<p>In a major development, Judicial Watch forced the declassification and release of an FBI memo or âelectronic communicationâ (EC) that officially launched the counterintelligence investigation, termed âCrossfire Hurricane,â of President Trumpâs 2016 presidential campaign.</p>
<p>We obtained the document that disgraced FBI official Peter Strzok wrote in our FOIA <a href="https://www.judicialwatch.org/press-releases/judicial-watch-sues-doj-for-electronic-communication-that-initiated-counterintelligence-investigation-of-president-trumps-2016-campaign/">suit</a> against the FBI and DOJ for: âThe Electronic Communication that initiated the counterintelligence investigation of President Trumpâs 2016 presidential campaign.â (<a href="https://www.judicialwatch.org/documents/jw-v-doj-electronic-comms-counterintel-complaint-02743/"><em>Judicial Watch v. U.S. Department of Justice</em></a> (No. 1:19-cv-02743)).</p>
<p>The redacted document details seemingly third hand information that the Russian government âhad been seeking prominent members of the Donald Trump campaign in which to engage to prepare for potential post-election relations should Trump be elected U.S. President.â The document also alleges Trump campaign adviser George Papadopoulos claimed to an unnamed party that âthey (the Russians) could assist the Trump campaign with the anonymous release of information during the campaign that would be damaging to Hillary Clinton.â</p>
<p>The document notes, âIt was unclear whether he [Papadopoulos] or the Russians were referring to material acquired publicly of [sic] through other means. It was unclear how Mr. Trumpâs team reacted to the offer. We note the Trump teamâs reaction could, in the end, have little bearing of what Russia decides to do, with or without Mr. Trumpâs cooperation.â</p>

One of the people identified was George Papadopolous (although public media sources provide a spelling of Papadopoulos), who was believed to be one of Donald Trumpâs foreign policy advisers. Mr. Papdopoulos was located in [Redacted] so the [Redacted] met with him on several occasions, with [Redacted] attending at least one of the meetings.</p>

<p>No wonder the DOJ and FBI resisted the public release of this infamous âelectronic communicationâ that âopenedâ Crossfire Hurricane â it shows there was no serious basis for the Obama administration to launch an unprecedented spy operation on the Trump campaign. We now have more proof that Crossfire Hurricane was a scam, based on absurd gossip and innuendo. This document is Exhibit A to Obamagate, the worst corruption scandal in American history. Gen. <a href="https://saraacarter.com/another-bizarre-twist-in-flynns-case-covington-and-burling-will-enter-case-at-judges-invitation/" target="_blank">Michael Flynn.</a> Ranking Republican <a href="https://saraacarter.com/jim-jordan-on-michael-flynn-investigation-fbi-was-out-to-get-the-president-including-going-after-a-three-star-general/" target="_blank">Jim Jordan</a>, R-Ohio, along with his colleague Rep. Mike Johnson, R-LA, sent the letters after FBI Director Christopher Wray failed to respond to earlier requests this month.</p>
<p>The requests are significant and show the growing divide between Congressional Republicans on the committee and Wray, who has failed to respond to numerous requests since the beginning of his tenure at the FBI. Wray has also failed to oblige to Congressional requests to speak with FBI Special Agent Joe Pientka, who along with former FBI Special Agent Peter Strzok, conducted the now infamous White House interview with Flynn on Jan. 24, 2017.</p>
<p>The lawmakers also requested to speak with FBIâs former head of the Counterintelligence Division, Bill Priestap, whose unsealed handwritten notes revealed the possible ânefariousâ motivations behind the FBIâs investigation of Flynn. Not only has the House Judiciary Committee requested to speak with the agents but several years ago House Intelligence Committee had also requested to speak with Pientka regarding the circumstances surrounding the probe into the Trump campaign and Flynn.</p>

