A federal judge has declined a House committee's bid to have Attorney General Eric Holder held in contempt of court — and perhaps even jailed — for failing to turn over documents related to the Justice Department' s response to Operation Fast and Furious.

However, in a ruling Monday, U.S. District Court Judge Amy Berman Jackson also denied Holder's request for an indefinite stay of her prior order that the attorney general must turn over any "non-privileged" documents the House Oversight and Government Reform Committee subpoenaed as part of an investigation into the botched gunrunning investigation. The judge previously ruled that Holder must give the panel any documents that are not both predecisional and deliberative in nature.

Jackson called the House contempt motion "entirely unnecessary" and said it was evident that she was considering the government's motion to lift her prior order. "Under those circumstances, the Court finds no basis to hold defendant in contempt," she wrote.

But the judge also said she saw no reason to allow the Justice Department to withhold unprivileged documents until the case was complete. She ordered those records turned over to the committee by Nov. 3, along with a log of the records claimed to be privileged.

"Though the Court has the discretion to grant a stay in the interests of judicial economy and efficiency, pending appeal or otherwise, there is no pending appeal here and the Court has already ruled that defendant has no legal basis to withhold non-deliberative documents. The 'possibility' of an appeal and piecemeal litigation does not satisfy defendant’s burden to demonstrative a 'clear case of hardship or inequity' without a stay," she wrote in her decision (posted here).

A Justice Department spokesman welcomed the decision, at least the part rebuffing the motion to hold Holder in contempt. "We are pleased that the court rejected the committee's latest stunt," spokesman Brian Fallon said.

Our "JUSTICE" System SIMPLY IS NOT Justice!

This judge, apparently, has no concept of CONTEMPT!

This liberal judge is owned by the progressive liberals!  

Eric Holder is an obvious, in-your-face criminal who should be in prison. The American People know this.  This judge is in Obama's pocket and/or afraid of the consequences of crossing "the Regime" and holding someone accountable for something!!!

She may be in the pocket of the Federal bureacracy, but I would bet that she has compromised her ethics and morals because of fear of reprisal and the potential loss of her seat of power! She fails to understand that there is far more at stake here than merely keeping her job! She has compromised the trust of the American people and in essence has said that law breakers like Eric "the snake" Holder are above the law!

Do we not see the problem here? The enemies of freedom are using our own laws to defeat our freedoms.. Some Americans voted for Democrats for the WH! When they get in they appoint Liberal Justices. We are finding out this means that our Constitutional rights are not as before.. they are directed from two treasonous places.. the WH and the court! LIBERAL COURTS.. Oh Oh, there goes honor as that is a relative thing! No absolute morals as this is also a matter of relativism!

Hopefully after the November elections we can

clean up DC and finally say GOODBYE to obama

and all the DEMOCRAPS and muslims in our government!

Maybe they should hold U.S. District Court Judge Amy Berman Jackson in contempt first, then have a real judge hold Holder in contempt, along with Brian Fallon.

The judge ruled on feelings and what is good for the communist party. It's so obviously clear that Holder should be held and jailed for contempt. Alleged judge Amy Berman Jackson should be removed from the bench for her judicial blindness.

What else can we expect from her? an Ashkenazi liberal Jewish, and nothing less than appointed by the Kenyan illegal in the WH...!!

Fact Check:   'Joe Biden Claims ‘We Didn’t Lock People Up In Cages’

CLAIM: Former Vice President Joe Biden claimed, on immigration: “We didn’t lock people up in cages.”

VERDICT: FALSE. The “cages” were built by the Obama-Biden administration.

Univision moderator Jorge Ramos asked Biden at the third Democrat debate at Texas Southern University in Houston, Texas, why Latinos should trust him after the Obama administration continued deporting “undocumented immigrants.”

Biden claimed that the Obama administration’s policies were more humane than those of President Donald Trump: “We didn’t lock people up in cages,” he said.

In fact, the “cages” were built by the Obama administration to deal with a surge of unaccompanied minors who crossed the border illegally in 2014.

Originally, the Obama administration was “warehousing” children — literally — in overwhelmed Border Patrol facilities. Breitbart News broke the story of the surge, which was partly triggered by Obama’s policy of allowing illegal alien children who entered the country as minors to stay in the country (Deferred Action for Childhood Arrivals, or DACA).

The “cages” are chain-link enclosures in Border Patrol processing facilities that are meant to protect children from adults in custody. They are not permanent accommodations.

In mid-2018, as the Trump administration began enforcing a “zero tolerance” policy that stopped the “catch-and-release” policy of letting illegal aliens go after they were arrested. Detaining adults and children meant that children had to be processed separately; the enclosures prevented adults from harming children.

As Breitbart News reported at the time, children were not housed in “cages.” They were processed and then taken to shelters, where they were given medical care, toiletries, education, recreation, and counseling, and where staff attempted to find relatives or sponsors to whom they could be released.

Democrats began tweeting images of “kids in cages” to condemn the Trump administration. Journalists, too, shared those images.

One problem: they were taken during the Obama administration.

Public outrage at the images led President Trump to end the policy, and require families to be detained together.

Democrats keep repeating the mistake, however: in July, they had to delete a tweet that used an image from the Obama era and cited the “inhumane treatment” of children by the Trump administration.

Republicans argue that not detaining illegal aliens is actually the cruel policy, because it encourages migrants to undertake a dangerous journey, often guided by cartels and smugglers.

As Breitbart News’ Alana Mastrangelo noted recently:

But what’s worse than “cages,” however, are reports of migrant children also being handed over to human traffickers during the Obama administration — while Biden was vice president — according to the New York Times. Between October 2013 and July 2015 alone, nearly 80,000 unaccompanied children from Central American countries were detained by U.S. authorities.

It remains unclear how many of the tens of thousands of children were handed over to human traffickers — including sex traffickers — during that span of nearly two years, as those cases are reportedly not tracked.

“Others were ransomed by the very smugglers to whom their families paid thousands of dollars to sneak them into the United States,” reported the New York Times in 2015, during Obama’s presidency and Biden’s vice presidency. “Some lost limbs during the journey or found themselves sold into sexual slavery.”

Biden told voters in South Carolina last month that he would close all border detention facilities, guaranteeing that the migrant flow would continue.
