<p>Late last week the FBI document that started the Trump-Russia collusion fiasco was publicly released. It hasn’t received a lot of attention but it should, because not too long from now this document likely will be blown up and placed on an easel as Exhibit A in a federal courtroom.</p>
<p>The prosecutor, U.S. Attorney <span class="rollover-people"><a class="rollover-people-link" href="https://thehill.com/people/john-durham">John Durham</a></span>, will rightly point out that the document that spawned three years of political misery fails to articulate a single justifiable reason for starting the “<a href="https://www.hsgac.senate.gov/imo/media/doc/abbreviated%20timeline%20horowitz.pdf" target="_blank">Crossfire Hurricane</a>” investigation. </p>
<p>Those of us who have speculated there was insufficient cause for beginning the investigation could not have imagined the actual opening document was this feeble. It is as if it were written by someone who had no experience as an FBI agent.</p>
<p>Keep in mind the FBI cannot begin to investigate anyone, especially a U.S. citizen or entity, without first creating a document that lists the reasonably suspicious factors that would legally justify the investigation. That’s FBI 101, taught Day 1 at the FBI Academy at Quantico, Va.</p>
<p>To the untrained eye, the FBI document that launched Crossfire Hurricane can be confusing, and it may be difficult to discern how it might be inadequate. To the trained eye, however, it is a train wreck. There are a number of reasons why it is so bad. Two main ones are offered below (if you would like to follow along, the <a href="https://www.judicialwatch.org/documents/jw-v-doj-reply-02743/" target="_blank">document is here</a>):</p>
<p>First, the document is oddly constructed. In a normal, legitimate FBI Electronic Communication, or EC, there would be a “To” and a “From” line. The Crossfire Hurricane EC has only a “From” line; it is from a part of the FBI’s Counterintelligence Division whose contact is listed as <a href="https://en.wikipedia.org/wiki/Peter_Strzok" target="_blank">Peter Strzok</a>. The EC was drafted also by <a class="rollover-people-link" href="https://thehill.com/person/peter-strzok">Peter Strzok</a>. And, finally, it was approved by Peter Strzok. Essentially, it is a document created by Peter Strzok, approved by Peter Strzok, and sent from Peter Strzok to Peter Strzok.</p>
<p>On that basis alone, the document is an absurdity, violative of all FBI protocols and, therefore, invalid on its face. An agent cannot approve his or her own case; that would make a mockery of the oversight designed to protect Americans. Yet, for this document, Peter Strzok was pitcher, catcher, batter and umpire.</p>
<p>In addition, several names are listed in a “cc” or copy line; all are redacted, save Strzok’s, who, for some reason, felt it necessary to copy himself on a document he sent from himself to himself. </p>

