The judge who ordered Pennsylvania to not certify the results of the 2020 election wrote in an opinion on Friday that the Republicans who filed the related lawsuit will likely win the case.

Pennsylvania Commonwealth Judge Patricia McCullough made the assessment as part of an opinion explaining her rationale for blocking Pennsylvania’s election certification.

A group of Republican lawmakers and candidates sued the Keystone State earlier this week, arguing that the state legislature’s mail-in voting law—Act 77—violated the commonwealth’s constitution.

“Petitioners appear to have established a likelihood to succeed on the merits because petitioners have asserted the Constitution does not provide a mechanism for the legislature to allow for expansion of absentee voting without a constitutional amendment,” McCullough wrote.

When ruling on an emergency injunction, judges have to consider whether the party which requested the injunction is likely to win the case or “succeed on the merits.” McCullough opined that the “petitioners appear to have a viable claim that the mail-in ballot procedures set forth in Act 77 contravene” the plain language of the provision of the Pennsylvania Constitution which deals with absentee voting.

Pennsylvania said that it had certified the results of the election for president and vice president on Nov. 24 while the court was reviewing briefings from both parties. In response, the plaintiffs filed a request for an emergency injunction, arguing that that state need not have acted so fast.

“It appears that respondents’ actions may have been accelerated in response to the application for emergency relief … in an effort to preclude any remedial action by this court faster than this court was able to evaluate the application for emergency relief and the answers to it,” the plaintiffs wrote.

  • Does anyone know what the PA Legislature is doing... are they in session, have they called for a resolution to declare the certification of the election void and to appoint new Electors based on their Constitutional duty?   Are we being lied to again... by two faced legislators ... whose obvious goal is to appear concerned and when all fails to point fingers everywhere but at themselves?

    • I believe we are being lied to.

    • No, I believe the PA legislature is true to most politicians of the day... sellouts to a new world order.  Americans no longer hold the franchise on their elections... they are being managed by global interests.

      An 11th-hour attempt by some Republican members of the Pennsylvania state House to get the Legislature to directly intervene in the state’s certification of President-elect Joe Biden’s popular vote victory here appears to have fizzled after a virtual majority party caucus meeting Saturday night.

      A group of members, none of whom are part of senior House leadership, had crafted a resolution that would declare a finding of the House that the results of the presidential election are in dispute, and “urging” Gov. Tom Wolf and his Secretary of State Kathy Boockvar to rescind their certification of Biden’s win.

      The resolution, by itself, wouldn’t have been binding on Wolf, but supporters were hoping it would have created a platform and more pressure for further steps including: a formal challenge to the seating of Pennsylvania’s Democratic Party electors by members of the state’s Congressional delegation; or efforts within the General Assembly to name its own electors.

       

      But after Saturday’s discussion, it was clear the House effort wasn’t going anywhere.

       

      Speaker of the House Bryan Cutler, R-Lancaster County, and Majority Leader Kerry Benninghoff, R-Centre County, said in a statement issued as the caucus broke that they agreed the state’s elections processes and procedures need a top-to-bottom review for consistency and fairness, but they said there is no time to take legislative action on this year’s results and they will not be calling the House back into session.

       

      Their joint statement read, in part:

       

      “We are physically unable to consider any new legislation before the end of session. A simple resolution takes three legislative days for consideration and a concurrent resolution takes five legislative days to move through both chambers, which means we do not have the time needed to address any new resolutions in our current session,” which expires Monday as per the state constitution.

       

      ”It is obvious Pennsylvania’s election processes are in dire need of repair. Our work to ensure the chaos and confusion of the 2020 election are not repeated will continue in the next legislative session.”

    • If President Trump manages to save his reelection the leadership in the PA house have now become CRIMINALLY COMPLICIT with the theft of the public's election/vote and need to be arrested, indicted, and tried for accessory to election fraud, and other appropriate crimes.  It is time to put such individuals on notice... that failure to act to enforce the laws when criminal activity is clearly known to exist, the offending parties will be held to strict accountability.

  • Judge McCullough demonstrates "Constitutional Principle" - - -kudos to her; now if the PA legislature will just do the job they set out to do and change that law so the legislature can appoint the electors, "instead of" their rabid secretary-of-state, it will save the PA election for the GOP and President Trump.
