Republicans push bill to split up ‘nutty 9th Circuit’ Court

Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.

They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th's judicial fiefdom. 

Right now, Flake said, the circuit is far too sprawling. 

“It represents 20 percent of the population -- and 40 percent of the land mass is in that jurisdiction. It’s just too big,” Flake told Fox News on Wednesday. “We have a bedrock principle of swift justice and if you live in Arizona or anywhere in the 9th Circuit, you just don’t have it.”

Flake says it typically takes the court 15 months to hand down a decision.

“It’s far too long,” he added. 

Conservatives have mocked the 9th Circuit for years, often calling it the “Nutty 9th” or the “9th Circus,” in part because so many of its rulings have been overturned by the U.S. Supreme Court.

Gee, it looks fair to me.

McCain FINALLY says or does something that makes sense!

But why?  Neither McCain nor Flake are supporters of Trump.  Are his constituents giving him a hard time? And even if they are, why should he care, unless he plans to run again at 86 years old?

Yeah............I'm curious about all this.  Snowflake and McCain of all people think the 9th is TOO liberal?  Whatever they've got in mind.......................you can bet it's not good for the rest of the country.  The only people they look out for is-----THEM

It might have something to do with many people finally noticing, and voicing their disdain for, the ineffectual career politicians that pollute our Congress, and McCain could be trying to justify his worth by doing something worthwhile so he will remain in office. Who knows. I don't trust him though.

Along these lines, our best-known hero veteran who came home from war with health problems, and who also knows more about vets and military and war and foreign affairs and state department stuff, and who lives in AZ, and near the worst VA hospital, and who has a HUGE amount of power in Congress and in DC, somehow could not (or would not) get the VA fixed.  And Pres. Trump WILL fix it, and McCain is a never-Trumper!  We in our household have always wondered why this disconnect!

I am sure he does not use the VA hospital.  Congress does not have what we have to live under for health care nor social security.  Not to mention that he is very rich, thanks to his wife.  I feel maybe the changes came about in him due to his wife's wealth and whom they associate with.   People change in life he may have been a moral person at some point in his life, but he certainly has not been for a long time.

Further to your points, I don't see how breaking up that district will stop judge shopping.  Since left wing judges write the rules as they go along, anyone they want to have standing they can give standing to, since they don't seem to care if they get reversed by the SCOTUS.  And if I am right, then,  is this just grandstanding by McCain/Graham? For McCain it might not be.

I don't know about Graham, but if the court were divided, AZ would have a bigger say in court matters, and McCain would be able to claim that for his legacy,which is probably what motivates him. I won't try to imagine the likely  lewd reasons for Graham's involvement. :)

The biggest problems seem to be too many cases, not enough judges, too many left wing judges, not enough time to hear the cases, and the biggest problem of all....California.

I would rather see total abolishment of 9th circuit to expand North California and Northwest Alaska to the Minnesota area and Southern Cal Nevaada Arizona to Denver.The judges from 9th can become real lawyers and chase ambulances.

Anything that has  anything to do with California is screwed up,,,enter the male Pelosi Kevin De Leon of the state Senate! He probably will not work with George Bush either

Making the court smaller, rather than addressing the corruption of it and removing members, is typical of a McCain show time solution.

These so called justices can be, and must be, fired and the Constitution is the authority for doing so.

Another thing. If the current ruling of this alien court is reviewed by the supreme court, and upheld as just, then the supreme court should also be fired per the Constitution. In addition, all those people, including the Presidents who appointed members of both courts, those who voted to confirm the appointments,  and those who applauded, supported, or promoted the results of their Constitutionally hostile anti-American rulings should be prosecuted, and some in fact tried for treason.

And one other thing. If the people of Arizona are so stupid as to keep this McCain thing in office as a representative of the State, then Louis Farrakhan should serve as their attorney general.

Joe Biden Vows: Give Taxpayer-Funded Obamacare To All Illegal Aliens In U.S.

Former Vice President and 2020 Democrat presidential primary candidate Joe Biden is vowing to give Obamacare, funded by American taxpayers, to all 11 to 22 million illegal aliens living in the United States.

During an interview with Telemundo’s Jose Diaz-Balart, Biden forgot that Obamacare technically bans illegal aliens from enrolling in healthcare plans — although illegal aliens are still able to obtain subsidized and free healthcare at Americans’ expense — and promised that under his plan, all 11 to 22 million illegal aliens would be able to get Obamacare.

The exchange went as follows:

DIAZ-BALART: When I … NBC moderated that first debate with you, I didn’t … I don’t recall a clear answer, under your plan should … would the 11, 12 million undocumented immigrants that live in the United States, that have been here many for generations, would they have access …

BIDEN: Yes.

DIAZ-BALART: — to health insurance.

BIDEN: Yes, they … if they can buy into the system like everybody else.

DIAZ-BALART: Because you know, in [Obamacare] they can’t.

BIDEN: Yeah. Yeah, I know. Well they can, that’s my point. They continue to be able to do that.

DIAN-BALART: They cannot under the ObamaCare.

BIDEN: Well and that’s my point, they will though. They will be able to buy into … [illegal aliens] would be able to buy in, just like anyone else could.

Biden joins Sen. Bernie Sanders (I-VT), Sen. Elizabeth Warren (D-MA), and South Bend, Indiana, Mayor Pete Buttigieg — among other 2020 Democrats — in committing to forcing American taxpayers to pay for healthcare for illegal aliens who arrive in the U.S.

Already, due to loopholes, American taxpayers are spending nearly $20 billion every year to provide illegal aliens with subsidized healthcare, emergency room visits, and other health services.

Under the 2020 Democrats’ plan to provide taxpayer-funded healthcare to all illegal aliens living in the U.S., Americans would be billed potentially $660 billion every decade just to cover the costs. Other research has found that the plan would cost Americans at least $23 billion every year.

As Breitbart News has reported, experts have said that giving taxpayer-funded healthcare to effectively all foreign nationals who can make it to America’s borders would drive “strong incentives for people with serious health problems to enter the country or remain longer than their visas allow in order to get government-funded care.”

Despite 2020 Democrats’ continued push for taxpayer-funded healthcare for illegal aliens, American voters are overwhelmingly opposed to the plan. The latest Wall Street Journal/NBC News survey revealed that the healthcare-for-illegal-aliens plan is the least popular policy position, with opposition from 62 percent of U.S. voters.

Similarly, a CNN poll from July discovered that 63 percent of likely swing voters oppose providing healthcare to illegal aliens, along with nearly 6-in-10 of all likely U.S. voters and 61 percent of moderates. A Rasmussen Reports survey also found that likely voters, by a majority of 55 percent, oppose giving healthcare to even the most low-income illegal aliens.