<p>In her now fully declassified January 20, 2017 email to herself, former national security advisor Susan Rice three times claimed everything about incoming Gen. Michael Flynn was done <a href="https://www.washingtonexaminer.com/news/fully-declassified-susan-rice-email-reveals-reluctance-to-share-sensitive-russia-information-with-michael-flynn">“by the book.</a>” In the January 5, 2017 meeting, Rice wrote, “President Obama asked if Comey was saying that the NSC should not pass sensitive information related to Russia to Flynn. Comey replied ‘potentially.’ He added that he has no indication that Flynn has passed classified information to Kislyak, but he noted that ‘the level of communication is unusual.”</p>
<p>On March 22, 2017, Judy Woodruff of PBS asked Susan Rice about President Trump’s claim that that the Obama administration had surveilled his campaign in 2016. “<a href="https://www.pbs.org/newshour/nation/susan-rice-trumps-wiretapping-claim-nothing-sort-occurred">Nothing of the sort occurred</a>,” said Rice.</p>
<p>On April 4, 2017, Woodruff confronted Rice with revelations from House intelligence committee chairman Devin Nunes. As the California Republican charged, during the final days of the Obama administration, the president-elect and the people around him may have been caught up in surveillance of foreign individuals and their identities may have been disclosed. Woodruff wondered, “Do you know anything about this?”</p>
<p>“<a href="https://www.youtube.com/watch?v=5f3ScOY5FJY">I know nothing about this</a>,” answered Rice, who knew everything about it, and this was not her first duty on the falsehood front. Back in 2014, Rice said deserter Bowe Bergdahl had served the United States with <a href="https://www.cnn.com/2014/06/06/politics/rice-cnn-interview/index.html">“honor and distinction</a>.” That whopper came two years after Rice’s major starring role.</p>
<p>On September, 11, 2012, Islamic terrorist attacked the U.S. diplomatic compound in Benghazi, Libya, killing ambassador Chris Stevens, information officer Sean Smith and CIA operatives Glen Doherty and Tyrone Woods, both former Navy SEALs. On multiple television news shows, Susan Rice blamed the attack on a spontaneous protest over a video, which she knew was false.</p>
<p>Two years later, as she praised Bergdahl, Rice claimed that “parts” of the Benghazi story turned out wrong and, “that doesn’t make me a liar. That makes me a public servant trying to say what we knew at the time.” That does make her a liar, and Susan Rice is only one of the women the president sent to do his dirty work.</p>
<p>UN Ambassador Samantha Power defended the administration’s decision to intervene in Libya. As <a href="https://www.cnn.com/2016/05/19/politics/axe-files-samantha-power/index.html">she told David Axelrod in 2016</a>, “the aftermath has proven very challenging,” and the country was “anti-foreigner.” No mention of the Americans Susan Rice claimed had been killed over a video protest. In similar style, State Department mouthpiece Marie Harf did not associate terrorism with militant Islamic jihadists. Three years after Benghazi, as the Islamic State tortured and slaughtered, Harf blamed terrorism on a “<a href="https://www.politico.com/story/2015/02/isil-fight-state-department-115251">lack of opportunity for jobs</a>.”</p>
<p>On the home front, Lois Lerner deployed the IRS against conservatives groups who favored limited government and lower taxes. The predatory Lerner wound up taking the Fifth multiple times and was conveniently allowed to retire. In 2018, Lerner’s boss claimed his administration “<a href="https://thehill.com/blogs/blog-briefing-room/news/389188-obama-jokingly-brags-i-didnt-have-scandals-during-my-presidency">didn’t have scandals</a>,” and recent revelations have prompted no second thoughts.</p>
<p>The president held the Oval Office meeting on January 5, 2017, the same day his chief of staff Denis McDonough made a request to unmask Gen. Michael Flynn, president-elect Trump’s incoming national security advisor. On January 11, Samantha Power made her seventh request to unmask Gen. Flynn, and the six others included two requests on December 14, 2016. Other requests came from treasury officials and ambassador to Italy John Phillips, but the president wasn’t going to leave the vice president out of the loop.</p>
<p>On January 12, 2017, a request to unmask Flynn came from Joe Biden his own self. Eight days later, outgoing national security advisor emailed herself that the outgoing president wanted it all done “by the book.” In March, 2017, Rice denied that Trump had been the subject of wiretapping and <a href="https://www.washingtonpost.com/opinions/susan-rice-when-the-white-house-twists-the-truth-we-are-all-less-safe/2017/03/21/f7cdef86-0e45-11e7-9d5a-a83e627dc120_story.html?utm_term=.cc2add3a71e8">in the Washington Post</a> charged that such “false statements” were part of a “disturbing pattern of behavior that poses real and potentially profound dangers to U.S. national security.”</p>
<p>Asked about the Obama administration surveillance of political rivals, Rice said, “I know nothing about this.” As the full truth begins to emerge, interested parties might dial back to May, 2017.</p>

