Fed Appeals Court: Immigrant Who Voted Illegally Can be Deported

Image result for Margarita Del Pilar FitzpatrickWeeks after the House Minority leader blasted President Donald Trump for pledging to investigate voter fraud, a federal appellate court has ruled that a Peruvian immigrant can be deported from the U.S. for illegally voting in a federal election. The decision comes on the heels of a spat between Congresswoman Nancy Pelosi and the president. The California Democrat accused Trump of making false claims of election fraud and said that undermining the integrity of our voting system is “really strange.” Most Democrats in Congress agree with the former House Speaker and strongly oppose an investigation, asserting it will limit access to voting.

Not surprisingly, the overwhelming majority of the mainstream media coverage promotes the Democrats’ inaccurate version of the facts. One news network referred to Trump’s voter fraud claims as “baseless” and simply an excuse to enact restrictive voting laws. Another wrote that “Trump’s ‘iIlegals voting’ comments are false and divisive,” calling voter fraud by undocumented immigrants “patently false.” In an editorial titled “The Latest Voter Fraud Lie,” a mainstream newspaper writes that the “baseless claims continue to get converted into policy in the form of stricter voting laws like requiring prospective voters to show a photo ID…” A multitude of similar media reports have flooded the news wires in the week’s following Trump’s meeting with congressional leaders to address the issue.

This week’s appellate court ruling provides a jolt of reality that the media has chosen to ignore. Election fraud was a significant concern in 2008 and 2010, which is why Judicial Watch launched an election integrity project in 2012. The project is a legal campaign to force cleanup of voter registration rolls as well as monitor elections. As an example of the pervasive fraud, Judicial Watch uncovered that 1,046 aliens, or residents who are not U.S. citizens, were on the voter rolls in eight Virginia counites leading up to the 2016 presidential election. If that rate of non-citizen registration held in the rest of Virginia’s counties, that would mean that about 6,500 non-citizens are registered to vote in the state. Additionally, Judicial Watch’s investigation found that 57,923 Virginians were registered to vote in at least one other state as well as 19 deceased individuals. Similar issues have been uncovered in several other states as part of Judicial Watch’s ongoing probe into election fraud.

Under the Naturalization and Immigration Act there is no such thing as an Anchor Baby... any child born to parent(s) while visiting the US (legal and illegally) is not granted US Citizenship automatically... they must declare their desire to become a US Citizen, once they reach the age of majority... 18 or loose any claim.  There is a legal process that they must go thru... and it is time sensitive.  If they fail to respond in the time provided they retain the Parents Citizenship.. whatever that was at the time of their birth.

It is a false construct of the left ... an illegal claim, that all children born in the US are automatically US Citizens... they are not.  Congress has the Constitutional power to define US Citizenship and they have using the Immigration and Naturalization Act of 1952 as amended in 1965.. that Act contains the lawful means to citizenship for aliens who arrive here legally and defines how one becomes a US Citizen. Illegal aliens are not granted US Citizenship by law... they were given CLAIM to US citizenship by the unlawful acts of the Democrat Party and its former President and Cabinet officers... such claims can be and are being revoked.

"The Latin American woman in the recent court ruling who voted illegally is hardly an isolated case. Her name is Margarita Del Pilar Fitzpatrick and she lied about being an American citizen on an Illinois Department of Motor Vehicle form. It was that easy. Fitzpatrick, a legal U.S. resident with three kids, voted in two federal elections in 2006 and claims that she had official approval to cast a ballot after presenting her Peruvian passport and green card. An immigration judge and the Board of Immigration Appeals, the government’s highest administrative body for interpreting and applying immigration laws, determined that Fitzpatrick should be deported because non-U.S. citizens cannot vote in federal elections and can be removed from the country for doing so.

