it makes health care unaffordable.  There are enough ways to mock the President without giving him inadvertent positive branding in a soundbite sized culture of low information voters.

So, no Obamacare.  I like Unaffordable Care Act.  What other names for it do you like to use?

A Vision for Health Care in America

Here is a vision for health care in America that all people can agree upon:
Imagine a doctor and patient sitting in a doctor's office.  The patient has all the money they need to pay for their medical needs.  There are no insurance companies in the room.  There are no government bureaucrats in the room.  Just the doctor, the patient and the money.

How Do You Get There?
With the tax deduction “Cash in the Hand”:
For Individuals:
  • If you could deposit your income tax payment in a Health Savings Account, would you do it?
  • If you could deposit your property tax payment in a Health Savings Account, would you do it?
Waiters and Waitresses:
  • Would you like all the sales taxes collected each day by your employer to be divided equally between all the workers in the restaurant and deposited into a Health Savings Account for you?
Workers in a big box store:
  • Would you like your employers property tax bill divided equally between all the workers and deposited in your Health Savings Account for you?

The possibility of Obama ‘vetoing’ his Obamacare legislation because of recent discoveries from the Congressional Budget Office that it violated two of his campaign pledges about overall costs and reducing the deficit . . . now seems to be on the back-burner. Apparently the sensible notion was released as a trial balloon and was just a “tease” designed to confuse conservatives. No change is now expected. This is a perfect time to see how well President Obama came through on the fifteen most crucial promises he made about “reforming” health care in this country.

  • 1. Health care will cost less for the individual and the government. That was why the "vetoing" of Obamacare actually made sense. It has now been revealed by the CBO that it will cost much more and will not help reduce the deficit.
  • 2. Better care would result. Not according to the Congressional Budget Office and American physicians. Worse care and longer waits are the future for American patients.
  • 3. Deficits would be reduced and Obamacare would help the nation meet the challenges of the future. Sorry, the CBO shows that Obamacare will NOT pay for itself even using ten years of taxes to cover the first six years of the program's operation. It will increase deficits and the National Debt.
  • 4. It was part of his promise there would be “no new taxes on the middle-class.” However, Obamacare will begin collecting taxes on virtually everyone including the middle-class right away to pay for the program’s start in 2014.
  • 5. Abortions will NOT be paid for with Obamacare and your tax dollars. The reason that Bart Stupak and eleven other “pro-life” Democrats held out till the last 24 hours was that they could see there was no provision in the law forbidding abortion funding. Then President Obama gave Stupak a promise there would be no funding of Abortions – a promise that has no legal power. Abortion funding is still NOT prohibited in the law as passed.
  • 6. Not one dime over $900 Billion to fund it. The CBO now shows it coming in at over $1 TRillion which is what’s causing the deficit increases it will bring.
  • 7. Health Care unconscionable profits for Insurance agencies will be reduced dramatically. First of all health insurance profit margins were 3.2% last year one of the lowest profit margins of any profitable industry. Secondly, thanks to Obamacare their absolute profits wil rise at least for the foreseeable future as 30 million new customers are added to their client rolls.
  • 8. This is NOT socialized medicine. Ahem, FDR implemented 39 key agencies as part of the “New Deal" . . . but Obamacare creates almost 400 new agencies in just one monster law . . . medicine will become much more complicated and less user-friendly and, yes, it is obviously a government program now incorporating all the old agencies and 392 new ones . . . .
  • 9. We will seek bi-partisan input and support. The only thing bi-partisan was that 34 House Democrats joined the Republicans in voting against Obamacare. Obama held a shuck-and-jive bi-partisan meeting where Republican input was totally ignored though it obviously made the most sense. Democrats talked for a bit longer than Republicans but Obama talked and harrangued for longer than both together. In the end not one of about ten great Republican ideas made it into the bill.
  • 10. We’ll put this on C-Span; the creation of this new law will be open, transparent and a non-political process. BARF!
  • 11. You’ll till be able to keep your current doctor and current health care insurance if you want to. Sorry, but a lot of doctors will not be a part of this program; and a lot of insurors will no longer be insuring the same employers because of the debilitating effect of Obamacare on employer finances.
  • 12. There will be NO rationing of health care. Were you born yesterday? Longer lines? Fewer doctors? More regulations between you and your doctor? Attempts to call a great deal of the most expensive medical possibilities “optional” for the elderly – rationed care is the ONLY way that Obamacare could hope to work, sort of.
  • 13. We’ll not go down that road (reconciliation) to pass the bill. That’s how they did pass it.
  • 14. We’ll make sure there’s a five-day period for public comment before the bill is signed into law. Never happened.
  • 15. We will “reform” the health care industry. They have enlarged the government and the health care bureaucracy and thrown a lot of money at the “problem.” The word “reform,” however, means to “improve” or “make better.” They clearly have NOT reformed the health care system.