<p>In an unexpected turn of events defense lawyer for former national security advisor Lt. Gen. <a href="https://saraacarter.com/army-lt-gen-michael-flynn-vindicated-u-s-attorney-files-motion-to-dismiss-case-against-three-star-general/" target="_blank">Michael Flynn</a> has filed a writ of mandamus with the United States Court of Appeals with the District of Columbia to dismiss the case against Flynn, vacate the order appointing an amicus curiae and reassign the case to another judge. The petition comes after Judge Emmet Sullivan, who oversees Flynn’s case, failed to grant the government’s motion to dismiss based on what his defense believes is a political prejudice against Flynn.</p>
<p>Sidney Powell filed the 31 page writ of mandamus on Tuesday afternoon with the court, arguing in the petition that Judge Emmet Sullivan, who has been overseeing the case has wagered a political agenda against her client.</p>

<p>FBI Agents Peter Strzok and Joe Pientka interviewed National Security Advisor Michael Flynn on January 24, 2017. According to documents presented in the court case, agent Peter Strzok did the questioning and agent Joe Pientka took most of the notes.</p>
<p>Following the interview agent Pientka then took his hand-written notes and generated an official FD-302; an FBI report of the interview itself. There has been a great deal of debate over the first draft, the original FD-302 as it was written by Joe Pientka. In the case against Flynn the DOJ prosecutors never presented the original Pientka 302.</p>
<p>On May 2, 2020, the DOJ, using new information gathered by U.S. Attorney Jeff Jensen, declassified and released a segment of James Comey testimony that was previously hidden. Within <a href="https://t.co/s8M7D0yvjA?amp=1" target="_blank">the transcript</a> Comey says Pientka wrote the Flynn 302 on<strong> January 24th</strong> immediately following the interview. <p>People defending the FBI have even said it never existed. However, the testimony of FBI Director James Comey proves the 302 was drafted on <strong>January 24th</strong>.</p>
<p>Additionally, recent evidence from <a href="https://t.co/3Q0CcWAleH?amp=1" target="_blank">Brady material turned over to the defense</a> by auditing attorney Jeff Jensen showed FBI lawyer Lisa Page and FBI Agent Peter Strzok rewriting, editing and shaping the 302 on February 10, 2017, more than two weeks later:</p>

<p style="padding-left:40px;">Peter Strzok replies back to Lisa Page that he was “trying to completely re-write the thing so as to save Joe’s voice”, because Joe Pientka was the actual author.</p>
<p style="padding-left:40px;">Peter Strzok is re-writing the interview notes of Pientka in order to construct the framework to accuse Flynn of lying. Lisa Page is editing the re-write to make it more cogent and readable.</p>
<p>The question has remained: Where is the original 302 report as written by Pientka?</p>
<p>While the question(s) around the missing original 302 have yet to be reconciled, one possible path to discover its location and a copy of its original content lies in the testimony of Sally Yates. Former DAG Sally Yates <a href="https://www.youtube.com/watch?v=YtIQdneqlq4" target="_blank">testified to congress</a> that after the Flynn interview DOJ-National Security Division:</p>

<p>“The DOJ-National Security Division received a detailed readout from the FBI agents who had interviewed Flynn.” <a href="https://youtu.be/YtIQdneqlq4?t=3485" target="_blank">Yates said</a> she felt “it was important to get this information to the White House as quickly as possible.”</p>

<p>Yates is describing the Pientka 302. The Pientka 302 could have been received at the DOJ-NSD later in the evening of January 24th, or perhaps the morning of the 25th. Either is possible because Yates was having meetings about the topic.</p>

