nbcnews.com } ~ Stephen Breyer said Monday that the Supreme Court should take another look at whether the court's earlier rulings regarding enemy combatants at Guantanamo Bay allow "perpetual detention."... Breyer dissented when the court denied an appeal from a Gitmo detainee, Moath Hamza Ahmed al-Alwi, a man from Yemen captured by Pakistani forces and accused of being one of Osama bin Laden's bodyguards and of fighting against U.S. forces. He has challenged his open-ended detention, which has continued at Gitmo for 17 years. The U.S. has never filed charges against him. The U.S. military said he admitted fighting with the Taliban and staying at Qaeda safehouses. His lawyers said al-Alwi fled for safety to Pakistan and was seized by bounty hunters. In 2004, the Supreme Court ruled that Congress gave the president authority to detain enemy combatants for the duration of the relevant conflict. But, Breyer noted, the court's majority said its understanding of what Congress allowed might change if circumstances changed and detention had no prospect of ending. "It is past time to confront the difficult question left open" by that earlier ruling, Breyer said. "Al-Alwi faces the real prospect that he will spend the rest of his life in detention based on his status as an enemy combatant a generation ago, even though today's conflict may differ substantially from the one Congress anticipated."The court should address whether "Congress has authorized and the Constitution permits continued detention." The court rejected al-Alwi's appeal by an apparent vote of 7-1, with Breyer the sole dissenter. Justice Brett Kavanaugh did not participate, because the case came to the court from the Court of Appeals for the D.C. Circuit, on which he served.

In most professions, especially where lives are on the line, failure to do the job is not an option. This is particularly true where law enforcement and the military are concerned. Politicians, not unlike members of the military and law enforcement officers, take oaths of office where they swear affirm that they will enforce our laws and defend the Constitution. While law enforcement officers and members of the armed forces may face dire consequences for violating their oaths of office, politicians generally do not. Their oaths of office do not provide an “escape clause” whereby they may opt to ignore any of the laws that are not to their liking. Unlike the entries on the menu of a restaurant where the patrons order the food that they find palatable or where they may substitute one item on the menu for another, their oaths of office demand that those who take that oath agree to enforce all laws and honor and defend all of the provisions of our Constitution. Dereliction of duty is a serious offense for members of the armed forces and for law enforcement officers and one that carries significant consequences. On June 4, 2019 ABC News reported, Police arrest ex-deputy who 'did absolutely nothing to mitigate' Parkland school massacre. We will not delve in the specifics of this ongoing case, but it is important to note that the deputy sheriff in this case has been charged with multiple crimes, some of which are felonies, all emanating from his alleged failures to act to protect the children who were killed in that school. Contrast how that deputy is being prosecuted for alleged failures to act with the politicians who, with impunity, demand that law enforcement officers not act to cooperate with immigration law enforcement personnel - even when those actions result in the death of innocent victims...

Culture Beat:  Remember when the Internet was a great big free-speech zone, where almost any idea or belief could be freely and easily expressed? Well, leave it to the Left to mess it all up. Popular conservative political comedian Stephen Crowder recently had his YouTube channel demonetized — all because a leftist activist and “journalist” at Vox complained that Crowder’s comments about him, making fun of his homosexuality and ethnicity, amounted to bullying.

Initially, YouTube did nothing other than noting that Crowder’s comments did not violate its policies. The Vox journalist, however, being the leftist that he is, took to social media and called on the Rainbow Mafia to boycott YouTube. It wasn’t long before YouTube partially reversed course and demonetized Crowder’s channel, explaining, “Even if a creator’s content doesn’t violate our community guidelines, we will take a look at the broader context and impact, and if their behavior is egregious and harms the broader community, we may take actions” [emphasis added].

Hello, 1984.

Crowder represents just the latest victim in a growing number of mostly right-leaning personalities who have been punished or silenced by social-media giants for daring to express views the Left vindictively classifies as “hate speech.”

And YouTube is just getting started. Following its action against Crowder, YouTube announced that it was “taking another step in our hate speech policy by specifically prohibiting videos alleging that a group is superior in order to justify discrimination, segregation or exclusion based on qualities like age, gender, races, caste, religion, sexual orientation or veteran status.”

Not only will YouTube demonetize and censor creator content based upon its own subjective and ever-evolving definition of what encompasses “dangerous” hate speech, but it will “rank content based on quality.” As Sundar Pichai, CEO of YouTube’s parent company Google, explained, “We are bringing that same notion and approach to YouTube so that we can rank higher quality stuff better and really prevent borderline content.” In short, YouTube will promote mainstream media news and political commentary over nontraditional new media. And by doing so, it aims to limit the impact of disfavored alternative journalism.

These tech giants are acting the part of Big Brother, censoring political speech with which they disagree, and then running and hiding behind their “private company” moniker whenever they’re called out for it. Many conservatives point to the free market as the sole solution, but that response is arguably too idealistic and naive. Government’s aim should be to protect the right of Americans to access the “town square.” And if social-media giants do indeed represent the town square, then First Amendment concerns are valid.

Update: After the huge uproar over this issue, YouTube finally apologized Wednesday … to the “LBGT” community. YouTube CEO Susan Wojcicki lamented not taking more definitive action against Crowder, saying, “I know that the decisions we made was very hurtful to the LGBTQ community and that wasn’t our intention at all.”  ~The Patriot Post
