One week after President Donald Trump fulfilled a campaign promise by curbing the arrival of refugees from several Muslim-majority countries, a senior bureaucrat at the Department of Homeland Security countermanded his presidential directive.
The acting director of U.S. Citizenship and Immigration Services of Homeland Security, Lori Scialabba, sent out a February 2 memo directing her employees to continue processing documents for refugees from the countries named by Donald Trump. The memo was leaked to The Intercept website and was made public on Document Cloud.
According to The Intercept:
LESS THAN ONE week after senior leadership at the Department of Homeland Security issued a policy guidance that threatened to bring much of the government’s asylum and refugee work to a grinding halt, a new directive issued to employees appears to reverse key elements of the procedures U.S. immigration officials are expected to follow… According to an internal memo issued Thursday by Lori Scialabba, the acting director of U.S. Citizenship and Immigration Services, the portion of Trump’s controversial ban pertaining to the issuance of visas and other benefits to immigrants from the targeted countries “does not affect USCIS adjudication of applications and petitions filed for or on behalf of individuals in the United States regardless of their country or nationality.”
The new memo, obtained by The Intercept, stands in direct contradiction to the earlier DHS guidance, which effectively blocked U.S. immigration officials from issuing decisions in any adjustment of status cases for nationals of the banned countries — including applications for permanent residency and naturalization by individuals already in the United States.
Scialabba’s actions spotlight the need for Trump to nominate his top appointees so they can clean house in the many agencies that they were elected to oversee.
Trump nominated General John Kelly as Secretary of the Department of Homeland Security, and he was confirmed January 20, but much of the implementation of the department’s policies is still controlled by holdover bureaucrats, such as Scialabba. Until they are removed, sources say, the Department of Homeland Security will not come close to implementing President Trump’s agenda, even with Kelly at the top of the organization.
“It normally takes a president more than a year to get the lion’s share of his appointees in place, leaving the management of agencies and departments in the hands of career employees who are not in position to make critical and long-term decisions,” Max Steir reported at Bloomberg Views.
We have to do more than just take the gloves off, we have to actually start swing at them and knock them down.

This is BS... Trump may fire everyone of them now and.. and appoint his own TEMPORARY leadership... Someone is giving Trump bad guidance. Hell Obama appointed Czar's extra-constitutional appointments without any Congressional authority or confirmation to do so. Let him appoint temporary Czars... The President can appoint special assistance... provide them with HIS own authority ... power to act in his capacity to run an agency until permanent help is confirmed.
Speaking of urgent needs...Trump should fire every US Attorney and Assistant US Attorney who are political appointees... these individuals can be replaced with temporary appointments also... subject to confirmation. Trump doesn't need to fill any of these vacancies... he can simply appoint temporary US Attorney's, until Congress confirms those pending permanent appointments. We don't need Obama's US Attorney's countermanding Trumps agenda by throwing cases ... get rid of them.

Yes... all US Attorney's are political appointees ... they serve at the President's will. Hence, they can be fired at will or asked to resign and if they refuse... fired. The President has the authority to assign career DOJ attorneys too fill in when the US Attorney is not available... hence, Trump can assign a temporary replacement for any US Attorney he removes... from within the Civil Service Pool... OR he can hire one directly to fill in.
That process applies to all of his cabinet positions... hence, he is not saddled with a requirement to keep the Obama appointee holdovers... he can fire them and replace them. I suppose now that Session's is AG we might see some movement to do what I have suggested.
In my meeting with a U.S. Congressman yesterday, I asked the question, "Why is it taking Congress so long to confirm Trump's appointments and why is congress dragging their feet on subjects like ACA, immigration, building the military and all the other issues Trump wants to do?"
His answer: "The leadership, Jim. That's about all I can say about it." He introduced a bill on "Term Limits" and told me the leadership wouldn't even read it, let alone send it to committee.
After talking with him, there is only one conclusion to come to! "Don't throw stones, when you live in a glass house."
We, Republicans and conservatives, have the power to do what ever we want. HOWEVER, we all know that the leadership of both the House and Senate, hate Trump and will back stab him at every turn, yet most people are still blaming the demorats for the slow action that the congress is moving.
IT ISN'T THE DEMORATS, IT'S THE RHINO REPUBLICANS THAT IS CAUSING THE MAJORITY OF THE PROBLEMS!
The American people woke up and elected Trump, NOW we have to wake them up, to remove the Rhino's like, the song bird Mccain, the back stabber Ryann, the hillbilly Mcconnell and all the rest of those that will not comply with what the Conservative movement stands for.