<p>Instead, how about “I spy [on the next Republican to run for] the President of the United States of America” or simply the identifier, “I, spy”?</p>
<p>In a Watergate-level scandal largely ignored by the media, <a href="https://www.westernjournal.com/nunes-criminal-referrals-mueller-collaborators-coming/?ff_source=Email&ff_medium=PUBreaking&ff_campaign=wj-breaking&ff_content=libertyalliance" target="_blank">evidence</a> continues to mount that the Obama administration was not only spying on President Donald Trump’s campaign but was also fostering a resistance within the <a href="https://www.westernjournal.com/deep-state-didnt-start-donald-trump/?ff_source=Email&ff_medium=PUBreaking&ff_campaign=wj-breaking&ff_content=libertyalliance" target="_blank">deep state</a> before he was even elected.</p>
<p>The most egregious and obvious example has been the case against Michael Flynn, Trump’s former national security advisor who pleaded guilty to making false statements to the FBI after getting caught up in the investigation of potential collusion between the <a href="https://www.westernjournal.com/clock-ticking-schiff-intelligence-chief-says-russia-collusion-transcripts-ready-release/?ff_source=Email&ff_medium=PUBreaking&ff_campaign=wj-breaking&ff_content=libertyalliance" target="_blank">Trump campaign and Russia</a>.</p>
<p>The case against Flynn has since imploded as newly declassified documents <a href="https://www.westernjournal.com/bidens-name-list-flynns-case-makes-gma-interview-look-even-worse/?ff_source=Email&ff_medium=PUBreaking&ff_campaign=wj-breaking&ff_content=libertyalliance" target="_blank">revealed</a> that then-Vice President Joe Biden and other high-ranking officials requested the “unmasking” of his identity after routine intelligence surveillance picked up a call between Flynn and then-Russian Ambassador Sergey Kislyak, <a href="https://www.foxnews.com/politics/grenell-releases-list-of-officials-who-sought-to-unmask-flynn-biden-comey-obama-intel-chiefs-among-them" target="_blank">Fox News</a> reported.</p>
<p>Other names on that request include a who’s who in the Obama administration, such as then-Chief of Staff Denis McDonough, former FBI Director James Comey — who reportedly <a href="https://www.westernjournal.com/reporter-calls-meeting-obama-comey-hatching-plot-trump/?ff_source=Email&ff_medium=PUBreaking&ff_campaign=wj-breaking&ff_content=libertyalliance" target="_blank">concocted</a> the Russia collusion investigation in a meeting with Obama — and James Clapper, Obama’s former director of national intelligence.</p>

<p>Obama has a history of making enemies lists.</p>
<p>I speak from personal experience because I am on his enemies list from the 2008 campaign. As a result, I was harassed and threatened. I even published a book in 2012, titled “<a href="https://www.amazon.com/Obamas-Enemies-List-Intimidated-Election-ebook/dp/B00B7RUAUA/ref=sr_1_2?crid=1U8DT8EOXC8OC&dchild=1&keywords=obamas+enemies+list&qid=1589486287&sprefix=obama%27s+enemies+list%2Caps%2C210&sr=8-2" target="_blank">Obama’s Enemies List</a>.” Apparently, Gen. <a href="https://www.westernjournal.com/ex-fed-prosecutor-unhinged-flynn-judge-invites-anti-trump-group-therapy-sesson/?ff_source=Email&ff_medium=conservativevideos&ff_campaign=dailypm&ff_content=libertyalliance" target="_blank">Michael Flynn</a> is on Obama’s enemies list, too.</p>

