According to diGenova, there was none, a violation of the  requirements for the action by Rosenstein. DiGenova points out that “in April of 2017, the FISA Court itself, lambasted the FBI and the DOJ under liar-nObama for systematic and continuing lack of candor and providing false information to the court, and, illegally allowing contractors to have access to information.” He continues, “The Inspector General of the Department of Justice started this investigation based on the FISA Court information. It is the Inspector General who referred the text messages between Strzok and Page and all of the other relevant information to House and Senate committees to allow them to conduct oversight. { theconservativetreehouse.com } ~ Intelligence Chairman Devin Nunes appears on Fox News for an professional interruption session with Sean Hannity... Chairman Nunes was able to slip in a few points between Hannity shuffling his papers to tell the audience how much his sources know about the papers he is shuffling, and how those sources outline Chairman Nunes memo content. After Hannity was able to locate his place amid his papers, he tells his audience what his sources said about Chairman Nunes memo, he then asked Nunes to confirm his sources were correct.  There are a few – notably including Rep. Devin Nunes – who against continual blowback from the Left have been tirelessly working to bring the truth to the forefront. And, what is this truth? It's the – now – documented and out-in-the-open facts showing that the liar-nObama "Shadow Government" which I have been writing about since October 2008 – before liar-nObama's 'election' and "Secret Cabal" within our Department of Justice and Federal Bureau of Investigation is real. Nunes' 4-page "FISA Memo" released 2 February 2018, is based upon this 99- page document, which is verifiable and can be viewed online. Of note is that the 99-page document not only identified the FBI but, also, the DOJ, CIA and NSA. The document was prepared by the Foreign Intelligence Surveillance Court (aka FISA court) and the Nunes' Report is based upon FISC's conclusions. by Thomas Gallatin:  The House Intelligence Committee voted unanimously Monday to release the Democrat rebuttal to the Republicans’ FISA memo. President Donald Trump will now have five days to decide if he will release it to the public, which he has previously stated he would do. Rep. scum-Adam Schiff (D-CA), the author of this rebuttal memo, accused Republicans of seeking to distort the facts with the FISA memo produced by House Intelligence Committee Chairman Devin Nunes (R-CA). Democrats claim that Nunes coordinated with the White House in creating the FISA memo, a charge Nunes has strongly denied.

          Meanwhile, Rep. Jerrold Nadler (D-NY) “leaked” a six-page response to the FISA memo, in which he argues that the FBI’s acquiring of a FISA warrant based on the dubious and unverified Christopher Steele dossier was perfectly fine because of Steele’s solid reputation with the FBI and because the allegations made within the dossier have not been disproven.
          Andrew McCarthy of National Review astutely notes that the court is interested in the credibility of eyewitnesses, not the reputation of the agent who collected the information. If the FBI, as the FISA memo alleges, relied heavily on the unverified information from the Steele dossier, then the FBI did not meet the standard necessary to justify receiving a surveillance warrant. McCarthy writes, “So far, the FBI and Justice Department have provided only cause for grave concern that they gave a federal court unverified, highly unreliable information that was essential to the court’s probable-cause finding, and that they did so without being candid with the court about the biases of the information’s purveyor. That being so, the burden is on the FBI and the Justice Department to prove that they did not act improperly in seeking the FISA warrant — especially since they, rather than the rest of us, are in possession of the information that they insist would vindicate them.”
          McCarthy also points out that the burden is on the DOJ and the FBI to prove they had credible witnesses for seeking a FISA warrant. He writes, “Before you ever get to the point of having an expert explain factual transactions that are beyond the ken of the layman, the occurrence of these factual transactions has to be established by competent, reliable witnesses. Steele and the FBI point us to none.” He continues, “Warrants are issued based on the quality of the information proffered to the court, not the duration of the information-gathering process.
          Democrats are clearly scrambling to regain control of the narrative surrounding Russiagate, with spurious accusations of a Republican Congress going out of its way in seeking to protect Trump. However, the stench of deep-state corruption is all wafting from the Democrat side of the aisle, and no amount of political spin perfume will cover the stink of this growing scandal.   ~The Patriot Pos

 Judge Orders Mueller To Prove  Russia Meddled In Election

A Washington federal judge on Thursday ordered special counsel Robert Mueller’s team to clarify election meddling claims lodged against a Russian company operated by Yevgeny Prigozhin, an ally of Russian President Vladimir Putin, according to Bloomberg.

Concord Management and Consulting, LLC. – one of three businesses indicted by Mueller in February along with 13 individuals for election meddling, surprised the special counsel in April when they actually showed up in court to fight the charges. Mueller’s team tried to delay Concord from entering the case, arguing that thee Russian company not been properly served, however Judge Dabney Friedrich denied the request – effectively telling prosecutors ‘well, they’re here.’

Concord was accused in the indictment of supporting the Internet Research Agency (IRA), a Russian ‘troll farm’ accused of trying to influence the 2016 US election.

On Thursday, Judge Freidrich asked Mueller’s prosecutors if she should assume they aren’t accusing Concord of violating US laws applicable to election expenditures and failure to register as a foreign agent.

Concord has asked Dabney to throw out the charges – claiming that Mueller’s office fabricated a crime, and that there is no law against interfering in elections.

According to the judge’s request for clarification, the Justice Department has argued that it doesn’t have to show that Concord had a legal duty to report its expenditures to the Federal Election Commission. Rather, the allegation is that the company knowingly engaged in deceptive acts that precluded the FEC, or the Justice Department, from ascertaining whether they had broken the law. -Bloomberg

On Monday, Friedrich raised questions over whether the special counsel’s office could prove a key element of their case – saying that it was “hard to see” how allegations of Russian influence were intended to interfere with US government operations vs. simply “confusing voters,” reports law.com.

During a 90-minute hearing, Friedrich questioned prosecutor Jonathan Kravis about how the government would be able to show the Russian defendants were aware of the Justice Department and FEC’s functions and then deliberately sought to skirt them.

“You still have to show knowledge of the agencies and what they do. How do you do that?” Friedrich asked.

Kravis, a prosecutor in the U.S. Attorney’s Office for the District of Columbia, argued that the government needed only to show that Concord Management and the other defendants were generally aware that the U.S. government “regulates and monitors” foreign participation in American politics. That awareness, Kravis said, could be inferred from the Russians’ alleged creation of fake social media accounts that appeared to be run by U.S. citizens and “computer infrastructure” intended to mask the Russian origin of the influence operation.

“That is deception that is directed at a higher level,” Kravis said. Kravis appeared in court with Michael Dreeben, a top Justice Department appellate lawyer on detail to the special counsel’s office. -law.com

Concord pleaded not guilty in May. Their attorney, Eric Dubelier – a partner at Reed Smith, has described the election meddling charges as “make believe,” arguing on Monday that Mueller’s indictment against Concord “doesn’t charge a crime.”

“There is no statute of interfering with an election. There just isn’t,” said Dubelier, who added that Mueller’s office alleged a “made-up crime to fit the facts they have.”

Dubelier added that the case against Concord Management is the first in US history “where anyone has ever been charged with defrauding the Justice Department” through their failure to register under FARA.
