  • The DOJ is so concerned about federal laws being broken because of an audit. They were not the least concerned about the federal laws that WERE broken during the election.

  • The Federal Government cannot tell a state not to conduct an audit.  It is impossible and out of the Federal Government's lane.

    • The feds can, indeed, tell States what to do.  But the second part of the question is do the states have to obey the feds?  Art. I, sec 4 of the Constitution gives primary responsibility for holding elections under rules passed by each State's Legislature.  The feds can intervene, but in my opinion, to take the primary responsibility away from the States will require a Constitutional Amendment.  Congress has made some variance in the rules by passing the Voting Rights Act; but the responsibility for elections in eacfh State is for the State's Legislatuire to make the rules, and arguably that includes audits to insure Legislative laws are followed..  /s/ Glenn Neal, Attorney at Law (Retired)