<p>Back in July 2008, Obama called me out by name, identifying me as an enemy, and sent a signal to his supporters to actively harass me. Sen. Obama said at the time, “[T]here was an ad, one in South Dakota by Floyd Brown, I don’t think that I am off the wall here to say that, you know, a lot of outside groups that are potentially going to be going after us hard.”</p>
<p>With these comments, <a href="https://www.westernjournal.com/names-obama-officials-involved-michael-flynn-situation-declassified/?ff_source=Email&ff_medium=conservativevideos&ff_campaign=dailypm&ff_content=libertyalliance" target="_blank">Obama</a> was able to incite his supporters to launch all kinds of personal attacks against me. As if on cue, I was flooded with an onslaught of nasty, hate-filled, vulgar and obscene anonymous phone calls and emails from Obama supporters. Some included death threats.</p>
<p>My bio and personal information soon appeared on a specialized enemies list on his campaign website. The Obama team called the page “Fight the Smears.” I received even more calls and the cyberattacks on me and my website increased. A Wikipedia page that referenced me was overwhelmed with scurrilous lies.</p>
<p>Obama’s use of Nazi and mob intimidation tactics had a clear objective: to shut up any early opponents.</p>
<p>Flynn got in Obama’s crosshairs for two reasons, and shot to the top of Obama’s enemies list: First, in 2014 Flynn told an “uncomfortable truth,” one the Obama administration didn’t want Americans to hear.</p>
<p>Flynn dared to oppose Obama’s false narrative — about <a href="https://www.westernjournal.com/4-men-arrested-allegedly-plotting-isis-attack-us-military-facilities/?ff_source=Email&ff_medium=conservativevideos&ff_campaign=dailypm&ff_content=libertyalliance" target="_blank">ISIS</a> as a “JV team” — when in reality Islamic extremist groups around the world were growing in number and strength, posing an increasingly dangerous risk, as we saw born out when later, radical Islamist terrorist group attacks escalated.</p>
<p>Not only did he oppose Obama when testifying to a congressional committee in 2014 (and was subsequently fired), Flynn even went as far as writing a book about Obama’s negligence published in 2016 — and then he had the audacity to campaign for Donald Trump.</p>
<p>So, taking down Flynn was like a twofer for Obama. He was also aiming for someone even higher on his list — President Trump.</p>
<p>Which explains the Jan. 5, 2017, meeting with Obama and former FBI Director James <a href="https://www.westernjournal.com/reporter-calls-meeting-obama-comey-hatching-plot-trump/?ff_source=Email&ff_medium=conservativevideos&ff_campaign=dailypm&ff_content=libertyalliance" target="_blank">Comey</a> to cover up spying on the Trump campaign by plotting to entrap Gen. Flynn, thus derailing Trump’s presidency before it even had a chance to begin.</p>

She also stepped up to defend presumptive Democratic nominee Joe Biden, whose name appeared on the list most recently.</p>
<p>CBS tucked the latest Flynn case revelation into a one-minute brief following a coronavirus report very critical of President Trump. “Well, Margaret, unmasking is when a senior government official requests to know the identity of the U.S. citizen in an intelligence report. <strong>It's something that happens thousands of times a year</strong>,” Reid declared to downplay the significance of what was exposed.</p>
<p>Reid eased into acknowledging that Biden’s name was among those who requested to unmask Flynn, and insinuated that those outraged by it were just toeing the Trump administration line.</p>

<p>The action by D.C. District Court Judge Emmet Sullivan, who was appointed by former President George W. Bush, effectively puts the government’s effort to <a href="https://www.westernjournal.com/fiery-dan-bongino-flynn-case-obama-knew/" target="_blank">drop the charges</a> on hold.</p>
<p>Sullivan said he will, “at the appropriate time,” develop a schedule for arguments against the Justice Department’s plan to drop the case, according to <a href="https://www.washingtonpost.com/local/legal-issues/us-judge-puts-on-hold-justice-dept-move-to-dismiss-michael-flynns-guilty-plea-to-hear-outside-groups-challenges/2020/05/12/2fb4e356-949d-11ea-82b4-c8db161ff6e5_story.html" target="_blank">The Washington Post</a>.</p>
<p>Flynn’s defense objected to the stall.</p>
<p>“No rule allows this filing,” attorney <a href="https://www.westernjournal.com/attorney-president-obama-involved-plot-set-flynn/" target="_blank">Sidney Powell</a> wrote in her own court filing, noting that Sullivan would not accept outside groups’ comments in the past.</p>

