  •    They will NEVER run out of "HATE TRUMP"! They are now free to make up anything they want. I they are now Judge, Jury and Exicutioner. I can't imagine the frustration of the deceived Biden voters.     Once more it is more than a personal problem... it is an issue of Executive Privilege and the separation of powers... all branches being equal.  The Congress and certainly the FBI and DOJ are not Constitutionally empowered to order the Office of President and Chief of the Executive Branch of Government to do anything. 

    Impeachment is the Constitutional means to deal with a rogue President.  Once removed from office then the President is open for criminal due process… indictment and prosecution.

    • Roland, I can't believe that you approve of the FBI and DoJ going after President Donald J. Trump, since Trump is not in office right now and therefore, he "is open for criminal due process.....indictment and prosecution". Who needs enemies when you have friends like that?

      I do not… and did not approve of the FBI or DOJ going after Pres. Trump... BECAUSE HE IS NO LONGER IN OFFICE.  In fact, I believe Pres. Trump retains ‘EXECUTIVE PRIVILLEGE’ regarding the use and control of his private and official presidential papers; as the products of his Constitutional Office. 

      There is a vast difference between APPROVING the FBI and DOJ seizing documents produced under the doctrine of ‘Executive Privilege...’ and investigating the conduct and subpoenaing the documents of a former president, which have no right or claim to ‘Executive Privilege’.  There are certain acts and conduct which remain essential to defense of the separation of powers doctrine, in the life of a former president.  Protected acts of ‘Executive Privilege’ occur whenever a former President is functioning in an official status… as a former president… for ceremonial events or various legal actions which could compromise his former Office as President.

      I do not approve of the DOJ and FBI seizing products produced by Pres. Donald Trump while President or after leaving office in the performance of his duties as a former President… unless, he agrees to voluntarily releases them.  I hope this clarifies my position on the illicit use of the FBI and DOJ to seize the documents and papers of Pres. Trump’s Presidency, which are subject to ‘Executive Privilege.

      In all other cases… not subject to executive privilege… a former President is subject to the rule of law and due process, provided to all US Citizens, under the US Constitution… as a private citizen, he is not above the law.

    • Ok. Now I get what you mean. A former president is above the law as far as his actions in office or related to the office are concerned, unless he cooperates voluntarily. Thanks for explaining!

    • No one is above the law... it is the OFFICE of the President and the Executive Branch that has ‘Executive Privilege’ which exempts certain materials and the personage of the President from indictment or subpoena.  Executive Privilege attaches to the products and the papers generated by a sitting President while performing the official duties of the OFFICE OF PRESIDENT...

      In addition, a President is not indictable for criminal conduct while holding the OFFICE OF PRESIDENT... It is the Office that is above the law... not the man.  The Executive Branch and Office of the President…are co-equal branches of government… they are soverign entities.  A sitting President may not be indicted, he is soverign while in office. Similar to a King, a sitting President is exempt from indictment.  In the President's case though, it is the Office and Executive Branch of Government, that is soverign and above the law.

      Congress may IMPEACH a President... thus, removing him from Office… then the DOJ and Judiciary may INDICT and TRY him for any alleged criminal conduct.  A sitting president however is, in effect a coequal branch of government and a soverign.  The Office is enshrined in the personage of the President UNTIL HE IS REMOVED BY IMPEACHMENT, THE 25th Amendment,  OR HIS TERM ENDS...

      A former President retains Executive Privelege rights when the law, Congress, or any other agency seeks access to his Presidential papers or the products of his office while he was president.  Executive Privilege’ is also applied to any ‘official’ papers or documents that originate from his actions as a former president.

    • Your explanation confirms what I summarized before. President Donald J. Trump retains executive privilege, thus he is above the law in this context, and the FBI had no business raiding his private residence. He could have been removed from office by being impeached and he wasn't. So, nobody can implicate him on anything related to the Office of President anymore, as it should be. We all know that this is another witch hunt that has no basis in law as you lay it out in your post so well and eloquently. Thanks again!

      Be it as it may, we all also know that President Trump will be vindicated and that he himself is clean as a whistle even as another one of his former associates is being prosecuted by the deep state. Fortunately Allen Weisselberg is loyal to President Trump and is not cooperating with the deep state operatives. He rather takes the "bullet" and pleads guilty. What a patriot!

    • Exactly... executive privilege is a legal defense against interference in the functions of the Executive Branch and the Office of the President.... it is the Office and Branch that is being afforded a legal exemption from the other Branches of Government and opposition political parties.