<p>For Americans hoping Senate Republicans might finally engage the Russia collusion hoax seriously, last nightâs interview of Senate Majority Leader Mitch <a href="https://www.foxnews.com/shows/special-report" target="_blank">McConnell</a> by âSpecial Reportâsâ Bret Baier was a tremendous disappointment. McConnell better figure out quickly that if he doesnât hold the Resistance accountable for the Russia hoax that harmed his party and the entire country for many years, he wonât have a majority in the next term. If it helps to motivate him, he should remember that not having the majority in the next term means he wonât get to confirm judges, an issue he hopes will be his defining legacy.</p>
<p>For three years, a false and dangerous narrative of treasonous collusion with Russia to steal the 2016 election was woven throughout the media and government. This conspiracy theory harmed international relations, domestic governance, and the lives of many individuals. It ended when a special counsel probe was finally forced to admit in 2019 that there was <a href="https://www.justice.gov/storage/report.pdf">no evidence that any American had colluded with Russia</a> to steal the 2016 election, much less anyone close to President Donald Trump.</p>
<p>Debunking this false narrative was for many years left to a very small band of reporters and congressional investigators. Most of the attention-getting congressional work was done on the House side, including the revelation that Hillary Clintonâs campaign had secretly paid for the false narrative and that there was serious abuse of the Foreign Intelligence Surveillance Act in how the government secured wiretaps to spy on Trump campaign affiliates.</p>
<p>Despite being controlled by Republicans throughout the ordeal, the Senate was largely absent from the fight with the exception of just a few senators â Sen. Chuck Grassley of Iowa and Sen. Ron Johnson of Wisconsin being the primary investigators whose oversight work and document demands paid off. And their work should not be underplayed.</p>
<p>It is due to them that the detailed texts got out about the anti-Trump machinations of FBI investigator Peter Strzok and FBI lawyer Lisa Page. They sounded the alarm about Christopher Steele, author of the Clinton research, whom the media and government had falsely claimed was trustworthy. They detailed FISA abuse. They were concerned about the Flynn case from the very beginning, and fought with the FBI for information about it. They were also responsible for seeking information about the unmaskings that recently made the news. It all should have been much bigger news.</p>
<p>After the Russia collusion hoax helped Democrats win the House of Representatives in the 2018 election, the Senate needed to step up the fight. Yet McConnell didnât prioritize the issue in any way. He never noticeably supported the senators or committees who were doing actual work. He instead deferred to Richard Burr of North Carolina, the ostensible head of the Senate Select Committee on Intelligence, which for years has in effect been run by Democrat Mark Warner.</p>
<p>Burr was a Russia hoaxer, threatening legislation to protect Robert Mueller, the Republican who was presented as heading the probe. When Mueller appeared before Congress to defend the special counsel report, he had very little knowledge of it and <a href="https://babylonbee.com/news/i-am-still-sharp-as-a-tack-protests-mueller-moments-before-taking-phone-call-on-a-banana" target="_blank">appeared extremely befuddled</a>. <p>Only yesterday, after Burrâs cell phone was seized by the FBI as part of its investigation into alleged insider trading, did he finally step down from chairing the committee. That committeeâs major addition to the Russia collusion storyline was the arrest of a staff member for <a href="https://thefederalist.com/2020/03/20/insider-trading-scandal-is-just-latest-reason-burr-should-be-removed-as-intel-chair/" target="_blank">lying about leaks to the reporter(s) with whom he was having extramarital relations</a>.</p>

<p>FBI Agents Peter Strzok and Joe Pientka interviewed National Security Advisor Michael Flynn on January 24, 2017. According to documents presented in the court case, agent Peter Strzok did the questioning and agent Joe Pientka took most of the notes.</p>
<p>Following the interview agent Pientka then took his hand-written notes and generated an official FD-302; an FBI report of the interview itself. There has been a great deal of debate over the first draft, the original FD-302 as it was written by Joe Pientka. In the case against Flynn the DOJ prosecutors never presented the original Pientka 302.</p>
<p>On May 2, 2020, the DOJ, using new information gathered by U.S. Attorney Jeff Jensen, declassified and released a segment of James Comey testimony that was previously hidden. Within <a href="https://t.co/s8M7D0yvjA?amp=1" target="_blank">the transcript</a> Comey says Pientka wrote the Flynn 302 on<strong> January 24th</strong> immediately following the interview. <p>People defending the FBI have even said it never existed. However, the testimony of FBI Director James Comey proves the 302 was drafted on <strong>January 24th</strong>.</p>
<p>Additionally, recent evidence from <a href="https://t.co/3Q0CcWAleH?amp=1" target="_blank">Brady material turned over to the defense</a> by auditing attorney Jeff Jensen showed FBI lawyer Lisa Page and FBI Agent Peter Strzok rewriting, editing and shaping the 302 on February 10, 2017, more than two weeks later:</p>

