Arizona told to stop prosecuting job-seeking (illegal) immigrants

A federal judge ordered an immediate halt Monday to Arizona’s enforcement of identity theft laws that penalize immigrants in the country illegally for seeking employment.



U.S. District Judge David G. Campbell said in his order that the laws are at odds with federal statutes that protect such immigrants from prosecution simply for applying for work.



Federal law makes it a crime to use falsified documents, but draws a distinction between identity theft and application to work. The application to work by an immigrant in the country illegally is not, in itself, a crime under federal law.

Arizona tried to change that. In bills passed in 2007 and 2008, Arizona changed the definition of identity theft to include attempts at employment by immigrants in the country illegally. Maricopa County Sheriff Joe Arpaio began to enforce them. 

A group of plaintiffs challenged those laws, including a woman who was convicted of identity theft and a taxpayer in Maricopa County, which includes Phoenix. They objected to using taxpayer dollars to enforce the law. Arpaio tried to get the suit thrown out of court.



The plaintiffs argued before Campbell that the federal rule on employment applications by immigrants in the country illegally supersedes Arizona law. To resolve those challenges, Campbell took into account a 1947 U.S. Supreme Court case that says courts should assume that “the historic police powers of the states” aren’t superseded “unless that was the clear and manifest purpose of Congress.”

Shameful of this LIBERAL Judge, he is anti-Christian / anti-United States of America Everything!!

You are correct Sister. Legally the judge cannot come against present laws without due process. He is doing this to avoid the legalities of it!. He wants Arizona to bow and they have every right to reject his decision as he did not use due process! He needs to make decisions against these laws and that takes much time. Liberals are noted not to obey the legal process to avoid the times that honorable Americans have to go through!

Never mind the "due process" NO FEDERAL  JUDGE CAN EVEN LAWFULLY BE IN ANY STATE,  MUCH LESS OPERATE IN IT IN ANY WAY. Kick the darn Federal court out or arrest the judge for just being there  plus his trying to dictate to the state and over-throw state law.  That is the same as any Foreigner trying to over=throw the govt - the state govt is being attacked there and they need to make an example of that Federal trespasser. The state laws are over any and all Federal anything that comes along - DC has  not real power = the STATES are who have the power ! Time the states take back their power and set things right and straight and put DC in its place instead of bowing to it.

Yes, it is law so support what you are doing. This idiot anti-American judge has no right to tell anyone to ignore present ;laws! We know BO does all the time and this judge the same! He can climb a post like he thinks his ancestors did!

The plan is to keep wages low and continue to suppress middle class americans by flooding the country with illegal aliens who are getting welfare on top of incomes from jobs they are taking from us. They get hiring preferences for being a minority.

Right on. The judge must think that the States need to get federal approval for their laws. Like most progressives he must also view the States as mere administrative units of the NATIONAL government.

TRUMP:  Trump To Give ‘Start Your Engines’ Command At Dayton

President Donald Trump will give the command for drivers to start their engines before the Daytona 500.

Daytona International Speedway officials named Trump the grand marshal for NASCAR’s season opener, meaning he will deliver the most famous four words in auto racing. “Gentleman, start your engines,” has been a staple of races around the country and world for decades.

White House spokesman Judd Deere said Thursday the president plans to attend the race. Track president Chip Wile confirmed the news in a release.

“Daytona International Speedway has been privileged to have hosted several sitting presidents of the United States over our history,” Wile said. “We’re honored that the president of the United States has chosen to experience the pageantry and excitement of ‘The Great American Race.’”

Trump is the third sitting president to attend a race at Daytona, but only the second to attend the Daytona 500. George W. Bush attended in 2004. Trump is the first to be given an honorary role in pre-race ceremonies.

Trump is scheduled to spend part of the Presidents Day weekend at his private club in Palm Beach, Florida.

The Federal Aviation Administration issued a flight restriction for Sunday and the U.S. Secret Service, which is responsible for presidential security, also tweeted to fans that drones are prohibited within 30 miles of the race in Daytona Beach — a restriction put in place for presidential visits.

Trump has hosted previous NASCAR champions at the White House and last October awarded the Presidential Medal of Freedom to motorsports titan Roger Penske. Last year, Trump also praised retired driver Mario Andretti, the Daytona 500 winner in 1967, reminiscing about a ride Andretti gave him in a race car for his reality show “The Apprentice.”

“I said, ‘Mario, get me out of here. I want to get out of this car,’” Trump recalled. “We went so fast. We literally — we covered four blocks in like a second.”
