Democrats campaigned last fall on making the District of Columbia a state. Unfortunately for Democrats, the U.S. Constitution stands in the way. 

 

Some Democrats would like to have you believe that the case for D.C. Statehood is akin to Puerto Rican statehood, but it’s not. When it comes to D.C. statehood, it’s clear that this nothing more than an attempt to pack the Senate and House with an army of far-left-wing Democrats.

The case against D.C. statehood on the constitutional merits is an open-and-shut case: You can’t do it. It may be possible to annex parts of D.C. to Virginia and Maryland, but granting statehood to the city of D.C. would not pass constitutional muster. In Article I, Section 8 powers, the “enumerated powers” of the federal government, make D.C. the seat of the federal government. On the list is the power to “exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square)” and “become the Seat of the Government of the United States.” This is called the “Enclave Clause,” because it is the provision that sets down D.C. as the enclave, or home, for the federal government.

Our Founding Founders saw the District as one being run by the federal government and independent of any state’s authority. As quoted in The Heritage Foundation Guide to the Constitution, James Madison in Federalist 43, explained that “the indispensable necessity of complete authority at the seat of government carries its own evidence with it.” In other words, if the federal government became dependent on a state, that could lead to “proceedings interrupted with impunity.” He also worried that a state housing the federal government would have more influence than other states creating an imbalance of power. It would be virtually impossible to carve out parts of the city of D.C. and leave a small portion to the federal government in a way that would pass constitutional scrutiny.

  • It will take an AMENDMENT to the US Constitution to admit DC as a State.... this must not happen.  In fact, the Federal Territories....

  • Does it matter that it is unconstitutional?  Our Supreme court has been compromised - most likely bought and paid for - except for two justices.  

    • You are right Edie, the Supreme Cowardice Court of America.  The keepers of the Constution and the last arbitor of the Laws of the United States of the United States of America, HAVE been betraed  by 7 of the Supreme TRAITORS!  Their oath meant NOTHING!

       

  • The Nazi Democrats are shredding the constitution. Republicans do the same thing only not as agressive. The biggest unconstitutional power grab in the history of this country was the passage of the Federal Reserve act of 1913. Congress is obligated by the constitution to coin our money and set bthe value of silver and gold which is the only legal tender allowed by the constitution. Congress has no authority to delegate their powers to a pivate entity. The federal reserve is not federal and it has no reserves. the ferderal reserve is a private bank, I will shorten this a little. The congress needs money, they call the fed and have them call the mint and order, lets say a million federal reserve notes. that so called money is printed up out of thin air. It is then loaned to the government with interest. A pretty good scam. Making "money" out of paper, out of thin air and then attaching interest to it. The fed creates boom and bust cycles, they draw in over a trillin dollars in interest a year and pay no income tax. The fed pays no property taxes. We have beeb conned for over 100 years now and this country owes the fed over 22 trillion dollars. It is a debt that can never be repaid because the fed only prints up the principle, there is never any dollars printed up to cover the interst. It is a catch 22 and it is illegal. The Rockefeller family is one of the owners of the fed, the Rothschilds family, JPMorgan family, Wahrberg family, and a few more and they control the wealth of this nation. One more thing. They not only own the fed, but they also own ALL of the central banks in the world. 

    • You are correct!  The Federal Reserve Act is unconstitutional and I don't know any way to change that.  Any ideas anyone out there????

    • The only solution I have is to abolish the corrupt federal government and let the states do what they are supposed to do.

    • How do you do that and still meet the requirements of the Union for an effective agency serving common needs?
