There undoubtedly will be the argument made that the President has no 'DIRECT PERSONAL' Constitutional authority to execute the Laws of the US... However, if it were Biden the argument would be just the opposite.  Historically, the President’s powers to execute the laws of the United States have been exceptional.  It has only been recently that the DOJ and Congressional legislation have challenged a President's Constitutional authority to use his vast resources to pursue crime… especially, political criminals.   I wonder why now?

The US Marshall Service is part of the DOJ and the President's Administration.  The Constitution clearly states that the President is to commission all the officers of the United States.  See: Article 2, Section 2, Clause 2, and Article 2, Section 3.  US Marshalls are commissioned and appointed by Presidential authority.  The President holds the ultimate Constitutional Authority to staff... appoint... US Marshalls, not the AG.  Essentially, all US Marshalls and their deputies serve at the President's pleasure making them RESPONSIVE TO HIS ORDERS... or dismissal. 

The AG has statutory authority to supervise the agencies within the DOJ... including the US Marshalls Service.  However, the AG and all of the DOJ-appointed officers serve at the pleasure of the President.  The President may dismiss the appointed officers without cause.  US Marshalls are commissioned under the President’s Constitutional authority.  Albeit, the AG has been delegated statutory authority to appoint US Marshalls. That statutory power, however, encroaches on the Constitutional authority of the President.  It can be argued that the President's power is supreme in this matter and if necessary the President can remove any AG who refuses to sign on to the President's powers to appoint his own US Marshalls.

Several constitutional scholars challenge the President's authority... to actively and directly enforce the law. In fact, the existing statutory limits on Presidential power to execute the laws are overreaching. The DOJ is becoming the 4th Branch of Government, operating nearly independently of the President and his administration.  That is why America needs a 'Jackson' as President.  One willing to fire the entire cabinet if necessary to return the balance of power between the Branches of Government.  A president who is willing to create his version of the Jackson ' Kitchen Cabinet' could thwart the US Senate and deep state's unconstitutional statutory and regulatory limits on the President's constitutional authority to directly enforce the laws of the United States. 

America needs a ‘Bull in the China Closet’...  A President willing to challenge Congress and the subversives in his Administration... the political appointees and compromised career civil service who are acting as roadblocks to the President's law enforcement powers. The next President must be ready to fire several AGs, and their assistants, in succession. He must be prepared to dismiss the Directors of the FBI and US Marshalls Service and any other senior DOJ officials who resist his effort to prosecute political corruption. 

The next President must make it clear that he is the NATION’S CHIEF CONSTITUTIONAL LAW ENFORCEMENT OFFICER...  He must affirm the Constitution charges the President alone, to 'TAKE CARE THAT THE LAWS BE FAITHFULLY EXECUTED', and that the President 'shall commission and or appoint all the officers of the United States.'  See:  Article 2, Section 3 and Article 1, Section 2, Clause 2.  He must send a clear signal to the deep state that he has unilateral authority to dismiss any appointed official and officer in the DOJ.  He then must demonstrate his willingness to use that authority… filling the vacancies created with his temporary appointments. The President can reappoint any current officials if he later determines they meet his standards and America's needs.

The next President must quickly establish clear boundaries that define the separation of powers between the Branches of Government... He must make it understood that the Executive Branch Administers the government and EXECUTES THE LAWS.  That the Legislative Branch (Congress) legislates needful law, funds the government, and conducts civil, not criminal, oversight of the government.  Congress does not administer the government, conduct criminal oversight, or execute the laws of the United States.  He must remind the Judicial Branch that they must not legislate from the bench by referring activist judges for impeachment.  He must work with Congress to rewrite the Federal Judiciary Act, keeping an eye on limiting the federal court's jurisdiction and fixing various internal structural issues... by expanding the SCOTUS to operate within three Divisions....  civil, criminal, and constitutional Divisions, each with 9 justices  He should recommend the expansion of federal court Districts from 94 to at least 100, and a complete overhaul of the administrative and immigration courts  

Congress and the AG must acknowledge the President's constitutional authority to execute the law of the US as he determines appropriate... too, order and direct investigations, pursue federal crimes wherever found, to recommend indictment to grand juries, to prosecute criminal conduct, without obstruction by Congress or the bureaucracy.  Such obstruction must be labeled as unlawful obstruction of justice.  The President must exercise his Constitutional authority to DISCIPLINE and supervise the DOJ and its various federal law enforcement agencies... without statutory interference. The DOJ, and its federal law enforcement agents... FBI, US Marshals, BATF, etc. must all be subject to direct presidential oversight and discipline… up to and including dismissal... as the president sees fit.