<p style="padding-left:40px;">Peter Strzok replies back to Lisa Page that he was âtrying to completely re-write the thing so as to save Joeâs voiceâ, because Joe Pientka was the actual author.</p>
<p style="padding-left:40px;">Peter Strzok is re-writing the interview notes of Pientka in order to construct the framework to accuse Flynn of lying. Lisa Page is editing the re-write to make it more cogent and readable.</p>
<p>The question has remained: Where is the original 302 report as written by Pientka?</p>
<p>While the question(s) around the missing original 302 have yet to be reconciled, one possible path to discover its location and a copy of its original content lies in the testimony of Sally Yates. Former DAG Sally Yates <a href="https://www.youtube.com/watch?v=YtIQdneqlq4" target="_blank">testified to congress</a> that after the Flynn interview DOJ-National Security Division:</p>

<p>Yates is describing the Pientka 302. The Pientka 302 could have been received at the DOJ-NSD later in the evening of January 24th, or perhaps the morning of the 25th. Either is possible because Yates was having meetings about the topic.</p>

<p>May 10, 2020. "OBAMAGATE!"</p>
<p>That's when President Donald J. Trump <a href="https://twitter.com/realDonaldTrump/status/1259561821289226248">tweeted</a> the one word, all-caps, one exclamation mark, that changes everything. A day earlier, the president had also tweeted <a href="https://twitter.com/realDonaldTrump/status/1259328864859422723?s=20">Jesse Watters' video</a>, titled âObamagateâ â the scandal at the epicenter of American politics that has had many names: âRussiagateâ, the âRussia Hoaxâ, âSpygateâ, but itâs only fitting that it should end with its true name.</p>
<p>This was never about the Russians and the spies were cogs in a machine who were following orders.</p>
<p>One man, not some nebulous organization or unaccountable bureaucracy, pushed the lever and decided to use the machinery of law enforcement and intelligence agencies to suppress the political opposition.</p>
<p>Another Democrat in a White House long ago once put up a sign on his desk that said, "the buck stops here." Or, as Lisa Page, formerly of the FBI, texted much more recently, âpotus wants to know everything weâre doing." The POTUS in question wasnât Truman anymore: it was Barack Obama. And the gang that couldnât frame straight was prepping FBI ex-boss Comey to brief Obama on the plot.</p>
<p>In an address to the real deep state, the 3,000 members of the Obama Alumni Association, the titular head of the government in exile that has been working its manicured fingernails off to subvert, undermine, and betray the actual President of the United States lectured on the rule of law.</p>
<p>"There is no precedent that anybody can find for someone who has been charged with perjury just getting off scot-free. Thatâs the kind of stuff where you begin to get worried that basic â not just institutional norms â but our basic understanding of rule of law is at risk," Barry scolded.</p>
<p>General Flynn wasnât charged with perjury. Maybe Page and Strzok should have spent more time helping Comey brief the C student in the Oval Office and less time carrying on. But itâs Obama who might want to spend time reviewing the penalties for perjury or making false statements to the FBI.</p>

<h2>Flynn Timeline</h2>
<p>July 24, 2012: President Obama appoints Lt. Gen. Michael Flynn, a Democrat, to head up the Defense Intelligence Agency (DIA).</p>
<p>2012-2014: Flynn clashes with colleagues and questions the Obama administrationâs claim that the Islamic extremist group Al Qaeda was almost defeated. He also objects to what he says is an Obama administration policy to ban use of phrases such as âIslamic extremistâ terrorism, arguing that âto defeat the enemy, you have to define it.â</p>
<p>April 30, 2014: Flynn announces his retirement as Director of the Defense Intelligence Agency, effective in August. </p>
<p>Feb. 2016: Flynn becomes a Trump campaign adviser.</p>
<p>Nov. 8, 2016: Trump is elected president.</p>
<p>Flynn publishes an op-ed calling for the U.S. to support Turkeyâs president against his opposition. A note is later added disclosing that Flynn was consulting for a company with ties to the Turkish government.</p>
<p>Nov. 10, 2016: Â In a meeting, President Obama reportedly warns Trump against hiring Flynn.</p>
<p>Nov. 18, 2016: Trump names Flynn his national security adviser. Over the next few weeks, Flynn communicates with numerous international leaders.</p>

