The leaking of a draft opinion in Dobbs v. Jackson Women’s Health Organization has rocked the Court and Washington. The 98-page draft opinion is dated Feb. 10, 2022 and authored by Associate Justice Samuel Alito. I have two columns coming out today on the opinion and the disgraceful leak from within the Court.
The opinion is joined by Justices Clarence Thomas, Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett. It declares that “Roe and Casey must be overruled. It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
The opinion can change but the damage done to the Court as an institution will likely be lasting. This shattered a long tradition of the Court of strict secrecy and integrity in the handling of drafts.
The leak is the greatest crisis faced by Chief Justice John Roberts and the greatest security breach in the history of the Court.
The question is how the FBI and the Court will proceed in the investigation. Anyone taking this deeply unethical act is likely to have taken steps to hide their tracks. I would be surprised if there were a paper trail or email record. However, anyone who would take such a reckless act may have been equally reckless in the means used to violate the Court’s rules.

Any pretense of honor the High Court had was lost long before this leak... The Warren Court scuttled the Court's honor and reputation long ago with the politicization of Justicial findings. The LandMark case of 'Roe vs. Wade' is a writ... forged with the blood of the innocent. It testifies to the burgeoning absence of justicial reason in the Courts. The sanctioning of abortion remains a disgrace and the high watermark of the courts' corruption... the highlight of a plethora of immoral findings ejecting God from the Public Square and ultimately the living rooms of America.
Any pretense of Justice being administered by the SCOTUS died with the sanctioning of a new morality... and the rejection of natural law and God from its historic influence on the Benches of America's Courts. Anyone who believes any true concourse between righteousness and the High Court exists today is blind. Nearly every evil work is endorsed or tolerated by the Judiciary. Anyone who claims America is a nation occupied by a moral and religious people today has not studied the LAW or the application of modern judicial reason.
No one said the SCOTUS was there to support religion... However, the Constitution clearly states" Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; ..." Constitutional law clearly defends the right of the people to engage in the FREE EXERCISE of religion. That is a mighty powerful statement.
First, a careful reading of the Federalist Papers and the notes on the various debates regarding religious freedom... It is easily concluded, that the term religion referred directly to the Christian Faith… and the restrictions in government were limited to ESTABLISHING A STATE RELIGION… not the recent SCOTUS abrogations of the original intent to allow the free exercise of the Christian faith… religion. The founders and our Constitution were never intended to give protections for Satanists and Muslims, etc.
The Constitution doesn’t bar Religion from participation in the state or government ... On the contrary, every session of Congress and State Legislatures open with prayer and or a religious invocation. The monuments, halls, walls, and the very doors of the SCOTUS are covered with CHRISTIAN icons, scripture, and art. These works and customs demonstrate the irrefutable support for the founding fathers mixing religion with the daily functions of government. The state was never to reject the exercise of religion, it was to avoid the establishment of one particular 'denomination; as a state, religion… thus, outlawing all others.
The first amendment doesn't prohibit religion it guarantees it... and not just any religion. Get over it! Your personal agnostic views are not those of the founding fathers or the Constitution. Our founders were deeply committed Christians and for nearly 250 yrs. our country has been identified as a Christian culture and state... to argue otherwise stands in opposition to reams of historic evidence and tradition, that prove such a claim.
Next, the Courts and justices ADMINISTER JUSTICE... they APPLY the law to the CASE IN LAW Before them... their findings do not apply to every case brought in dispute before the bench... Previous findings (Stare Decisis’) is fiat law (usurped law)... The term settled law is another misnomer as the law is never settled... it is subject to constant dispute, with each new case brought before a judge or jury.
The Courts must have their jurisdiction NAILED down in no uncertain terms… they are totally out of control. The Courts must be limited to the adjudication of the case in law before the court. The findings of each case are unique to that case and must be limited to that case alone. If some judicial wizard attempts to muddy the waters by claiming similar cases need similar verdicts or findings... their license to practice law should b immediately revoked. The injection of previous case law (findings) to somehow stabilize the judicial system is false. It often permits un-elected judges and lawyers to erode the law with the trappings and minutia of judicial findings... which should never become law.
If a law is ruled unconstitutional it must apply only to the CASE IN LAW BEFORE THE COURT, not all cases... The law must remain valid in all its points and those who seek future relief should be required to bring their own case in law before the court; where a judge or jury makes a decision based on the facts and law as applied to that particular case in law. Congress should act to amend or repeal any law when they AGREE with a judicial finding that the law is unconstitutional. If Congress does nothing to address such a finding, the law should remain as passed until congress changes or revokes the law. Unelected Judges' must not have their findings void laws passed by Congress or legislatures and signed into law by the proper executive authority.
The remedy for bad law is to bring the case before the court... EACH CASE ON ITS MERITS... until Congress or the legislature changes or repeals the offending law... The law must not be rewritten or modified by judicial findings, future cases must stand on their own merit.

