Back in 2010, the Democrats who would not let their fellow congresscritters see the “Affordable” Care Act, known as “ObamaCare,” before it was passed thought they were so smart. Due to the stupidity of the American voter, the people were going to all end up enrolled in government approved health insurance programs that people with pre-existing conditions could enroll in, and all the healthy young people would pay for the sick older people….
The triumphant elite forgot one little thing. Despite Common Core, Americans still know how to do real, simple math, and the majority know how to budget on a limited income. (It’s called survival.)
The Affordable Care Act was, from the time we all got a good look at it, decidedly UNAFFORDABLE. So, the American people who needed health insurance started looking around for alternatives since the deductibles made the insurance itself unusable for many people. (The idea was to keep costs down. Well, not going to the doctor, and not using the insurance at all definitely keeps costs down.) For people who aren’t sick, paying the fine just made more sense, as it was cheaper in the long run.
As it happens, the policies that ObamaCare was designed to drum out of the market – short term policies renewable annually, and at any time with a cap on outlays, and not paying for a number of prescription drugs – are actually still available even if they are not ACA compliant. Not only are they still available, but even with the federal fine for not being ACA compliant, they are a heck of a lot cheaper than regular ACA policies that must be purchased during an open enrollment period. From the Wall Street Journal:
Robin Herman, the 34-year-old owner of a marketing firm in San Francisco, bought a short-term policy in December. The monthly cost of her short-term coverage, plus conventional ACA-compliant plans for her two children, is roughly one-quarter of what she would have paid for conventional health plans covering all three of them, she says.
“This is saving me a ton of money for the year,” she said, despite the penalty. Plans that comply with the health law’s rules cost more than her old pre-ACA policy and are “just not affordable,” she said.
Savings. The reason why Americans are turning to the old ways of buying health insurance is plain and simply to save money. ObamaCare otherwise would be bankrupting them.

Not exactly. The "old way" way was an anti-trust immune, rigged access to healthcare bought from federal Congress by health insurance lobbyists over decades. This permitted the industry to restrict cost-shared membership pools to job-related access (by healthy workers not likely to need extensive medical care), or astronomically expensive individual plans if offered at all.
Ultimately the upshot was that the health insurance industry re-aligned its pre World War ll goal from providing health care access for people to premium collection.
Their excuse; malpractice payouts and geriatric baby boomer costs could not be sustained.
That notion is correct. But lawyers intentionally molested the insurance industry and health care providers for profit. So noting that they are all a bunch of louses does not even begin to cover it, since both the insured and uninsured ill bear the burden for it all.
Tort reform is the true solution short of a personal lack of professional integrity. Or perhaps society needs to amp up its commonly held expectations of its members morality. "JUST DO'IN MY THING" that unduly injures others has an amoral tinge that is not self-justified.
People with this attitude ought not to be able to console themselves with their guilt by "crying all the way to the bank".
A lot of businesses are getting around it by breaking up their employees into smaller "companies". Many hotels are splitting out employees and claiming them as a separate company. Like the housekeepers are a "company", the restaurant staff a "company", etc. Each company has less than 50 employees, so then doesn't have to pay for their health insurance...
Why even pay the fine? All you have to do is get one utility turn off notice and you are EXEMPT from the fine.
Just don't pay your electric bill one month and when you get the turn of notice, pay it immediately and WALA, you are exempt from having Obamacare!
It wouldn't be a problem if our CONGRESS had READ the ACA bill before passing it into law! Executive Orders can be bypassed if the Congress works at it! But they will not!

Election candidacy, like healthcare costs, has been made to be expensively beyond the reach almost everyone. That would be a definition of shunting one of the few avenues of Constitutional redress to be used by the citizenry, until failure of them all provokes justifiable civil uprising and overthrow. IMOaJ
