Federal Prosecutor Alleges Boss Pressured Him To Engage in 'Unethical Conduct'; Judge Calls Abuses 'Egregious,' 'Pervasive,” and “Reprehensible”

In perhaps the most stunning documentation yet of abuses by Eric Holder’s Justice Department, two former Assistant United States Attorneys spoke to defense attorneys and revealed appalling deceit and corruption of justice. This latest litigation time bomb has exploded from multi-million dollar litigation originally brought by the Department of Justice against Sierra Pacific based on allegations that the lumber company and related defendants were responsible for a wildfire that destroyed 65,000 acres in California.

In what was dubbed the “Moonlight Fire” case, the tables are now turned. The defendants have discovered new evidence and filed a stunning motion. The new evidence and disclosures are being taken seriously by the Chief Judge of the Eastern District of California—as they should be. In a shocking action, Judge Morrison C. England Jr. ordered the recusal of every federal judge in the Eastern District of California.

Sierra Pacific Industries and other defendants were compelled to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land to settle massive litigation brought against them by the United States alleging that they caused a 2007 fire that destroyed 65,000 acres in California. Sierra Pacific has always maintained that the fire started elsewhere and that the state and federal investigators and Department attorneys lied. Now that settlement may go up in smoke because of the new evidence of outrageous misconduct by the federal prosecutors and the investigators from state and federal offices, as well as findings earlier this year by a state judge.

In an extraordinary development, Judge England, Chief Judge of the United States District Court for the Eastern District of California, ordered the recusal of all the Eastern District judges from the case because of serious allegations that the Court itself was defrauded by the government in the original prosecution. To avoid any appearance of partiality, he has referred the case to Ninth Circuit Chief Judge Alex Kozinski to appoint a judge from outside the Eastern District to handle the case going forward. Judge Kozinski has excoriated prosecutors for failing to meet their legal and ethical obligations.

The order notes that the defendants filed an action this week to set aside the $55 million settlement because, as the defendants allege, “the United States presented false evidence to the Defendants and the Court; advanced arguments to the Court premised on that false evidence; or, for which material evidence had been withheld, and obtaining court rulings based thereon; prepared key Moonlight Fire investigators for depositions, and allowed them to repeatedly give false testimony about the most important aspects of their investigation; and failed to disclose the facts and circumstances associated with the Moonlight Fire lead investigator’s direct financial interest in the outcome of the investigation arising from an illegal bank account that has since been exposed and terminated.”

Now who do we believe. The Govt or Sierra Pacific.

I damm sure don't believe the Federal Government. Every word out of Obama or any of his cronies mouth is nothing but a lie.

Hmm, let me see. The government said that we could keep our health plans (a lie), our premiums would go down an average of $2500 (a lie, they are going up by that much), Ebola wouldn't come the the U.S. (it did), we can stop Ebola in it's tracks (we didn't), our Southern Border is more secure than ever (it's a sieve), Benghazi occurred because of a video (another lie) and other lies ad infitum. If I were betting, my money would be on Sierra Pacific. 

My vote is for Serra Pacific. The government is no longer deserving trust of any kind.

We can blame the govt for so many lies,etc., but it is the VOTERS that are to blame. They cannot vote for anyone but a party member (liberal-democrat).

Turning the matter over to the Ninth Circus will prove to be another travesty.  These BOZOs have no idea what the word "justice" means.

Just another money & land grab. Just ask farmers, ranchers, & the states what the feds are up to.

    Just this issue by itself should force the DOJ to be purged of the likes of Holder and all top management and a Bi-Partisan group of Senators used to monitor and take over it's functions until it can be reorganized and made effective again . Plus all documents needed by Congress to do it's investigative work should be secured and supplied to each committee as needed . 

Where are the orders to investigate and INDICT the judges and prosecutors who acted illegally in this matter?  It is not enough to recuse them there must be indictments for any laws broken, including disbarment proceedings for unethical conduct.

Congress should take the matter under advisement and begin investigation to impeach any justices that acted improperly.

There was a time when we could trust the Government/Courts and Congress to do the jobs they were hired by vote to do. Sadly,that has all changed.

