Limited Federal Government... 17 Enumerated Powers... What's that?

There are ONLY (17) 'Enumerated Powers' delegated to the Congress and the Federal Government by the US Constitution. These 'enumerated powers' are the limits on federal power that our founders provided in the Constitution. Congress and the Federal Government have far exceeded their delegated powers, usurping powers given to the States and the People...  We must return to these limits on governmental power if we are to have a Constitutional Republic.

Article I, Section 8 of the Constitution lists the seventeen powers... specifically enumerated by the Constitution. The federal government is restricted to governing within the limits of these powers. We must return to the Constitutional limits on Federal Power, in order to protect the liberties of every American from the current abuses of the federal government.

So how did prescription drugs become regulated? How are certain industries required to be licensed? What about the hundreds of other areas the federal government has invaded with its statutory, regulatory and Judicial usurpations... Education, energy, transportation, national parks, etc., these functions are all the creation of an out of control federal government. How did that happen? The people and the states failed to keep the federal government in check.  The Federal Judiciary exceed its powers and began to find federal powers never in the Constitution.  The federal government and its leaders knowingly and openly defied the limits of the US Constitution... they wrongly and openly usurp the powers of the People and the several States. 

The Tenth Amendment States: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." That word, reserved, speaks of exclusivity. The Tenth Amendment and Constitution did not speak of a preferential view for the division of public power.  The Constitution is a mandate not a choice: All powers not delegated to the United States by the Constitution are reserved for the States and the People.

The several states were to be the power houses of government... not the Federal Government. Within the framework of the States, a crucible of ideas was to be created, one capable of benefiting all of society. The States were to be laboritories of democracy... the engines of liberty... where in each state could choose those laws and ideas that worked best for its people..

The idea behind our system of Constitutional government was simple, yet profound... a divided government (state and federal), with defined/enumerated powers limiting the central government... while empowering local governments... The State governments were to be given virtually unlimited powers, but limited amounts of money. States could not "print money" to fund their programs, because only the federal government had the power to do such. On the other hand, the federal government was limited to 17 enumerated powers, and without additional power and authority, it had no reason to engage in deficit spending to fund unlawful programs. This kept the value of the US dollar steady, until the early part of the 20th century, when Roosevelt's New Deal began and our currency was devalued to pay for "extra Constitutional" ... government programs. Socialist programs, and progressive ideas have destroyed our Constitution and the original landmarks of government, established by our founders.

The Founders of this republic believed in the dispersion of power... They divided power within government to maximize individual freedom and to protect the power of the States. This was a unique system that kept big government from raising unlimit amounts of money to spend on programs not permitted by the Constitution. Restricting the enumerated powers to 17 functions kept the Federal Government small and limited. Keeping it from raiding the State's treasury's and the people's pocket books, to fund unconstitutional programs and wars.

Under our founding father's system of Constitutional Government... the people and businesses had the power and freedom to move from state to state, in order to find a government that best suited their needs. The People's power to "vote with their feet" and the economic engines of business, were to keep the State governments in check.

Below is a list of the 17 powers our Constitution gives Congress:

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To borrow on the credit of the United States;

To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

To establish a uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;

To establish Post Offices and Post Roads;

To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;

To constitute Tribunals inferior to the supreme Court;

To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations;

To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;

To provide and maintain a Navy;

To make rules for the Government and Regulation of the land and naval Forces; 

To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;

To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;

To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings; And

To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof...

So true Bonnine... our Constitution and underlying law is only effective when the People are willing to enforce there application... running off the lawlessness and corruption of the wicked and their cohorts. .

The Constitution has all the remedies we need to rescue and reset our Republic ... Our founders gave us Article 5, the amendment process, to address future problems with our Constitutional government.

There are basically four things we need to do:

1) Repeal all direct taxes.. begin with the removing the 16th Amendment and return government financing thru taxation to its original sources... excise taxes, import and export duties, fees for government services,  etc. Return much of what the Federal Government is doing to the States... thus reducing the costs and scope of the federal government.  No more direct taxes as originally intented and limited by the US Constitution.

2) Phase out the Federal Reserve... return the management of our money supply to Congress and the US Treasury.  Let the US Tresury assume all the duties of a Central Bank... END FIAT CURRENCY.  Return to a Constitutional currency.  Money tied to assets with real value: gold, silver and commodities, such as oil and natural gas.  End paying interest on borrowed money, from the unecessary private financing of our public debt... No more deficit financing... phase a balanced budget in over 10yrs.

3) Repeal the 14th, 16th, and 17th Amendments... Return the appoint US Senators to the several States as originally authorized by the Constitution. Remove birthright citizenship, and the creation of special interest minority rights, under the 14th Amendment.  The Constitution's body already contains guarantees of due process and civil rights for all of its CITIZENS.  End the extension of Constitutional rights to ilegal aliens in the US.

4) Add a Term Limits and Recall Amendment to the US Constitution...  One term, 6yrs, with 1/3rd standing for election and appointment (judges included) every 2 yrs.  Include a Recall Provision... Give every State Legislature the power to recall any elected federal representative of the State.  End the power of encumbancy and political parties with this single amendment.

Return the financing of the federal government to Constitutional means: excise taxes, duties, tarriffs, fees for service, and the issue of government bonds to finance long term Constitutional programs. Limit federal government to its enumberated powers as contained in Article 1, Section 8 of the Constitution.  Reduce both the size and scope of government to sustainable levels. 

No more deficit spending... phase in a balanced budget over 10yrs.  A Balanced Budget Amendment may be necessary if Congress can not control spending once citizen representatives are running the government.

CONFUSION:   Pelosi Says Constitution Spells Out ‘Two Co-Equal Branches’ Of Government

House Speaker Nancy Pelosi must be taking night classes at the Alexandria Ocasio-Cortez School of Government.

Pelosi, the 79-year-old third-highest ranking official in the U.S. government, was speaking to the Center for American Progress today when she mistakenly said there are “two co-equal branches” of government, before correcting herself to say there are three.

Watch:

“First of all, let me just say, we take an oath of office to protect and defend the Constitution of the United States,” Pelosi said.

“Democrats take that oath seriously, and we are committed to honoring our oath of office. I’m not sure that our Republican colleagues share that commitment, and I’m not sure that the president of the United States does, too,” she claimed.

“So, in light of the fact that the beauty of the Constitution is a system of checks and balances— two co-equal branches— three co-equal branches of government,” she corrected with a laugh.

“A check and balance on each other,” she continued. “Con— Constitution spells out the pri— pa, uh, the duties of Congress and one of them is oversight of the president of the United States, another one of them is to impeach the president of the United States,” Pelosi said.

In November, Alexandria Ocasio-Cortez rallied supporters on Facebook to pitch in and help Democrats take back “all three chambers of Congress.”

“…the Progressive movement works and it wins in all districts…If we work our butts off to make sure that we take back all three chambers of Congress– three chambers of government…,” she said during the virtual appearance.

She clarified that she meant the “presidency, the Senate and the House.”

According to the Constitution, the three branches of government are the legislative, executive and judicial.
