The Supreme Court might uphold Mississippi’s abortion law, and the pro-abortion left is all in a tizzy over it. In fact, some have suggested that if the government does not make it easier for babies to be killed, a revolution might ensue. But if the highest court in the land does allow this law to stand, how might the decision impact the upcoming midterm elections?

The New York Times reported:

The Supreme Court seemed poised on Wednesday to uphold a Mississippi law that bans abortions after 15 weeks of pregnancy, in what would be a momentous and polarizing decision to roll back the abortion rights the court has defined over the last half century.

The author echoed arguments made by Supreme Court justices who favor the legality of abortion, noting that “[m]oving that line to 15 weeks would discard decades of precedent,” and that “several of the conservative justices appeared ready to go further and overrule Roe entirely, letting states decide whether and when to ban abortions.”

Justice Brett Kavanaugh indicated he might support upholding the Mississippi law when he asked an attorney representing Mississippi:

“In other words, that the Constitution is neither pro-life nor pro-choice on the question of abortion but leaves the issue for the people of the states or perhaps Congress to resolve in the democratic process?”

Justice Sonia Sotomayor argued that upholding it would constitute an existential threat to the validity of the Supreme Court. “Will this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?” she asked.

With no sense of irony, she also asked how the court would survive if people believe it has become politicized.

At this point, it seems probable that the court will allow Mississippi’s law to remain intact, although a complete repudiation of Roe v. Wade still seems less likely. But even so, if the court rules for the law, it could have tremendous ramifications on the upcoming midterm elections. Indeed, it appears Democrats already recognize that if the law remains, it will give them a line of attack against Republicans during the campaign.

CNN reported:

Democrats now are banking on a backlash fueled in large part by voters who back abortion rights, or are at least passively support a right to choose, but had not considered it a top issue in recent years due to the protections granted by Roe v. Wade.

Jazmin Vargas, spokeswoman for the Democratic Senatorial Campaign Committee told the activist media outlet, “[w]e must defend a Democratic Senate majority with a power to confirm or reject Supreme Court Justices.”

  • I believe most Americans feel as I do about abortion, it is MURDER!!!!!  If the devildemocrats pin their hopes on the Mississippi case being upheld they better get their cheat on right now because they will need it more than in 2020!!!!!

  • Sonia, Roe v. Wade was ALREADY 'just a political act'.  And a wrong precedent is a wrong, regardless of how long it has been on the books. The bottom line: Roe v. Wade was an exercise in politics, not law. This is a federal constitutional republic, pure and simple. The federal govt. is one of LIMITED and DELEGATED powers - "few and defined," in the rather authoritative words of the man fairly known as the Father of the Constitution, James Madison. Such an issue as this is not one of those enumerated powers. And while we are on the subject of the rule of law vs. arbitrary law - aka tyranny - I will point out that once we return to the former, neither Sotomayor nor Kagan will be sitting on that august bench anyway.

    This is because they were appointed by an illegal occupant of the Oval Office. BHO was never eligible for that office because he doesn't meet one of the eligibility requirements FOR the office - that is, needing to be a 'natural born' citizen. What is a nbc? It is a person "born in the country, of parents who are citizens" thereof. (The definition is from the definitive tome of the day of the constitutional Framers on such nation-building matters, E. de Vattel's 'The Law of Nations'. And that eligibility requirement for that particular federal office - and as amended later, logically, for that of the VP as well, since that person might accede to the higher job - STILL STANDS, absent a constitutional amendment to the contrary.) BHO's birth father - at least as far as he has sworn; another subject - was never, nor did he ever apply to be, a U.S. citizen. Thus, all of the legislation that BHO signed into law, and all of the E.O.'s that he issued, and all of the appointments that he made - including to the SCOTUS, and inferior courts - need to go with him. Into the trash bin. For it to be as though he was never in that office. For, he never occupied it legally. (And if BHO Sr. was not in fact his birth father, as some allege, he is still guilty of fraud and perjury.)

    Sharp-eyed commenters will note that this 'little matter' applies as well to K Harris (NEITHER of whose parents were U.S. citizens at the time of her birth). Thus, a major day of reckoning looms for the nation. As we learn some fundamental facts the hard way. One of which is that if you are going to live by the rule of law, you can't go to sleep on the job.

Today they are killed, burned and sacrificed to the sexual Gods, used for medical experiments and science. Jesus will put an end to all this evil soon.

  • I think the left is miscalculating again.  I believe, and I hope I am correct, that most people are against government supported abortions.

  • Feminazism went bankrupt when islamic culture with its' secular/religious brutalizing of islamic women was presented by the MSM during the Obama years, and the silence from the radicals was deafening. No pussy hat protests for women stoned to death for being accused of adultery or adolescent girls clitorially castrated; uh-uh!

    Abortion as a special rights carve-out was their poster cause (and the only specialized one that gained judicial staying power). Stare desisis will not prevail, due to the now understood and reviled assault upon individuality. IMHO

  • By voting on the issue, it isn't doing away with abortion rights, it just puts it into the hands of the state where it belongs. The federal government has no business being in the abortion business and I am sick of having to pay for it.
