Federal Prosecutor Alleges Boss Pressured Him To Engage in 'Unethical Conduct'; Judge Calls Abuses 'Egregious,' 'Pervasive,” and “Reprehensible”

In perhaps the most stunning documentation yet of abuses by Eric Holder’s Justice Department, two former Assistant United States Attorneys spoke to defense attorneys and revealed appalling deceit and corruption of justice. This latest litigation time bomb has exploded from multi-million dollar litigation originally brought by the Department of Justice against Sierra Pacific based on allegations that the lumber company and related defendants were responsible for a wildfire that destroyed 65,000 acres in California.

In what was dubbed the “Moonlight Fire” case, the tables are now turned. The defendants have discovered new evidence and filed a stunning motion. The new evidence and disclosures are being taken seriously by the Chief Judge of the Eastern District of California—as they should be. In a shocking action, Judge Morrison C. England Jr. ordered the recusal of every federal judge in the Eastern District of California.

Sierra Pacific Industries and other defendants were compelled to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land to settle massive litigation brought against them by the United States alleging that they caused a 2007 fire that destroyed 65,000 acres in California. Sierra Pacific has always maintained that the fire started elsewhere and that the state and federal investigators and Department attorneys lied. Now that settlement may go up in smoke because of the new evidence of outrageous misconduct by the federal prosecutors and the investigators from state and federal offices, as well as findings earlier this year by a state judge.

In an extraordinary development, Judge England, Chief Judge of the United States District Court for the Eastern District of California, ordered the recusal of all the Eastern District judges from the case because of serious allegations that the Court itself was defrauded by the government in the original prosecution. To avoid any appearance of partiality, he has referred the case to Ninth Circuit Chief Judge Alex Kozinski to appoint a judge from outside the Eastern District to handle the case going forward. Judge Kozinski has excoriated prosecutors for failing to meet their legal and ethical obligations.

The order notes that the defendants filed an action this week to set aside the $55 million settlement because, as the defendants allege, “the United States presented false evidence to the Defendants and the Court; advanced arguments to the Court premised on that false evidence; or, for which material evidence had been withheld, and obtaining court rulings based thereon; prepared key Moonlight Fire investigators for depositions, and allowed them to repeatedly give false testimony about the most important aspects of their investigation; and failed to disclose the facts and circumstances associated with the Moonlight Fire lead investigator’s direct financial interest in the outcome of the investigation arising from an illegal bank account that has since been exposed and terminated.”

Perhaps the tide is turning in America.  One can hope.

I smell Muslim Dictator Obama in this!!   Holder is just another puppet!

The sight and sound of obama and his followers makes me want to barf. I have more respect for a turd. Obama and his apointees should be banished from where ever decent people are.

Check out Holder and the cases against the several of the  Financial Community.   They settled separately with Holder for about $20 billion.    Just to stop his harassment.   The $20 billion went into the D of J  and Holder.   Not the US Treasury.   So exactly what has Holder done with the Billions.   Bet  its  gone.   Can't imagine whose pockets it is ending up in.  If you hear BLM after someone,  you know Harry Reid has a buddy that wants that land.

Really now... the Ninth Circuit is the most constitution offending progressive federal judicial entity in the country. Giving it the duty to 'avoid any appearance of partiality' can only be theatre.

Exactly my thoughts... the 9th Circuit is an abomination and every justice on the 9th needs to be recused permanently.  Asking them to correct the illegal and disgraceful acts of previous judges and prosecutors is like asking the fox to guard the hen house.

Our courts are lost to men of ill will and activist judicial authority... Congress needs to redistrict the entire system putting every current judge out of office and reappointing the new districts with Constitutional Justices... those who will rule on the law as it applies to the Constitution rather than PC or some other personal agenda.

Yeah.....I like that word---------------------------------------PERMANENTLY

After reading the article through, Sierra Pacific was "taken for a hay ride" by "withholder's DOJ"';  Judge England and Judge Nichols saw through the whole charade and, this time, I believe "real justice" will be done. I hope both these justices have some reasonably good security, because they have made some "serious enemies" high up the chain.

 And, by the way, Judge Kozinski was appointed by President Ronald Reagan, so he is, probably, the only "sane"  justice, sitting in the Ninth Circuit.

YUP: President Trump Signs Great And Beautiful Trump Border Wall During Tour In San Diego

President Donald Trump visited the San Diego border on Wednesday to show off a newly constructed portion of the wall after a fundraising trip in California.

“It’s an amazing project,” Trump said, pointing to the 30-foot high barrier constructed with steel and concrete, noting that it also went six feet underground.

“If you think you’re going to cut it with a blow torch, that doesn’t work, because you hit the concrete, and then if you think you’re going to go through the concrete, that doesn’t work because we have very powerful rebar inside,” Trump said.

The president traveled via motorcade after a fundraiser to Otay Mesa, a community outside San Diego on the United States -Mexico border to review the latest constructed physical barrier.

He pointed out the new wall structure to the press, which was 24 miles of primary and secondary wall at the border.

“We have it covered underground, we have it covered overground,” Trump said.

The president was joined by acting Department of Homeland security Kevin McAllen and several other border security officials.

He said that over 44,000 bollard panels had been set up for the wall, which was then filled with concrete and rebar.

Trump admitted that he envisioned a solid concrete wall when he campaigned for president, but he was told by border officials that they preferred a wall constructed by concrete-filled bollards so they could see through it.

“It’s hardened concrete, very powerful concrete,” Trump said, pointing to the structure.

He added that the steel wall was designed to retain heat, making it harder to climb, plus having an anti-climbing system at the top.

“You can fry an egg on that wall,” he said. The president also acknowledged to reporters that he wanted the wall to be painted black and have spikes but said it was cheaper to let it remain naturally rust-colored.

“We can paint it later,” he said.

The president discussed his growing understanding of border barriers, noting that the Southern border would not need much more than 500 miles of wall to secure the border. He cited the existence of natural mountain and river barriers that prevented criminals from crossing. He did not rule out building additional barriers in the future but said it would depend on whether it was needed.

One border patrol agent spoke about the importance of the border wall to all of the agents, thanking the president for pushing forward on construction.

Trump said he met with Border Patrol prior to constructing the wall, picking the most effective structures to protect the border.

One border security official scoffed at the idea that the wall was a “vanity” project for the president.

“There’s a false narrative out there that this wall is the president’s vanity wall,” he said. “I’m here to tell you right now that that is false.”

He thanked Trump for listening to border patrol agents during the planning and construction process.

“You listened to the agents and you gave them exactly what they asked for,” he said.

One official with Trump confirmed that the structure was funded with regular Congressional appropriations in the FY 2017 and FY 2018 and that that the new wall replaced an inferior structure.

Trump said that he still considered the situation on the border a national emergency, but as more wall went up he could withdraw military forces.

“I hope you’re impressed,” he told reporters as he took questions about the project.

One worker told Trump of a tradition of workers signing the wall if they worked on the wall.

“I’ll sign it,” Trump said, and went to the wall and signed the steel barrier with a marker before encouraging other officials present to do the same.