<p>With the release of the new material from the case of Michael Flynn, an array of experts came forward to assure the public that it was all standard procedure for investigators to conclude that there was no criminal conduct uncovered and then prosecutors creating a crime (including the use of a clearly unconstitutional law never used to convict anyone since the start of the Republic). Many of these same experts who have been espousing untethered (and ultimately rejected) theories for criminal and impeachment charges for years. Yet, what was most striking is how <a href="https://lawandcrime.com/high-profile/the-bombshell-that-wasnt-lawyers-say-the-fbis-tactics-in-michael-flynn-case-were-routine/">many also rejected any claim</a> that the undisclosed evidence, at a minimum, violated <em>Brady</em>, the case requiring the government to turn over exculpatory information. Indeed, Ben Wittes, a staunch defender of James Comey, assured readers âwhile you might not know much about federal law enforcement,â this is all âstandard practices.â In fact, this is a clear and flagrant violation of the both <em>Brady</em> and the orders of Judge Emmet Sullivan. The fact that such violations are also dismissed by mainstream media and experts reflects how rage has distorted legal analysis in this Administration.</p>
<p>Â </p>
<p><a href="http://scholar.google.com/scholar_case?case=9550433126269674519&q=brady+v.+maryland,+373+U.S.+83&hl=en&as_sdt=2,44&as_vis=1"><em>Brady v. Maryland</em></a> is a 1963 decision of the Supreme Court that prosecutors  must under the Fifth and Fourteenth amendments disclose favorable evidence to defendants upon request, if the evidence is âmaterialâ to either guilt or punishment.  There are also d<span>ue process rights requiring the disclosure of any evidence </span>that<span> would allow the defense to attack the reliability, thoroughness, and good faith of the police investigation or to impeach the credibility of the stateâs witnesses. <em>Kyles v. Whitley</em>, 514 U.S. 419 (1995).</span></p>
<p>Courts like Judge Sullivan in the Flynn case issue standard orders under this and other cases requiring disclosure of evidence that are exculpatory or material to issues like impeachment.</p>
<p>Many of us who work on the criminal defense side have long frustrating histories with courts in dealing with violations of <em>Brady</em> and other cases.  Often these violations are exposed after sentencing (unlike in Flynn). Courts often cite cases like <em><a class="new" title="Strickler v. Greene (page does not exist)" href="https://en.wikipedia.org/w/index.php?title=Strickler_v._Greene&action=edit&redlink=1">Strickler v. Greene</a></em> to decline to order a new trial unless âthe nondisclosure was so serious that there is a reasonable probability that the suppressed evidence would have produced a different verdict.â That is a standard that is difficult to overcome.  However, this case exposes a particularly obvious set of violations.</p>
<p><strong>The Background</strong></p>
<p style="text-align:left;">These documents do not show prosecutors finding a way to arrest someone suspecting of a crime. They show prosecutors trying to create a crime.  It was previously known that the investigators who interviewed Flynn did not believe that he intentionally lied. That made sense. Flynn did not deny the conversations with then-Russian Ambassador Sergey Kislyak. Moreover, Flynn told the investigators that he knew that the call was inevitably monitored and that a transcript existed. However, he did not recall discussing sanctions with Kislyak. There was no reason to hide such a discussion. Trump had publicly stated an intent to reframe Russian relations and seek to develop a more positive posture with them.</p>
<p>It now appears that, on January 4, 2017, the FBIâs Washington Field Office issued a âClosing Communicationâ indicating that the bureau was terminating âCROSSFIRE RAZORâ â the newly disclosed codename for the investigation of Flynn. That is when Strzok intervened.</p>
<p>Keep in mind CROSSFIRE RAZOR was formed to determine whether Flynn âwas directed and controlled byâ or âcoordinated activities with the Russian Federation in a manner which is a threat to the national securityâ of the United States or a violation of federal foreign agent laws. The FBI investigated Flynn and various databases and determined that âno derogatory information was identified in FBI holdings.â Due to this conclusion, the Washington Field Office concluded that Flynn âwas no longer a viable candidate as part of the larger CROSSFIRE HURRICANE umbrella case.â</p>
<p>On that same day, however, fired FBI Special Agent Peter Strzok instructed the FBI case manager handling CROSSFIRE RAZOR to keep the investigation open, telling him âHey donât close RAZOR.â The FBI official replied, âOkay.â Strzok then confirmed again, âStill open right? And youâre the case agent? Going to send you [REDACTED] for the file.â The FBI official confirmed: âI have not closed it ⊠Still open.â Strzok responded âRgr. I couldnât raise [REDACTED] earlier. Pls keep it open for now.â</p>
<p>Strzok also wrote FBI lawyer Lisa Page, the same person Strzok had referenced his âinsurance policyâ to in emails. Strzok texted Page: âRazor still open. :@ but serendipitously good, I guess. You want those chips and Oreos?â Page replied âPhew. But yeah thatâs amazing that he is still open. Good, I guess.â Strzok replied âYeah, our utter incompetence actually helps us. 20% of the time, Iâm guessing :)â</p>
<p>That exchange is not disconcerting as Strzokâs actions. After a finding of âno derogatory information,â Strzok reached for the Logan Act and sent a research paper on the notoriously unconstitutional law. Thus, faced with a lack of evidence of any crime, Strzokâs response was to order the investigation be kept open and then focused attention on an unconstitutional law never used to convict a single person. Its use against the incoming national security advisor to say it is a crime to discuss foreign relations with a Russian official during the transition would have been utterly absurd.</p>
<p>The same officials then sent two investigators into the White House, knowingly evading the long-standing rules of contacting the White House Counselâs office in advance â something former FBI Director James Comey later bragged about and said that he âgot away with it.â</p>