<p>U.S. Attorney for Connecticut John Durham is going “full throttle” with his review into the origins of the investigation into suspected Russia-Trump coordination in the 2016 election, with additional top prosecutors involved in looking at different components of the original probe, sources told Fox News.</p>
<p>Two sources told Fox News that Jeff Jensen, the U.S. attorney for the Eastern District of Missouri who was tapped by the Justice Department in February to review the case of former National Security Adviser Michael Flynn, is continuing to help with Durham’s investigation even after the DOJ’s move last week to drop the case against Flynn.</p>
<p>The sources told Fox News that interim U.S. Attorney for the District of Columbia Timothy Shea is also assisting with components of the investigation.</p>
<p>“They farmed the investigation out because it is too much for Durham and he didn’t want to be distracted,” one of the sources told Fox News.</p>
<p>“He’s going full throttle, and they’re looking at everything,” the source told Fox News.</p>
<p>The Justice Department declined to comment on Jensen and Shea’s involvement.</p>
<p>Any indication that Durham could be building a case against anyone involved in the original Russia probe, however, is sure to inflame tensions between the Trump administration and congressional Democrats -- who already are ramping up accusations that these Justice Department reviews have become politicized. They slammed Attorney General Bill Barr for the DOJ’s decision Thursday to drop the Flynn case.</p>
<p>House Judiciary Committee Chairman Jerrold Nadler, D-N.Y., who was a key figure during Trump's impeachment proceedings, called the decision “outrageous."</p>

<p>That's when President Donald J. Trump <a href="https://twitter.com/realDonaldTrump/status/1259561821289226248">tweeted</a> the one word, all-caps, one exclamation mark, that changes everything. A day earlier, the president had also tweeted <a href="https://twitter.com/realDonaldTrump/status/1259328864859422723?s=20">Jesse Watters' video</a>, titled ‘Obamagate’ – the scandal at the epicenter of American politics that has had many names: “Russiagate”, the “Russia Hoax”, “Spygate”, but it’s only fitting that it should end with its true name.</p>
<p>This was never about the Russians and the spies were cogs in a machine who were following orders.</p>
<p>One man, not some nebulous organization or unaccountable bureaucracy, pushed the lever and decided to use the machinery of law enforcement and intelligence agencies to suppress the political opposition.</p>
<p>Another Democrat in a White House long ago once put up a sign on his desk that said, "the buck stops here." Or, as Lisa Page, formerly of the FBI, texted much more recently, “potus wants to know everything we’re doing." The POTUS in question wasn’t Truman anymore: it was Barack Obama. And the gang that couldn’t frame straight was prepping FBI ex-boss Comey to brief Obama on the plot.</p>
<p>In an address to the real deep state, the 3,000 members of the Obama Alumni Association, the titular head of the government in exile that has been working its manicured fingernails off to subvert, undermine, and betray the actual President of the United States lectured on the rule of law.</p>
<p>"There is no precedent that anybody can find for someone who has been charged with perjury just getting off scot-free. That’s the kind of stuff where you begin to get worried that basic — not just institutional norms — but our basic understanding of rule of law is at risk," Barry scolded.</p>
<p>General Flynn wasn’t charged with perjury. Maybe Page and Strzok should have spent more time helping Comey brief the C student in the Oval Office and less time carrying on. But it’s Obama who might want to spend time reviewing the penalties for perjury or making false statements to the FBI.</p>

<p>Sen. Chuck Grassley (R-Iowa), a senior member of the Judiciary Committee, said on Wednesday, "It's outrageous" the way Gen. Michael Flynn was treated by the FBI. </p>
<p>Grassley spoke on the day the Justice Department dropped the criminal case against Flynn, who was President Trump's first National Security Adviser.</p>
<p>Flynn pled guilty to lying to the FBI about his contacts with the Russian ambassador, but recently disclosed evidence shows the FBI went to Flynn's office four days after Trump's inauguration, hoping to trap Flynn in a lie. This happened after the FBI said it was prepared to close its counterintelligence case against Flynn because it had found no wrongdoing.</p>
<p>"First of all, he was entrapped," Grassley told Fox News's Brett Baier Thursday evening. "Entrapment is unconstitutional. It's a violation of your due process.</p>
<p>"Secondly, this thing would not be exposed if it hadn't been for (Attorney General William) Barr taking the bull by the horns and knowing something was wrong and going in and knowing where things were wrong, how to straighten it out.</p>
<p>"We haven't heard the end of Bill Barr's good work, because everything that's going on with the Durham investigation is another example of still other shoes to drop."</p>
<p>Baier asked Grassley if he thinks there are more "shoes to drop...that will shock Americans?"</p>
<p>"Not in regard to Flynn's part of it," Grassley said, "but in regard to Russiagate and in regard to FBI influence and malpractice and also in regard to a lot of FISA things, yes, I think there's more shoes to drop and I think there will be prosecutions."</p>
<p>The Justice Department's request to drop Flynn's case must be approved by a federal court in Washington.</p>

