Jobs Bill Force States to Surrender Sovereignty
Jobs Bill is not about creating jobs, but surrendering States Sovereignty. Under Sec.376, States receiving any Federal funding whether Medicaid, Medicare, Tuition, FEMA, etc. will now surrender its Sovereignty under this new Jobs Bill. Surrendering Sovereign Immunity allows states to be sued by anyone recognized by the Federal Government. Interesting that Hilda Solis has been advocating the rights of illegals and now this Jobs plan forces states to yield its sovereignty to be sued. It is also likely Labor Unions could invoke this requirement to supersede Right to Work and force unionization of state agencies and businesses. Is this a Jobs Bill or a Bill to expand Federal power via DOJ, DOL, and others members of the Federal Family?
SEC. 376. FEDERAL AND STATE IMMUNITY.
(a) Abrogation of State Immunity- A State shall not be immune under the 11th Amendment to the Constitution from a suit brought in a Federal court of competent jurisdiction for a violation of this Act.
(b) Waiver of State Immunity-
(1) IN GENERAL-
(A) WAIVER- A State's receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment to the Constitution or otherwise, to a suit brought by

an employee or applicant for employment of that program or activity under this Act for a remedy authorized under Section 375(c) of this Act.

This should be called the "Lead Zeppelin Act" because it ain't gonna fly, and Obama knows it. He doesn't want it to, either. He's been setting the GOP and TEA Party up for major dissing since his "jobs" speech in congress. When his bill doesn't pass (cuz we don't luv him) he'll point his finger at the Republcans/TEA Party and blame us. You just watch as see if he doesn't claim that we're holding the economy "hostage" or some other foolishness. I saw something about even Harry Reid isn't impressed with Obamas bill.
I agree we need the extention for the short term. But lets look at this issue from another point of view. should a state be sueable. We the good citizens of the states have been having our constituation rights abused by big bussiness from far to long and the way that has been tqking place is the bar on sueing states actually is a tool of big business to prevent citizens from sueing from wrongs. As a example only. The current states in the US have adopted and policy of uniform workmans compensation laws in 49 states. These laws form like this more or less. The population is subjected to these laws and REDRESS LAWS are supressed illegally in each state. That is right you the injuried worker does nto have a course of REDRESS. The right to sue from wrong doing or injury cased by a employer. A fundamental constituation right of redress is being sold to big bussiness. Now the end result is millions of injuried workers being dumped onto walfare, medicare ect. Now the large corperation now are cost shifting there bussiness operation onto public backs. That would be your and my backs. This system rewards doing evil and forced people to endure greater hardship after receiving a work injury. Big bussiness also is exempt from having inspection in the workplace as a result of opting into the Workmans Comp system. This allows wholesale abuse of employees becasue the large corperation then have no incentive to provide a safer workplace. Also there is no pentallity for employers having a increase in injuried workers. So a big box retailer such as fraud mart. Will cut it workforce to the bone to increase profits. Then due to the reducd work force. Work place injuries dump millions of employee onto the public coffers. The coperation and the state governments in effect are being allowed to engage in Rachettering. RICO
And that was done to get ride of th ctizens right to REDRESS. The most basic fundalmental right to sue from wrongs. This right to redress is why our nation had such a great stard. With out the right to redress and people suffer. No redress no improvement in life and corperations become abusive. Of course some people abuse the system. But the abuse of a few can in no way justify the conduct of the corperations or the states. And Indeed states need to be sueable.
I know alot about that, I had a child whom was taken away from me. The reason is because i am a christian, i live by a moral code. The state officials, busy bodies, liers and thiefs. Whom are paid by the states to be busy bodies, liers and thiefs. Lied in court, lied outside of court and you name it they did it. But they are protected by a bar to being sued. And indeed they all need to be sued and dumped from ever holding a state job or a federal job. When you put people with no moral into a public truss position you have to hold them to a higher accountability. And that is the meat of the issue in America today. We do not hold people in state nor federal government position accountable for conduct. It is time to CHANGE THAT.
As another from of wickedness. Federal employees get holiday pay from holidays that the average citizen does not get as a employee of a company. It is called wickness. So the people not working for the federal government are paying for people to have payed vacations. When they get none. Sounds a bit preverted. IT IS abusive and preverted.
These systems exist on many levels. The problems created by federal pay scales, Cost of living allowences and Bonsus structures and additiona holiday have almost bankrupted this nation. If you were to role back all pay COLA back until it bagain. You could pay off the debt. COLA allowed the unchecked plundering of the federal and state coffers by wicked R & D alike. Congress current salary is a result of COLA. Of course it is just on little preverted law used to creat injustice in the nation. I guess they don't want to take legal actions again when the states try to uphold their laws or when they want to oppose the constitution without a fight. When they don't get what they want, they break the rules or change them so they don't have any opposition to stealing your money, nation, and rights. No surprise.
What next ? Take away your vote so Obama can decide who leads the next path to destruction? Maybe his illegal alien, law breaking uncle deserves the seat next. Oh but now I'm prejudice.

Congress can't (legally) abrogate the Constitution by legislative means. A perfect case for state nullification, if this garbage passes into "law."
This attempt... in addition to the bill being ANOTHER "stimulus" bill. ? How many "stimulus packages" have miserably failed already ? Is anyone else screaming "DUH !?!" ?
