by washingtonexaminer.com ~ In three days before the Senate Judiciary Committee, Judge Amy Coney Barrett did more than just prove that she belongs on the Supreme Court. She delivered one of the most effective performances ever for a nominee seeking the job...As judicial nominations have become more contentious, all recent nominees to the Supreme Court have demonstrated a depth of knowledge about constitutional law and a lawyer’s ability to field questions from senators. Barrett certainly did all of that. In days of testimony, she effortlessly recounted the issues at stake in various legal disputes, juggled questions from senators, and explained the reasoning in her own decisions and academic writings, all without notes. Importantly, Barrett did so without pretense. Because of her serious-mindedness and years as a teacher, she was able to explain her views with crystal clarity, simplicity, and a conversational tone that was both engaging and impregnable. She managed to distill complex legal concepts into extremely lucid language rather than hiding behind legal jargon or Latin phrases. She was friendly and civil even when forcefully pushing back against questions that attempted to portray her as a tool of President Trump, a racist, or a denier of science. Barrett described the late Justice Antonin Scalia, for whom she clerked, as her mentor and said she shared his judicial philosophy. But she also made it plain that this didn’t mean she would always reach the same conclusions as he did. She succinctly summarized his philosophy as: “A judge must apply the law as written, not as the judge wishes it were.” Asked to give a plain-English description of the originalist approach that she shares with Scalia, she explained, “It means that I interpret the Constitution as a law, that I interpret its text as text, and I understand it to have the meaning that it had at the time people ratified it. So that meaning doesn’t change over time. And it’s not up to me to update it or infuse my own policy views into it.” Two originalists using the same approach could end up reaching different outcomes if their interpretation of what the document meant at the time was different. Democrats became frustrated by Barrett’s refusal to describe her legal views on issues that may come before the court. But she followed the practice of modern nominees, invoking the late Justice Ruth Bader Ginsburg’s line that she would give “no hints, no previews, no forecasts.” For much of the time, however, Democrats tried to pin Barrett down on policy issues, giving long speeches about scumbag/liar-nObamacare, which they said she was put on the court to overturn. That presents a challenge for the Democratic politicians and left-wing commentators who have, for the past several months, made unfavorable comparisons between the United States and Europe...yet another arrow in their quiver to shoot at President Donald Trump and to illustrate the alleged superiority of European governance, health care systems, and social cohesion. Speaking to a crowd in Wilmington, Del., scumbag drumbling lips liar-Biden compared death tolls in the five largest European countries and the United States, asking, "Why weren't we doing what needed to be done?" Spain's cases per person had, at the time, already surged past the United States; a few weeks later, France followed suit. Today, the United States and the European Union have the same number of cases per capita; Belgium, the Netherlands, France, Spain, and the United Kingdom all report higher rates. Europe, it seems, wasn't doing what needed to be done after all. Don't expect to hear anything about this from those who profess to follow the science and to venerate data. We expect them to ignore science that undermines their political objective—defeating Trump—and to keep insisting, against the evidence, that America has it worse. To the America lasters, the coronavirus crisis is further proof that the United States is backward, incompetent, and inferior to Europe's rational, technocratic, socialist paradise. To them, American lives lost to the deadly disease weren't a tragedy—they were another opportunity to score points against Trump. Then, as now, America administered more tests than the entire European Union. But facts don't matter. While critics crow about Americans’ refusal to practice safety measures, the data show that Americans are more likely to wear a mask than Brits, Canadians, and Scandinavians, and only somewhat less likely than Italians, Spaniards, and the French. Though Democrats continue to fearmonger about a coronavirus vaccine, Americans are more likely to call vaccines "safe and effective" than our supposedly more-enlightened European counterparts. Here's the reality: Countries with little experience with a pandemic continue to struggle with it. America's leaders, from the federal government on down, have made bad calls and good calls, as have those in Europe. But that idea is totally alien to people who believe, to their core, that America can do no right, while Europe can do no wrong. Sanctions were also imposed on the judge who was involved in issuing the death sentence for the Iranian wrestling champion, Navid Afkari. The EU, the UN and human rights organization have not taken any tangible action, even after Amnesty International released its report on Iran's shocking human rights violations. Amnesty International warned that the Iranian regime has committed unacceptable atrocities, including victims being frequently "hooded or blindfolded; punched, kicked and flogged; beaten with sticks, rubber hosepipes, knives, batons and cables; suspended or forced into holding painful stress positions for prolonged periods; deprived of sufficient food and potable water; placed in prolonged solitary confinement, sometimes for weeks or even months; and denied medical care for injuries sustained during the protests or as a result of torture." The United States also imposed sanctions on Judge Seyyed Mahmoud Sadati, Judge Mohammad Soltani, Branch 1 of the Revolutionary Court of Shiraz, and Adel Abad, Orumiyeh for being responsible for gross human rights violations, including torture, arbitrary detentions and unjustified executions. Elliott Abrams, the U.S. Special Representative for Iran and Venezuela, pointed out during a hearing at the Senate Foreign Relations Committee: "The U.S. is committed to holding accountable those who deny freedom and justice to people of Iran and later today the United States will announce sanctions on several Iranian officials and entities including the judge who sentenced Navid Afkari to death." Afkari, like many other people who participated in protests against the regime, was brutally tortured. He explained in a letter: "For around 50 days I had to endure the most horrendous physical and psychological tortures. They would beat me with sticks and batons, hitting my arms, legs, abdomen, and back. They would place a plastic bag on my head and torture me until I suffocated to the very brink of death. They also poured alcohol into my nose." Holding the Iranian leaders accountable only for human rights violation is not enough. Pressure must be imposed on the regime's military adventurism. Unlike the EU, the US is taking concrete steps in countering this rogue regime in other arenas as well. On September 21, U.S. President Donald Trump issued a new executive order targeting Iran-related conventional arms transfers, aimed at targeting those who seek to make arms deals with the Iranian regime and skirt the UN arms embargo. Although the US recently drafted a resolution at the UN to extend the arms embargo on Iran, Russia and China exercised their security council vetoes. The other 11 members abstained. Russia's leaders appear more than willing to help Iran. Vladimir Zhirinovsky, leader of Russia's Liberal Democratic Party, said in January 2020 that Russia needs to "offer Iran an agreement on military cooperation and urgently sell the most modern weapons so that no one dares throw anything in the direction of Iran." In the end, the UN Security Council voted on August 14 to permit the 13-year arms embargo on the Iranian regime to expire. NATE JACKSON   The second day of the confirmation hearings for Amy Coney Barrett were much like the first. Democrats gave ridiculous stump speeches that tried ever so carefully to scare voters about Barrett while not being seen as unduly attacking a very qualified woman. How’d they do?