Ya’all live long, strong and ornery,

OBAMA'S HEALTHCARE BUREAUCRAT

Now that obama has put his little signature on his healthcare bill itis up to the bureaucracy to really screw it up...remember obamaknocking the US Mail Service?

Bureaucratic heads make up the rules of the game to attempt to meet the goals and intent of the legislation.

Chosen as bureaucratic head of the Medicare and Medicaid services unit of thefederal government and thus a major portion of obamacare is DonaldBerwick.

Like many on obama's team, Berwick comes from the private sector as head of a non-profit in MA (Institute For HealthcareImprovement) that consults with hospitals and such on how they cancontain costs.

He has received criticisms as head of this organization for apparently not worrying about containing his ownsalary...which I assume is passed onto hospitals who hire hisconsulting firm.

The medical journal Modern Healthcare criticized Berwick for making $769,000 in 2003, $630,000 in 2004, andtax filings for 2008 show he earned $637,000 (so reported the BostonGlobe 3/31/2010).

Facts released by his consulting non-profit but personally profitable institute have also been criticized.

In 2006 researches found problems with his institutes claim that they had"averted" 122,000 deaths through a program focusing on better controlof hospital errors and infections.

The researches allege that 14% of hospitals never submitted data about the program and not all ofthe data submitted was audited (same Globe story).

If you listen to the 2008 documentary Money Driven Medicine you will hear Berwickbemoaning the culture of competition in the healthcare industry...he'sagainst competition in the healthcare field.

Has obama not repeatedly told us that his healthcare plan would promote competition?

If Berwick sets the rules according to this ideology then how willnon-competitive Medicare/Medcaid progams look to future members?

Berwick likes to take a business approach to medical care; such as qualitycontrol programs, "lean manufacturing," and "optimizing flow" ...whichmeans sort of like having checkout times from a hospital like they doin motels.

Berwick was made an honorary knight from the UK for his great help in revamping their healthcare system.

The HealthCare Economist on 4/28/2008 did a piece on healthcare plansaround the world and included this information on the Berwick-revampedGreat Britain system based on the Michael Tanner book, The Grass Is NotAlways Greener: A Look at Healthcare Systems Around the World:

- Great Britian spends 7.5% of GDP on healthcare (at what cost?);

- long waiting lists for treatment are "endemic;" there are 750,000people on admissions waiting lists; 40% of cancer patients never see anoncologist; "minimum" waiting times are mandated so that hospitals willcut costs and must be followed or they lose funding;

- rationing "pervades" the system; rationing is "explicit" for services such askidney dialysis, open heart surgery and terminal ill care;

- patients have little choice of providers;

-there is little access to specialists;

- physicians and nurses are basically government employees;

- due to contract negotiations over pay and work hours, few physicians are available nights and weekends;

- due to low pay there is a shortage of specialists.

Berwick must be confirmed by the Senate.

OBAMA WINS WAR OF RHETORIC

..but the republican effort was quite lame.

Despite what the majority of the public thinks (50.8% opposed,RealClear Politics poll average, 3/28), obama and the main stream mediaare all giddy over the passing of obamacare.

He has won the war of rhetoric and since we will not know for sure thatthis bill is a front and a fraud for another 7-10 years, obama has thewon the privilege to run about the country as egotistical as ever.

Some in the media will print what lies in the bill below obama'sguess-work rhetoric and expose what the bill really means to theaverage American.

Despite the sensibility of some of these discoveries, some exposed byfacts, obama has the advantage in knowing none of it will be actuallyproven until his presidency is dead and gone.

What a wonderful position for a sleazy politician to find himself.

obama has put off the guts of the bill for another 5 years and untilthen he and his foot soldiers will be able to cast any opposingopinions on the bill as right-wing, tea-bagging nonsense...as politicsas usual and as actions of the status quo.

He'll use pretty speeches and half-assed comedic statements on thestump to energize and indoctrinate his already blind supporters inbelieving his continued rhetoric.

Because we will not see the tragic consequences of this bill's passing until it slaps us up side the head.

obama's staff has told us that they have a mega-marketing campaignplanned to get the word out on what is in the bill. Shouldn't thishave been something they did months ago?

Actually they have, using the same rhetoric and dragging out some poorcrippled person or cancer patient to exploit for political gain.

They will not tell us what is actually in the bill or what it willactually mean to us, really, what they will tell you is how greatchange is and this is something you can believe in.

If you are not questioning why we never heard detailed specifics on howthis bill will work and its affects on the country from obama, his footsoldiers, and the media, then obama's rhetoric will fire you up sillyand you will clap your hands with glee while God blesses your ignoranceand the Constitution protects it.

We will be indoctrinated, not informed, with the message theadministration wants us to believe this bill will do and what itmeans. Unless we dig and search for the truth, obama has the advantageof hiding behind the curtain and providing us only with bright lights, pretty words, and stories of woe.