The only way I see to correct that condition of CORRUPTION, is to RID OURSELVES of those who are the seed of this corruption, starting at the top of the chain - THE GOVERNMENT OFFICIALS WHO ARE IN CHARGE OF GIVING ORDERS - the entire Obama Administration.

The Democrats (esp. Harry Reid and company) and those of both sides that supported by voting in support of Obamas' directives, MUST BE HELD RESPONSIBLE TO THE AMERICANS WHO VOTED THEM IN OFFICE.That goes double for the Courts and Congress!

If they have been "re-elected" this year or for this term, they must prove that their voting record was coerced by Nancy Pelosi/Harry Reid/ John Boehner, et. al,.It should be held for a "re-call" vote.

I BELIEVE FIRST IN GOD and secondly I BELIEVE IN AMERICANS to stand by our convictions upon which this country was founded and has fought for survival.

Congress can't even muster the courage to impeach the head of the Justice Dept. that is encouraging this type of illegal behavior. I agree that the judges should be impeached, prosecuted, etc., but I'm pessimistic about it ever happening. The only bright spot in this sorry episode is the integrity shown by Judge England.

I say it is the voters fault.  They keep re-electing the same crooks into office. Not only are the govt people to blame !

Fact Check:   'Joe Biden Claims ‘We Didn’t Lock People Up In Cages’

CLAIM: Former Vice President Joe Biden claimed, on immigration: “We didn’t lock people up in cages.”

VERDICT: FALSE. The “cages” were built by the Obama-Biden administration.

Univision moderator Jorge Ramos asked Biden at the third Democrat debate at Texas Southern University in Houston, Texas, why Latinos should trust him after the Obama administration continued deporting “undocumented immigrants.”

Biden claimed that the Obama administration’s policies were more humane than those of President Donald Trump: “We didn’t lock people up in cages,” he said.

In fact, the “cages” were built by the Obama administration to deal with a surge of unaccompanied minors who crossed the border illegally in 2014.

Originally, the Obama administration was “warehousing” children — literally — in overwhelmed Border Patrol facilities. Breitbart News broke the story of the surge, which was partly triggered by Obama’s policy of allowing illegal alien children who entered the country as minors to stay in the country (Deferred Action for Childhood Arrivals, or DACA).

The “cages” are chain-link enclosures in Border Patrol processing facilities that are meant to protect children from adults in custody. They are not permanent accommodations.

In mid-2018, as the Trump administration began enforcing a “zero tolerance” policy that stopped the “catch-and-release” policy of letting illegal aliens go after they were arrested. Detaining adults and children meant that children had to be processed separately; the enclosures prevented adults from harming children.

As Breitbart News reported at the time, children were not housed in “cages.” They were processed and then taken to shelters, where they were given medical care, toiletries, education, recreation, and counseling, and where staff attempted to find relatives or sponsors to whom they could be released.

Democrats began tweeting images of “kids in cages” to condemn the Trump administration. Journalists, too, shared those images.

One problem: they were taken during the Obama administration.

Public outrage at the images led President Trump to end the policy, and require families to be detained together.

Democrats keep repeating the mistake, however: in July, they had to delete a tweet that used an image from the Obama era and cited the “inhumane treatment” of children by the Trump administration.

Republicans argue that not detaining illegal aliens is actually the cruel policy, because it encourages migrants to undertake a dangerous journey, often guided by cartels and smugglers.

As Breitbart News’ Alana Mastrangelo noted recently:

But what’s worse than “cages,” however, are reports of migrant children also being handed over to human traffickers during the Obama administration — while Biden was vice president — according to the New York Times. Between October 2013 and July 2015 alone, nearly 80,000 unaccompanied children from Central American countries were detained by U.S. authorities.

It remains unclear how many of the tens of thousands of children were handed over to human traffickers — including sex traffickers — during that span of nearly two years, as those cases are reportedly not tracked.

“Others were ransomed by the very smugglers to whom their families paid thousands of dollars to sneak them into the United States,” reported the New York Times in 2015, during Obama’s presidency and Biden’s vice presidency. “Some lost limbs during the journey or found themselves sold into sexual slavery.”

Biden told voters in South Carolina last month that he would close all border detention facilities, guaranteeing that the migrant flow would continue.