<p>When the Department of Justice (DOJ) finally dropped the case against General Michael Flynn, a former national security adviser for President Donald Trump, House Democrats slammed the decision as a partisan attempt to “cover up” for Trump — presumably on Russia. While Flynn’s attorney, Sidney Powell, presented evidence suggesting Flynn was “set up by corrupt agents” who threatened his son in order to pressure him into pleading guilty, Democrats insisted that the DOJ’s decision to drop the case will “incriminate Bill Barr.”</p>

<p>U.S. District Court Judge Emmet G. Sullivan, the presiding judge in the government’s case against Gen. Michael Flynn, issued a standing order in February 2018 which lead prosecutor Brandon Van Grack was obligated to comply with. (It can be viewed <a href="https://www.courtlistener.com/recap/gov.uscourts.dcd.191592/gov.uscourts.dcd.191592.20.0.pdf">here.)</a> I am not a lawyer, but it seems to me such an order would be standard in any legal proceeding. The document states that, pursuant to Brady v. Maryland (and its progeny), the government has a <a href="https://www.courtlistener.com/recap/gov.uscourts.dcd.191592/gov.uscourts.dcd.191592.20.0.pdf">continuing obligation to produce</a>:</p>

<p>In repeated filings, Van Grack has maintained that he’s fulfilled his obligations. In an October 2019 filing, in response to Flynn attorney Sidney Powell’s request for Brady materials, he stated that the government “has complied, and will continue to comply, with its discovery and disclosure obligations, including those imposed pursuant to Brady and the Court’s Standing Order.” He denied that they had “affirmatively suppressed evidence.”</p>
<p>The government had not concealed Brady material, he wrote, nor was the government “aware of any information that would be favorable and material to [Flynn] at sentencing.”</p>
<p>Except that they had and they were.</p>
<p>Powell’s motion stated that “General Flynn was targeted and taken out of the Trump administration for concocted and political purposes.” He said this was a conspiracy theory.</p>
<p>Funny, Van Grack’s claims don’t quite square with the neutron bomb that was dropped last Wednesday night.</p>
<p>How would Van Grack characterize the FBI’s January 4, 2017 Closing Communication “which <a href="https://www.foxnews.com/politics/flynn-evidence-calls-into-question-statements-by-former-special-counsel-brandon-van-grack">recommended the FBI close</a> its investigation of Flynn, as its exhaustive search through government databases “did not yield any information on which to predicate further investigative efforts?”</p>
<p>How about FBI agent Peter Strzok’s instructions not to close the case yet because Flynn might have violated the 1799 Logan Act? Flynn was the incoming National Security Advisor for goodness sake. He had every right to speak to then-Russian ambassador Sergey Kislyak.</p>
<p>Notes taken by Bill Priestap, the assistant director of the FBI Counterintelligence Division, in a meeting with other top agency officials discussing ways to set up a perjury trap for Gen. Flynn? Notes which said, their “goal” was “to get him to lie, so we can prosecute him or get him fired.” Not Brady material either?</p>
<p>Nope.</p>
<p>Van Grack stated that “Flynn’s alleged false statements as critical to the FBI’s legitimate and significant investigation into whether individuals associated with the campaign of then-candidate Donald J. Trump were coordinating with the Russian government in its activities to interfere with the 2016 presidential election.” Additionally, he wrote that “Flynn’s conduct and communications with Russia went to the heart of that inquiry” and that his alleged “false statements to the FBI on January 24, 2017, were absolutely material.”</p>
