  • Thank you for your comment! In form I agree with you, except to say that I wasn't trying to give a complete history ot the original Tea Party. The idea was in general at the very least; to ignite a spark in hope and to make a few think at most. Although your argument in Pollock v. Farmers Loan & Trust is sound Chief Justice White held that while the 16th Amendment did creat a new form of taxation it did not creat "...one provision of the Constitution to destroy another; that is, they would result in bringing the provisions of the Amendment exempting a direct tax from apportionment into irreconcilable conflict with the general requirement that all direct taxes be apportioned." Needless to say, the 16th Amendment is a direct taxation and must be apportioned as is directed by the original Constitution. Therefore, the income tax as it is handed down today by the I.R.S. is an excise tax and the person paying such tax must be given the choice of whether they wish to be taxed or not. If you do not wish to pay a whiskey tax, then don't buy the whiskey. But thanks again for your comment.