The next President must act as the Chief Law Enforcement Officer of the US...  He must not tolerate the unlawful and unconstitutional usurpation of his authority by members of the DOJ or his cabinet and the other branches of government.  Should Congress or the DOJ interfere with the next President's authority as Chief Law Enforcement Officer he must take a page out of Lincoln's annals by issuing Presidential Warrants for their detention, indictment, and prosecution... If necessary, the next President may declare Martial Law, while he drains the swamp and restores constitutional government.

Why is this so important... the President's power to enforce the laws of the United States rests in the Constitutional power to FAITHFULLY EXECUTE the law... too, effectively administer GOOD GOVERNMENT the President must have the power of the SWORD and the LAW.  Without the power to directly execute the laws of the US; too, hold accountable the agents of the government, the President becomes a mere spoke on the wheels of corruption... going round and round... never quite able to direct its course. 

If a President is unable or denied the right to faithfully execute the laws of the United States... he becomes a mere figurehead. The real power in a government lies with those who bear the sword,  It rests with those who have the power to direct the agents of law enforcement.  Government power is managed by those who wield the sword of the law.  The President must be able to initiate investigations, direct existing investigations, and approach Federal Grand Juries with proposals to indict.  A President must have all the powers now held by the DOJ, and Federal Law Enforcement, if he is expected to regulate and control the bureaucracy and its political operatives ... those who are now the rogue elements of government.

Government is not reason; it is not eloquent; it is force. Like fire, it is a dangerous servant and a fearful master.  George Washington  Presidents must be both fire marshall and the people's arm of justice if we are to have good government.  Accountability starts and ends with the President. He is the Constitutional Officer charged with keeping all the Branches of Government and their agents accountable before the law.  It is the faithful execution of the law that is the best measure of a nation's greatness and civility.

  • Isn't it amazing as to what a president can or can't do depending on whether the left controls who is in office or not!!!!!  When President Trump, still the true president, held office the left constantly said he had no authority to change anything but had responsibility for everything but now that they have their illegitimate FRAUD in office power is unlimited but responsibility is nonexistant!!!!!!!!!!

    • If only Fraud vitiates everything... the fact is power whether legitimate or not is being exercised,., to the detriment of us all. Power can be either legitimate or illegitimate, it is up to the people to ensure that it is LEGITIMATE power running the State.  The People have failed to act with sufficient force and on time to guarantee Constitutional Government.  Biden is doing what criminals do... he is acting out criminally.  The dead rarely demands their lives be returned when taken fraudulently by a criminal. The only time I know that happened was at the CROSS OF CALVARY... where Satan had to release Christ as he held him fraudulently.

    • Don't mistake AUTHORITY for POWER... although Biden has no legal authority he has usurped powers that are quite effective...  legitimate and illegitimate power are both forms of force that can be brought to bear on most issues.  Biden's powers may be illegitimate; regardless, they are effective.

    • It's funny yet sad... Fed up Americans keep saying "They Can't Do That" of the Democrats... and yet they do! Knowing full well when you control every branch of Government, Agency and the Courts who's gonna stop em?

      Pres. Trump needs to examine where he has taken us and where we are currently heading...  He needs to organize an effective resistance; one, that is capable of resolving all of our core issues with leadership and the government's overreach. Pep rallies focused on raising money for his campaign, must not be his primary objective.  Draining the swamp and eliminating the deep state must be his ultimate goal and his ever-present focus.  It is time that his vast corporate empire focuses on the use of passive, aggressive civil disobedience (the Lech Walesa model for government reform) to reinstate Constitutional Government. It is past time that both political parties be exposed for their betrayal of America... No more fence-sitting.
