People who enter this country ILLEGALLY have no rights ! They broke the law by crossing our borders ILLEGALLY and it should be a felony instead of a misdemeanor !
I agree that first time illegal entry should be a felony and that they should face prison time and depending on circumstances, a permanent ban on applying for legal immigration. As for repeat offenders who rape of kill, we should deport them on a pine box.
So let's take the case of the latter. Should we say they should be summarily executed without a trial? If they have a trial, should we allow them a lawyer or to call witnesses in their defense? Should we be allowed to get confessions through torture? If executing them, should we use cruel and unusual means such as beating them to death, burning them at the stake, or drawing and quartering them? In other words, should we say they have NO protection from the Bill of Rights?
The supreme Court has said that even illegals have some protections under the Constitution. Please see Yick Wo v. Hopkins (1886) and Wong Wing v. U.S. (1896).
Yet even in those cases, their rights were limited. They did not have the full rights of citizens. For example, we can deport an illegal immigrant found within 100 miles of the border who has been here less than 2 weeks without a hearing.
I think "deportation" is the key to understanding why it's only a misdemeanor. It's enough to deport, but not enough to spend millions keeping them in jail before deporting them.
David, you make a good point, but somehow we have to get it through their heads that we take illegal entry seriously.
The real key to solving our illegal alien problems is to focus on those in government, and private industry who engage in trafficking in illegals... put Governors, Mayors, City Councils, Corprate leaders, owners of businesses, bankers and any others the knowingin do business with, hire or otherwise assist illegals to remain here ... accessing our welfare, education and medical facilities. Provide for manditory jail time and make it a felony to HARBOR or AID and illegal alien in any way.
Going after US Citizens engaged in Illegal Alien Trafficking or support will dry up the jobs and all the benefits... Then, the illegals alien will stop coming and those here will SELF-DEPORT the same way they arrived... without taxpayer assistance
Colonel, I agree with your suggestion on dealing with our illegal immigration problem. Hold those responsible and get back to controlling LEGAL immigration according to the needs of the country.

"Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both."
Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):
A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:
* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
* knowingly assists illegal aliens due to personal convictions.
There are also related felony charges for money laundering ... opening bank accounts using stolen or fraudulent ID's/Social Security Numbers.. Bankers need to be jailed... then watch all the banks stop facilitating illegal alien use of their illecitly earned funds. The RICO ACT comes to mind ... as many of these crimes are repetitive and involve conspiracies between groups and individuals benefiting from illegal alien trafficking... drugs and sex trafficking included.
In any event there are many laws being violated that need to be enforced... and if they were one can wagger that the illegals would self-deport or starve.

Two houses of Congress pose one obstacle to majority rule. That is, 51 senators can block the wishes of 435 representatives and 49 senators.
The president can veto the wishes of 535 members of Congress. It takes two-thirds of both houses of Congress to override a presidential veto.

Congress has the authority to deny citizenship to the offspring born here of illegal alien parents via §5 of the 14th Amendment without a constitutional amendment...just as it did in 1870.
Beginning that year, Congress began extending offers of citizenship to various Indian tribes. Any member of a specified tribe could become an American citizen if s/he so desired. Congress thus demonstrated that using its §5 powers to enforce the provisions of the Fourteenth Amendment, it could define who was properly within the jurisdiction of the United States and who was not.
Former Vice President and 2020 Democrat presidential primary candidate Joe Biden is vowing to give Obamacare, funded by American taxpayers, to all 11 to 22 million illegal aliens living in the United States.
During an interview with Telemundo’s Jose Diaz-Balart, Biden forgot that Obamacare technically bans illegal aliens from enrolling in healthcare plans — although illegal aliens are still able to obtain subsidized and free healthcare at Americans’ expense — and promised that under his plan, all 11 to 22 million illegal aliens would be able to get Obamacare.

Biden joins Sen. Bernie Sanders (I-VT), Sen. Elizabeth Warren (D-MA), and South Bend, Indiana, Mayor Pete Buttigieg — among other 2020 Democrats — in committing to forcing American taxpayers to pay for healthcare for illegal aliens who arrive in the U.S.
Already, due to loopholes, American taxpayers are spending nearly $20 billion every year to provide illegal aliens with subsidized healthcare, emergency room visits, and other health services.
Under the 2020 Democrats’ plan to provide taxpayer-funded healthcare to all illegal aliens living in the U.S., Americans would be billed potentially $660 billion every decade just to cover the costs. Other research has found that the plan would cost Americans at least $23 billion every year.
As Breitbart News has reported, experts have said that giving taxpayer-funded healthcare to effectively all foreign nationals who can make it to America’s borders would drive “strong incentives for people with serious health problems to enter the country or remain longer than their visas allow in order to get government-funded care.”
Despite 2020 Democrats’ continued push for taxpayer-funded healthcare for illegal aliens, American voters are overwhelmingly opposed to the plan. The latest Wall Street Journal/NBC News survey revealed that the healthcare-for-illegal-aliens plan is the least popular policy position, with opposition from 62 percent of U.S. voters.
Similarly, a CNN poll from July discovered that 63 percent of likely swing voters oppose providing healthcare to illegal aliens, along with nearly 6-in-10 of all likely U.S. voters and 61 percent of moderates. A Rasmussen Reports survey also found that likely voters, by a majority of 55 percent, oppose giving healthcare to even the most low-income illegal aliens.