<p>On Monday, Reps. Jim Jordan (R-OH) and Mike Johnson (R-LA), gobsmacked as we all were after the Flynn documents were unsealed last week sent a letter to FBI Director Christopher Wray. They have requested all documents related to the Flynn case and would like an “in-person” interview with FBI agent Joe Pientka, who interviewed Flynn with Strzok on January 24, 2017. Jordan and Johnson wrote, “Any criminal investigation grounded in Logan Act questions is an obvious political pretext to attack the Trump Administration.”</p>
<p><em>Fox News</em> <a href="https://www.foxnews.com/politics/flynn-evidence-calls-into-question-statements-by-former-special-counsel-brandon-van-grack">reports</a> that after they contacted the FBI about Pientka’s extensive role in Crossfire Hurricane and FISA matters, Pientka was conspicuously removed from the FBI’s website. Sources have told <em>Fox</em> that Pientka remains in a senior role at the agency’s San Francisco field office.</p>
<p>The question is how material were Flynn’s statements to Strzok and Pientka? Powell tweeted over the weekend that “No lawyer for @GenFlynn has heard the recording or seen the transcript [of Flynn’s intercepted calls with the ambassador]. I bet $1000 there is no mention of ‘sanctions.'”</p>
<p>It is astonishing that the FBI has not provided Flynn’s legal team with a transcript or a recording of his calls with Kislyak.</p>
<p>The other huge revelation came days before the unsealing of new documents last Wednesday. On April 24, Timothy Shea, who now handles the Flynn case for the DOJ, sent Powell many documents, which prompted her to immediately file a supplement to Flynn’s January 29 motion to dismiss the case. One document included evidence in the form of emails that Van Grack had made a side deal with Flynn’s attorneys at the time from Covington & Burling. (Flynn replaced them with Powell in late 2018.)</p>
<p>Powell’s supplement states she has “found further evidence of misconduct by Mr. Van Grack specifically. Not only did he make baseless threats to indict Michael G. Flynn [Flynn’s son], he made a side deal not to prosecute Michael G. Flynn as a material term of the plea agreement, but he required that it be kept secret between himself and the Covington attorneys [Flynn’s first legal team] expressly to avoid the requirement of disclosure in future cases.” (This document can be viewed <a href="https://www.scribd.com/document/458160278/US-v-Flynn">here</a>.)</p>
<p><a href="https://www.nationalreview.com/news/new-michael-flynn-filing-says-head-prosecutor-on-case-made-secret-deal-with-flynns-former-lawyers-to-get-guilty-plea-deal/">According to</a> the National Review, the “heavily-redacted emails show Flynn’s former lawyers discussing why the deal needed to be “kept secret,” implying that Flynn would be used to testify in further criminal cases. “The government took pains not to give a promise to MTF regarding Michael Jr., so as to limit how much of a ‘benefit’ it would have to disclose as part of its Giglio disclosures to any defendant against whom MTF may one day testify,” one email states. Giglio v. United States says the failure to disclose immunity deals to co-conspirators constitutes a violation of due process rights.”</p>

<p>DiGenova told Carr there is now a mole inside the FBI “who is leaking to the press about the current conduct of FBI Director Christopher Wray and his general counsel, Dana Boente.</p>

That is the beginning of a very ugly story.”</p>
<p>They discussed the nature of the documents which had been turned over to Sidney Powell last Friday, which we heard about last night. But diGenova said something I had not heard before. He said that Jeff Sessions was talked into recusing himself from the Trump/Russia collusion case by Dana Boente who was then-Acting Deputy Attorney General.</p>

<p>“No derogatory information was identified in FBI holdings,” the memo stated.</p>
<p>According to the FBI document, the federal law enforcement agency also asked a redacted agency, likely the Central Intelligence Agency (CIA), to conduct a similar search of its own records for derogatory information against Flynn, who at the the time was the incoming National Security Adviser for then-President-elect Donald Trump.</p>