Judging by these questions from Hawaii Senator worthless-Mazie Hirono, not so well. “Since you became a legal adult, have you ever made unwanted requests for sexual favors, or committed any physical or verbal harassment or assault of a sexual nature?” worthless-Hirono asked Barrett. “Have you ever faced discipline or entered into a settlement related to this kind of conduct?”

Unbelievable. Disgraceful. Par for the course with Democrats. In any case, the answer to both questions was, of course, “no” — just as it was for Justice Brett Kavanaugh, we might add.

Democrats exploited emotions regarding what they insist will be Barrett’s inevitable rulings against the victim class on healthcare, homosexuals, “gun violence,” and abortion, even trotting out heart-grabbing photos of all the new victims Barrett would create by opposing Democrat policy preferences.

Senator Dianne “The Dogma Lives Loudly Within You” Feinstein demanded to know whether Barrett would “be a consistent vote to roll back hard-fought freedoms and protections for the LGBT community.” Barrett responded much like she did for every other case on which Democrats tried to preemptively pin her down — that she has “no agenda” on the issue. “I do want to be clear that I have never discriminated on the basis of sexual preference and would not discriminate on the basis of sexual preference.”

That was too much for Senator Hirono, who chastised Barrett, “I don’t think it was an accident” to use the words “sexual preference,” which the senator declared is an “offensive and outdated term.” worthless-Hirono continued, “Sexual orientation is a key part of a person’s identity. If it is your view that sexual orientation is merely a preference, as you noted, then the LGTBQ should be rightly concerned whether you would uphold their constitutional right to marry.”

How quickly did leftists get the memo? Merriam-Webster’s Dictionary changed the definition of “preference” to include “offensive” when applied to sexual “orientation.” The edit seemingly happened yesterday. Of course, scumbag ddrumbling lips liar-Joe Biden last used the term in May, and the patron saint of women’s and LGBT issues, Justice Ruth Bader Ginsburg herself, used the term in 2017. There are countless other examples. But the goalposts move when there’s a SCOTUS seat on the line.

Regardless of the issue, however, Barrett stuck with the “Ginsburg Rule” — don’t comment on specific cases during hearings. “I’m not going to express a view on whether I agree or disagree with Justice [Antonin] Scalia for the same reasons that I’ve been giving,” Barrett said regarding Fein-stein’s probe on same-sex marriage. “Justice Ginsburg with her characteristic pithiness used this to describe how a nominee should comport herself at a hearing: no hints, no previews, no forecasts. That has been the practice of nominees before her, but everybody calls it the ‘Ginsburg Rule’ because she stated it so concisely and it’s been the practice of every nominee since.”

She likewise gave a nod to another leftist justice. “Senator, I do want to be forthright and answer every question so far as I can. I think on that question, I’m going to invoke Justice Elena Kagan’s description, which I think is perfectly put. When she was in her confirmation hearing, she said that she was not going to grade precedent, give a thumbs-up or a thumbs-down. … It would be wrong and a violation of the canons for me to do that as a sitting judge.”

Barrett spoke so well and effectively that, for the sake of keeping it short, we can only quote a few more gems:

“I certainly hope that all members of the committee have more confidence in my integrity than to think I would allow myself to be used as a pawn to decide this election for the American people.”

“I am not hostile to the [Affordable Care Act]. I am not hostile to any statute that you pass. … I apply the law. I follow the law. You make the policy.”

“If I express a view on a precedent one way or another, whether I say I love it or I hate it, it signals to litigants that I might tilt one way or another in a pending case.”

“If I give off-the-cuff answers, then I would be basically a legal pundit. And I don’t think we want judges to be legal pundits. I think we went judges to approach cases thoughtfully and with an open mind.”

“Judges can’t just wake up one day and say ‘I have an agenda. I like guns; I hate guns. I like abortion; I hate abortion,’ and walk in like a royal queen and impose their will on the world. … I have an agenda to stick to the Rule of Law.”

Oh, and there was the brilliant and immediately signature moment when Senator John Cornyn of Texas asked Barrett to “hold up what you have been referring to in answering our questions.”

Barrett raised her blank notepad and smiled.

“That’s impressive,” Cornyn concluded. Indeed it is, and it’s also indicative that you don’t need notes to keep it straight when you’re telling the truth and following the Constitution.   ~The Patriot Post