Most presidents will seek support from the public before a bill ispassed, obama has changed this method by first passing the bill nomatter what the public thinks.

Why?

Because he is well aware of how infatuated the public can be overpretty speeches and clever denouncements of the opposition's silly, offfocus antics; especially when supported by a biased and unprofessionalmedia.

With that infatuation, that indoctrination, obama can claim a hugevictory for change and thus an even bigger 'I told you so' at electiontime...yet, like his election, a claim based solely on style andlacking substantive substance.

It could have been different. Republicans in Congress should have donetheir job and reported to their constituencies the more egregiouselements of this bill. Similarly, the voting public could have donetheir research and added a little thought to imagine what couldactually happen under this bill and its affect on further legislation.

Republicans instead stuck by the "scrap it and start over" plan whichwas not a crowd pleaser and which was heavily criticized by the media. Not a good plan.

They played into obama's play on the obstructionist angle and they paid for it.

Then when they did offer 29 amendments to change the bill, obama's foot soldiers gleefully rejected the whole lot.

Yet it did not matter, obama has won the war of rhetoric.

obama could sleep with eldrick's leftovers now and it wouldn't matter for health care...he has won the war of rhetoric.

PARTS OF THE Health CARE BILL pages 58 & 59

THIS IS THE 2ND OFFICIAL WHO HAS OUTLINED THESE PARTS OF THE health CARE BILL

Judge Kithil of Marble Falls , TX -
HB3200 highlighted pages most egregious

Please read this........ especially thereference to

pages 58 & 59

JUDGE KITHIL wrote:

"I have reviewed selected sections ofthe bill, and find it unbelievable that our Congress, led by SpeakerNancy Pelosi, could come up with a bill loaded with so many wrong-headedelements."

"Both Republicans and Democrats areequally responsible for the financial mess of both Social Security andMedicare programs."
"I am opposed to HB 3200 for a numberof reasons.

To start with, it is estimated that a federalbureaucracy of more than 150,000 new employees will be requiredto administer HB3200. That is an unacceptable expansion of a governmentthat is already too intrusive in our lives. If we are going to hire150,000 new employees, let's put them to work protecting our borders, fighting the massive drug problem and putting more lawenforcement/firefighters out there."

JUDGE KITHIL continued: "Otherproblems I have with this bill include:
** Page 50/section 152: The bill willprovide insurance to all non-U.S. residents, even if they are hereillegally.

** Page 58 and 59: The government will have real-time accessto an individual's bank account and
will have the authority to make electronicfund transfers from those accounts.

** Page 65/section 164: The plan will besubsidized (by the government) for all union members, union retireesand for community organizations (such as the Association of CommunityOrganizations for Reform Now - ACORN).

** Page 203/line 14-15: The tax imposedunder this section will not be treated as a tax. (How could anybody intheir
right mind come up with that?)

** Page 241 and 253: Doctors willall be paid the same regardless of specialty, and the government will setall doctors' fees.

** Page 272. section 1145: Cancerhospital will ration care according to the patient's age.

** Page 317 and 321: The governmentwill impose a prohibition on hospital expansion; however, communitiesmay petition for an exception.

** Page 425, line 4-12: The governmentmandates advance-care planning consultations. Those on Social Security
will berequired to attend an "end-of-life planning" seminar every fiveyears. (Death counceling.)

** Page 429, line 13-25: The governmentwill specify which doctors can write an end-of-life order.

HAD ENOUGH???? Judge Kithil then goeson:

"Finally,it is specifically stated that this bill will not apply to members ofCongress. Members of Congress are already exempt from the SocialSecurity system, and have a well-funded private plan that covers theirretirement needs.
If they were on our Social Security plan,I believe they would find a very quick 'fix' to make the plan
financially sound for their future."

Honorable David Kithil

Health Care Bill

I can not believe what the Democrats did in order to pass the Health Care Bill. I thought it was illegal to bribe Senators in order to get there votes on something. The FBI has done stings on Senators and Congressman taking bribes to get votes on certain bills and other things to help companies or individual. Well what is the difference between the Bribes the Democratic Leadership did to get votes on the HCB and what the FBI stings did and arrest certain members for taking bribes. I used to be registered Democrat then registered Independant. I have now come to the realization that we have to come up with a 3rd party. Therefore for the first time in my life I am going to vote outside of the Republican or Democrate party and hopefully the Tea Party will have there own Candidates I can vote for or in the least I will vote for whatever candidate the Tea party endorses. I believe in everything the Tea Party stands for and as long as the Tea Party stand up for conservative values they will now get my vote and support. This country is in big trouble and we have to take it back and the polling booth is where we should start. Get out the vote and lets get these people out of office. You know who I am talking about the ones that say one thing and just does the same status Quo...