Actually, the believer is responsible to God for warning the unbeliever... AND for shepherding the weak in Christ. Many who profess to be members of the Body of Christ simply have no idea of the role of the Body of Christ, and their responsibility, before God, for perfecting the Saints, to bring the Body's members into unity, unto a perfect man... Many in the Church have failed in their duty to one another... starting with the clergy and extending to the elders in the laity.
The phrase, “perfecting the saints,” in Ephesians 4:12... refers to helping saints understand the Word of God. The word perfecting in Greek is ‘katarizo’ which means “to equip for service.” It also means “restoring things to their proper place” to make them complete. Ephesian’s 4:11-14 follows:

Corruption has entered the Church... The evil present in the days of Noah and Sodom and Gomorrah has returned and is holding captive the misguided. Our Nation’s Constitution and form of self-government work only where there exists a moral and religious people. The SILENT MAJORITY in the Body of Christ needs to speak out against the culture that has challenged God’s Law and precepts for life and government. Until the People return God to His proper place at the Head of Man and his House… his family and government... America will go the way of a decaying and dying world. The People can not serve two masters… Mammon and God… sin and righteousness.
One’s service to God is not a trifle… it is the whole duty of mankind and those who understand this will not remain silent before the enemy. What if one of the Justices leaked the information?
Very possible... especially the newest Judge. The courts have become the seats of political activism... judicial findings are being used as law something our forefathers would have rejected. Judges administer the law, the FEDERAL Judiciary and Courts are not to administer law that is the specific function of the State Legislatures, Congress, and or the State Executive. It is time to reign in the federal Judiciary... establish term limits AND end 'Stari Decisis, as settled or case law. Stari Decisis is fiat law (not constitutional)...
Judicial findings should APPLY ONLY to the case before the Court and no other. If a law is ruled unconstitutional in a judicial finding... the law remains valid in all other cases. Congress or the State Legislature must agree with the Court and when they do ... they must repeal or amended the law to make it constitutional or remove it. The Courts don't have the constitutional power to strike down the law in general... it must be case by case until the proper Constitutional authority acts to either remove, amend or notify the Court that their decision was made in error and the law remains as is.. no more fiat law.
The Judiciary needs to be stripped of its usurped powers... Administrative Courts should be voluntary only... and given only the power to issue administrative and monetary findings... no criminal sanctions. Federal Courts should only administer cases that are not covered by State Jurisdiction... States should have primary jurisdiction for all criminal acts except those on federal lands, property, possessions, or where the case is a clear Federal Statutory violation. The Federal Court Jurisdiction must be restrained to comply with Constitutional limits.
Two questions: 1. Will the rioting, violence and destruction caused by the Liberals in this protest be considered a Disruption of Federal Process, Trespass and Insurrection? 2. Will the Democrat Politicians who encourage and support such violence as well as the "perps" conducting it be arrested, incarcerated indefinitely, denied bail and access to Legal Counsel like the Republicans and Jan 6 protestors? My educated guess is NO! In fact, Ilhan Omar has already prepared a statement in the Lefts defense quote: "Just some people... doing something".