<p>Yet another bombshell development emerged Thursday in the case of former National Security Adviser Gen. Michael Flynn: the release of additional exculpatory evidence FBI officials had withheld from the courts and the defense for three years.</p>
<p>Crucially, this includes evidence that the Bureauâs official â302 reportâ filed by the lead agent who interviewed Flynn was edited multiple times, including by an official who never participated in the interview.</p>
<p>Thursdayâs revelations come on top of yesterdayâs disclosures indicating an apparent attempt by FBI officials to trap Flynn into committing a criminal offense during an interview.</p>
<p>The new revelation could prove even more significant: In addition to the apparently calculated effort to get Flynn to commit perjury or obstruction, top FBI figures, including FBI Deputy Assistant Director Peter Strzok and FBI lawyer Lisa Page, repeatedly altered the â302 reportâ that was filed after the Flynn interview.</p>
<p>That interview was conducted under highly unusual circumstances. Ordinarily, an FBI interview of a top West Wing official would be requested through the White House Counselâs office, and would be conducted in the presence of legal counsel representing the official being interviewed.</p>
<p>That did not occur in the case of the FBIâs interview with Flynn, and Comey later stated that under âa more organized administrationâ he âprobably wouldnât have gotten away with it.â</p>
<p>Initially, when the lead FBI agent handling the case was asked whether Flynn lied during the interview, he stated that he did not believe so.</p>
<p>But over the coming days Strzok and Page would edit and revise the agentâs 302 report repeatedly, according to a document providing text messages between FBI officials that the defense counsel finally received this week.</p>

Mike Flynn on January 4, 2017, only to have it reopened by Peter Strzok.</p>
<p>âThe goal of the investigation was to determine whether [Flynn], associated with the Trump campaign, was directed and controlled by and/or coordinated activities with the Russian Federation in a manner which is a threat to the national security and/or possibly a violation of the Foreign Agents Registration Act,â the FBI memorandum formally closing its investigation of Flynn stated. âFollowing the initiation of captioned case, the [Crossfire Hurricane] team conducted a check of logical databases for any derogatory information on [Flynn].â</p>