The Peruvian woman did not back down, appealing the decisions in federal court. The Seventh Circuit Court of Appeals agreed with the two previous rulings in favor of deportation, though it acknowledged that Fitzpatrick “led a productive and otherwise-unblemished life in this country.” In its decision, the court states that the motor vehicle form sternly warns aliens not to check the U.S. citizen box and that Fitzpatrick is “literate in English and has no excuse for making that misrepresentation.” Aliens are forbidden to vote in federal elections, the ruling says, adding that “another statute provides for the removal of aliens who vote in violation of either state or federal law.” During oral argument, the appellate judges inquired whether Fitzpatrick is the kind of person the Attorney General and Department of Homeland Security want removed from the United States. “The answer was yes,” the ruling states"

Margarita Del Pilar Fitzpatrick voted in the 2006 election so one knows that she voted on the 2008, 2010, 2012, 2014, 2016, elections.

If the press thinks most of the people do not want voter id we should have a nationwide vote on it and they should be confident and support the nation wide vote, let them put their money where their mouth is,

Amazing... a federal court says its ok to deport an illegal alien convicted of a felony offense... voting illegally.  How about the half-dozen or so other crimes this illegal had to commit in order to work and register to vote... ID theft, social security fraud, tax fraud or evasion, banking fraud, money laundering... and the list goes on and on. 

It is time to Impeach a whole host of Federal Judges and too disbar even more lawyers... whose ethics and concepts of law and order are unworthy of their profession.

Joe Biden Vows: Give Taxpayer-Funded Obamacare To All Illegal Aliens In U.S.

Former Vice President and 2020 Democrat presidential primary candidate Joe Biden is vowing to give Obamacare, funded by American taxpayers, to all 11 to 22 million illegal aliens living in the United States.

During an interview with Telemundo’s Jose Diaz-Balart, Biden forgot that Obamacare technically bans illegal aliens from enrolling in healthcare plans — although illegal aliens are still able to obtain subsidized and free healthcare at Americans’ expense — and promised that under his plan, all 11 to 22 million illegal aliens would be able to get Obamacare.

The exchange went as follows:

DIAZ-BALART: When I … NBC moderated that first debate with you, I didn’t … I don’t recall a clear answer, under your plan should … would the 11, 12 million undocumented immigrants that live in the United States, that have been here many for generations, would they have access …

BIDEN: Yes.

DIAZ-BALART: — to health insurance.

BIDEN: Yes, they … if they can buy into the system like everybody else.

DIAZ-BALART: Because you know, in [Obamacare] they can’t.

BIDEN: Yeah. Yeah, I know. Well they can, that’s my point. They continue to be able to do that.

DIAN-BALART: They cannot under the ObamaCare.

BIDEN: Well and that’s my point, they will though. They will be able to buy into … [illegal aliens] would be able to buy in, just like anyone else could.

Biden joins Sen. Bernie Sanders (I-VT), Sen. Elizabeth Warren (D-MA), and South Bend, Indiana, Mayor Pete Buttigieg — among other 2020 Democrats — in committing to forcing American taxpayers to pay for healthcare for illegal aliens who arrive in the U.S.

Already, due to loopholes, American taxpayers are spending nearly $20 billion every year to provide illegal aliens with subsidized healthcare, emergency room visits, and other health services.

Under the 2020 Democrats’ plan to provide taxpayer-funded healthcare to all illegal aliens living in the U.S., Americans would be billed potentially $660 billion every decade just to cover the costs. Other research has found that the plan would cost Americans at least $23 billion every year.

As Breitbart News has reported, experts have said that giving taxpayer-funded healthcare to effectively all foreign nationals who can make it to America’s borders would drive “strong incentives for people with serious health problems to enter the country or remain longer than their visas allow in order to get government-funded care.”

Despite 2020 Democrats’ continued push for taxpayer-funded healthcare for illegal aliens, American voters are overwhelmingly opposed to the plan. The latest Wall Street Journal/NBC News survey revealed that the healthcare-for-illegal-aliens plan is the least popular policy position, with opposition from 62 percent of U.S. voters.

Similarly, a CNN poll from July discovered that 63 percent of likely swing voters oppose providing healthcare to illegal aliens, along with nearly 6-in-10 of all likely U.S. voters and 61 percent of moderates. A Rasmussen Reports survey also found that likely voters, by a majority of 55 percent, oppose giving healthcare to even the most low-income illegal aliens.
